Agenda 01/08/2019 Item #11D01/08/2019 EXECUTIVE SUMMARY Recommendation to approve the Tourist Development Council’s (TDC) recommendation to have the Board of County Commissioners direct staff to research the impact of short -term vacation home rentals in Collier County, other County’s and municipalities actions on the issue, and to generate a report to the TDC and Board for a recommendation on action. ____________________________________________________________________________________ OBJECTIVE: To evaluate the positive and negative issues related to the short-term vacation rental business in Collier County utilizing current research and comparable data with other Florida Counties and bring back a report to the TDC and the Board for further guidance. CONSIDERATIONS: The Collier County Tourist Development Council (TDC) has expressed concerns over the past three years on the negative impact of the private transient rental market with respect to tax collections, health and safety, and compatibility with adjacent residential properties. The private transient rental market of vacation rentals in condominiums and private homes within Collier County and throughout the state continues to grow and evolve. Some Counties in Florida have taken definitive action to create new ordinances to regulate th is type of short term rental. The Collier County Tax Collector has worked with companies such as Air BnB, Inc. for several years to try and come to an agreement on how to regulate these rentals and to ensure the all applicable taxes are being collected and paid by the homeowner. To date, no agreement has been reached on transparency issues related to AirBnB, Inc. and other companies in this market space. Collier County has an existing provision in the Land Development Code (LDC) addressing vacation rentals that prohibits short term rentals of six months or less in certain areas of the unincorporated area. In the past, County Code Enforcement has investigated possible violations of this prohibited practice on a complaint by complaint basis. At their November 26, 2018 meeting, TDC members discussed the issue of short-term vacation rentals and recommended that the Board direct County staff to research the history of short -term rentals, the current situation in Collier County, and the future of these types of accommodations throughout Florida. FISCAL IMPACT: Further research will be undertaken to determine the fiscal impact. Funds exist within the FY 19 Tourism operating budget. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan with this Executive Summary. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issue at this time, and requires majority vote for approval. Should the Board approve this item, this Office will work with the County Manager in bringing back a report with recommendations.
