EXECUTIVE SUMMARY
Recommendation to authorize the County Attorney to initiate any legal action he deems necessary
to prevent a residential home from being used in a manner which creates a public nuisance.
OBJECTIVE: To ensure that alleged illegal drug activities do not reoccur at a private residence.
CONSIDERATION: For the past few months Commissioner Taylor, the Collier County Sheriff’s Office
and the Collier County Code Enforcement Division have received numerous complaints by the
neighborhood of suspected illegal drug activity occurring at 3339 Canal Street, Naples, FL 34112.
Coordinated efforts led to recent arrests by the Sheriff’s Office for drug possession and/or drug
paraphernalia on individuals on, or who had just left, the premises.
Discussions with the absentee property owner were then conducted. Following these discussions, the
individuals who were primarily responsible for these activities appear to have left the property and the
activities have apparently ceased, although the actual tenant remains.
To ensure that this pattern of activity does not resume, the County Attorney would like Board
authorization to commence immediate action should these activities reoccur in the near future.
Depending upon the circumstances, such legal action would include commencing a proceeding with the
Collier County Code Enforcement Board convening as the Nuisance Abatement Board, or seeking
injunctive relief in Court.
FISCAL IMPACT: None at this time. If court action is necessary, there would be an estimated $200.00
in filing fees that the County would seek to recover if the County were successful in a Circuit Court
action seeking an injunction, or other relief.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners authorize the County Attorney to
initiate any legal action he deems necessary to prevent a residential home from being used in a manner
which creates a public nuisance.
