Agenda 12/11/2018 Item #16A 312/11/2018 EXECUTIVE SUMMARY Recommendation to approve the release of two code enforcement liens with an accrued value of $8,333.23 for payment of $1,133.23 in the code enforcement actions entitled Board of County Commissioners v. Wayne Ray Finzer, Code Enforcement Board Case Nos. CENA20140013503 and CENA20170011622 relating to property located at 2675 Storter Ave, Collier County, Florida. OBJECTIVE: For the Board of County Commissioners to accept an offer to release two code enforcement liens with an accrued value of $8,333.23 for payment of $1,133.23 in relation to Code Enforcement Board Case Nos. CENA20140013503 and CENA20170011622. CONSIDERATIONS: As a result of code violations at 2675 Storter Ave, consisting of grass/weeds in excess of 18 inches in height. The lien (CENA20140013503) was recorded in the Official Records on January 15, 2015, at O.R. Book 5112, Page 1399. The lien amount of $1,506.28 is based on 24 days of accrued fines ($50 per day from September 13, 2014 through October 6, 2014) $1,200 plus a $230.28 in operational costs and abatement costs of $76.00. The lien (CENA20170011622) was recorded in the Official Records on April 16, 2018, at O.R. Book 5498, Page 1956. The lien amount of $6,826.95 is based on 130 days of accrued fines ($50 per day from September 9, 2017 through January 16, 2018) $6,500 plus a $226.95 in operational costs and abatement costs of $100. The property was acquired by Solex 55, LLC, via Warranty Deed recorded on August 27, 2018. The violations were abated by the previous owner. Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when a code enforcement lien encumbers property that is under new ownership and compliance has been achieved within 30 days. The property is being actively maintained and $500 has been paid in settlement of fines and $633.23 in operational and abatement costs were previously paid. The new owner is requesting a waiver of $7,200 in accrued fines. There are currently no known violations. FISCAL IMPACT: Payment of $500 has been made, representing $500 in fines, $633.23 were previously paid representing operational costs and abatement costs. If approved by the Board, accrued fines in the amount of $7,200 would be waived. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it as to form and legality. Majority support is required for approval. This item conforms to the Board’s policy contained in Resolution 2012-46. KN RECOMMENDATION: To waive the fines in the amount of $7,200, accept payment amount of $500, release the lien, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in the Official Public Records.
