DEe ~ \~~ 1Eq¡l/¡¡) i ~ ð O.t' ~l.'l~ o~6~~' AN ORDINANCE OF THE BOARD OF COUNTY COMMISSIONER COLLIER COUNTY, FLORIDA, AMENDING CHAPTER 42, ARTICLE II, DIVISION 2 OF THE CODE OF LAW AND ORDINANCES DERIVED FROM ORD. NO. 90-60, AS AMENDED, PERTAINING TO THE CITIZENS ADVISORY TASK FORCE; ELIMINATING THE TASK FORCE; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR INCLUSION IN THE CODE OF LAWS AND ORDINANCES; AND PROVIDING FOR AN EFFECTIVE DATE. Ordinance No. 2005- 68 WHEREAS, the Board of County Commissioners has adopted Resolution No. 85-236 t:reating a Citizens Advisory Task Force; and WHEREAS, Collier County Ordinance No. 90-60 previously set forth the requirements, functions, power, and duties of the Citizens Advisory Task Force; and WHEREAS, the established mission for the Citizens Advisory Task Force is to review and make recommendations to the board of county commissioners relative to all phases of the small cities community development blot:k !:,'Tant program; and WHEREAS, Collier County has become a Federal Entitlement County and is no longer eligible to participate in, and no longer receives funding through, the Small Cities Community Blot:k Grant Program; and WHEREAS, the publit: participation duties tor the Federal Entitlement CDBO Program now rest with the Affordable Housing Commission; and WHEREAS, it is the desire of the Board of County Commissioners to amend certain sections of the Code of Laws and Ordinance in order to repeal provisions pertaining to the Citizens Advisory Task Force. NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY· COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: SECTION ONE. Amendment of Sections of Chapter 42. Appointment and eomposition. (a) Thc advisory task forcc creatcd by this division shall be composed of five members. The composition of the tusk forcc shall be us fùllmvs: (l) One representative ofthc social services or social scienccs or a eommunity leader; (2) One representative of a minority group; (3) Tv..o reprcsentativcs of thc community at large; (4) One business leader. (b) Members of the task force shall bc appointed by and scrve at the pleasurc of the bourd of coulliy-tõümmissioners. See. 42 38. Terms of oftìec. (u) The initial terms ofottice ofthe members of the task force created by this division shall be us follows: (I) Three mcmbers vlÍll serve until December 31, 1991. (2) Tv..o members '.vill serve until December 31, 1992. (b) Thereafter, each appointment or reappointment shall be for Ii term of t'NO years. ¡\ mcmber of thlJ tusk foroe may be reappointed by the board of county conunissioners for one suceessive term. See. 42 39. Removal from offiee; failure to attend meetiBgs. (a) f.ny member of the task force created by this di';ision may be removed trom office,. '..v~th or '.."ithout cause, by u majority vote of the board of county commissioners. See. 42 40. Officers; quorum; rules of proeedure. (a) (b) (c) ,^.nnually the membership of the task force created by this division shall elect a chairman and vice chairman tì'Olll among the members. Officers' terms shall be for one year with eligibility for reelectiOll. The presence of three or more members of the task f{)rce shall eonstitute a quorum necessary to tuke action and trullsact business, In addition, un uftinnutivt: vttttHtf three or more members shall be llecessary in order to take official actioft;- regardless of whdher three or more members of the tusk force arc present at the mectillg. The task force shall, by majority vote of the entire membership, adopt rules of proccdure for the transaction, of business and shall keep a \vritten record of meetings, resolutiollS, findings und determinations. Copies of all minutæ, resolutions, reports, und ~ibits shull be submitted to the bourd of l:ounty ëefflmlSSlOners. See. 42 41. Reimburseluent of expenses. Members of the task force created by this di,..ision shall serve '.vithout compensutioll, but shull bt: entitled to receive reimbursement for expenses reasonably incurred in the performance of their duties upon prior upproval of the board of COUllty commiSSIOners. See. 42 42. Functions, powers and duties. The funetions, powcrs and duties of the task force created by this division shall be as follo'Ns: (I) The task force shall review and make recommendations to the board of county commissioners relative to all phases of the small cities community development block grunt program. (2) The task force may adopt and amend guidelines to govem their operation subject to approval by the board of county commissioners. See. 42 43. Duties of administrator. The duties of the eommunity development administrator or his designee shall be: (I) To administer the activities of the small cities cOI'nmunity development block grant pro gram. (2) To provide periodic written reports to the task foree, the oounty administrator, and thj;j board of county commissionom on tho acti·..ities of the small oities community devt!lopment block grant program and its finances in accordunce with the agreement bet\veen the state department of community affuirs and the county, dated Septcmber 29, 1989. This tusk force shall be reviewed once every f'Ûur years commencing in 1991, in uccordanee with the procedures contained in chapter 2, ul1icle VIII, division 2 of this Gøtk Sees. 42 45 42 55. Rcser...ed. SECTION TWO: Conflict and Severability. In the event this Ordinance contlicts with any other ordinance of Collier County, the more restrictive shall apply, If any phrase or portion of this Ordinance, or the particular application thereof~ shall be held invalid or unconstitutional by any court, administrative agency or other body with appropriate jurisdiction, the remaining section, subsection, sentences, clauses or phrases alld their application shall not be affected thereby, SECTION THREE: Inclusion in the code of laws and ordinances. The provisions of this ordinance shall become and made a part of the Code of Laws and Ordinances of Collier County, Florida. The sections of the Ordinance may be renumbered or relettered to accomplish such, and the word "ordinance" may be changed to "section", "article", or other appropriate word. SECTION FOUR: Effective Date. This Ordinance shall become effective upon filing with the Florida Department of State.
