Agenda 11/13/2018 Item #16K 511/13/2018 EXECUTIVE SUMMARY Recommendation to approve a Stipulated Final Judgment for final compensation in the amount of $87,500 for Parcel 300RDUE, plus $18,381 in statutory attorney fees and costs, and $2,967 for expert fees and costs, in the lawsuit styled Collier County v. BLD Associates, LLC, et al, Case No. 16- CA-1214, required for the Golden Gate Boulevard Expansion Project No. 60145. (Fiscal Impact: $46,348). OBJECTIVE: To settle full compensation owed for the taking of Parcel 300RDUE required for the expansion of roadway and related drainage and utility improvements to Golden Gate Boulevard (Project No. 60145), hereinafter referred to as the “Project.” CONSIDERATIONS: On November 18, 2016, the County condemned Parcel 300RDUE and deposited $62,500 into the Court registry as a good faith estimate of value pursuant to an Order of Taking in the lawsuit styled Collier County v. BLD Associates, LLC, et al, Case No. 16-CA-1214. The parcel was required for the construction of the Project and is a flag-shaped 53,411 square foot perpetual, non- exclusive, road right-of-way, drainage and utility easement, with the eastern portion of the property bordering the Miller Canal. This easement was acquired for the road improvements, as well as the construction of a boat ramp for access to the canal and a concrete turn-around/parking area for County official use only. An aerial of the property is attached. Appraisers for both parties agree that the size, shape and use of the easement area damages the value of the remainder property by approximately 90-95%. The remainder’s shape and size are irregular, and the setbacks make it undesirable for the development of a home. The appraisals opine that the highest and best use is arguably assemblage with the neighboring property after the taking leaving only nominal value to the remainder. The County attempted to negotiate the purchase of the entire property, but the property owner elected to retain ownership of the remainder. This matter was set for mediation on October 30, 2018, and the property owner’s appraisal set the value of the parcel at $94,900. Through negotiations prior to mediation, the parties agreed to a settlement of $87,500 as final compensation for the property interest taken and any damages, plus $18,381 for statutory attorney fees, and $2,967 for expert fees. If approved, the County will be obligated to pay an additional $46,348 over the amount on deposit. The County Attorney’s Office and Staff recommend approval of this Stipulated Final Judgment since a better result is not anticipated at trial. Upon approval, the County Attorney’s Office will file the attached Joint Motion for Stipulated Final Judgment with the Circuit Court. FISCAL IMPACT: Funds in the amount of $46,348 will be paid from impact fees from the Golden Gate Boulevard Expansion Project No. 60145. The primary funding source for the acquisition of right -of-way is impact fees. Should impact fees not be sufficient within a particular project, the secondary funding source will be gas taxes. GROWTH MANAGEMENT IMPACT: None.
