Agenda 01/08/2019 Item #16A 201/08/2019 EXECUTIVE SUMMARY Recommendation to award Invitation to Bid (ITB) # 18-7460 for “Mitigation Credits” for a multi- year contract term to vendors on a primary and secondary basis. OBJECTIVE: To have firms under contract that can provide mitigation credits t o satisfy permitting requirements in a timely manner. CONSIDERATIONS: Many County Projects require an environmental permit from permitting agencies (i.e. South Florida Water Management District (SFWMD), Army Corps of Engineers (ACOE) and Florida Department of Environmental Protection (FDEP). Collier County is required to provide compensatory mitigation to offset unavoidable wetland, other surface waters, and endangered species impacts. Federal and State agencies require mitigation credits as a condition of environmental permit approval. These impacts can be offset by purchasing credits at a Mitigation Bank. On August 9, 2018, the Procurement Services Division released notices of ITB # 18 -7460 for “Mitigation Credits” to 5,760 vendors. Interested vendors downloaded forty-eight (48) bid packages, and the County received four (4) bids by the September 10, 2018 deadline. The four (4) vendors were all found responsive and responsible. Awards have been established and are recommended on a per line item basis to a primary and a secondary vendor (where available). Staff is recommending awarding the contracts to Corkscrew Mitigation, LLC; LPI Wetland Mitigation Bank Ltd.; Panther Passage Conservation, LLC; and Southwest Florida Wetlands Joint Venture, as follows: Line Item Description Corkscrew Mitigation, LLC LPI Wetland Mitigation Bank Ltd. There were ties on the bids for lines 1a - Herbaceous Freshwater (UMAM) and 4a - Forested Freshwater (UMAM). In those instances, the Procurement Services Director followed the processes outlined in the County’s Procurement Manual, 11a PROCUREMENT METHODS (PURCHASES IN EXCESS OF $50,000), to break the tie. The contract term is for three (3) years with two (2) one (1) year renewal option. It is the intent of the County to award to the lowest bid per line item, consistent with the above identified primary and secondary vendors. FISCAL IMPACT: Funds for these services shall come from each using department's budgets as projects requiring mitigation credits are identified. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board approval. -SRT GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the Long-Range Transportation Plan and the Collier County Growth Management Plan. RECOMMENDATION: To award ITB # 18-7460 for “Mitigation Credits” Corkscrew Mitigation, LLC; LPI Wetland Mitigation Bank Ltd.; Panther Passage Conservation, LLC; and Southwest Florida Wetlands Joint Venture, on a primary and secondary basis, and authorize the Chairman to sign the attached Agreements with each vendor. TERM OF CONTRACT The contract term, if an award(s) is/are made is intended to be for three (3) years with two (2) one (1) year renewal option . Prices shall remain firm for the initial term of this contract. Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. The County Manager, or designee, may, at his discretion, extend the Agreement under all of the terms and conditions contained in this Agreement for up to one hundred eighty (180) days. The County Manager, or desig nee, shall give the Contractor written notice of the County's intention to extend the Agreement term not less than ten (10) days prior to the end of the Agreement term then in ef fect. All goods are FOB destination and must be suitably packed and prepared to secure the lowest transportation rates and to comply with all carrier regulations. Risk of loss of any goods sold hereunder shall transfer to the COUNTY at the time and place of delivery; provided that risk of loss prior to actual receipt of the goods by the COUNTY nonetheless remain with VENDOR. DETAILED SCOPE OF WORK Due to the number of County Projects that require the use of mitigation credits due to permitting requirement s (i.e., South Florida Water Management District (SFWMD), Army Corps of Engineers and Florida Department of Environmental Protection (FDEP), it is deemed to be in the best interest of the County to have firms on contract who are able to provide mitigation credits in a timely manner. Services to be provided shall include but not be limited to the following: • Herbaceous Freshwater credits • Herbaceous Saltwater credits • Forested credits • Forested Freshwater credits • Forested Saltwater credits • Saltwater credits • Panther Habitat Units • Other Endangered Species credits Firms must have expertise, experience and a track record in providing mitigation bank credits. The selected firms shall be re sponsible for knowledge of, and compliance with, all releva nt local, state and federal codes and regulations, including compliance with any SFWMD, Army Corps of Engineers, or FDEP permit requirements. All bidders must possess the proper qualifications and resources necessary to meet their mitigation obligations fo r a particular project. Bidders must have credits available immediately upon award of a project in order to satisfy permitting requirements unless ot herwise approved in writing by the County Project Manager or their designee. The County reserves the right to order such services from selected firms as may be required during said period but does not guarantee any minimum or maximum services to be ordered during the period specified from any given firm.
