COLLIER COUNTY WATER -SEWER DISTRICT UNIFORM BILLING,
OPERATING AND REGULATORY STANDARDS ORDINANCE; TO
INCLUDE PROPOSED WATER -SEWER RATES INCREASES OF 2.7
PERCENT, WATER RATE INCREASE OF 5 PERCENT FOR
GOODLAND SUB - DISTRICT, WITH AN EFFECTIVE DATE OF
OCTOBER 1, 2010.
WHEREAS, on December 11, 2001 the Board of County Commissioners adopted an
Ordinance No. 2001 -73, entitled the Collier County Water -Sewer District Uniform Billing,
Operating and Regulatory Standards Ordinance, and increased the water -sewer user rates and
directed staff to update the user rates after one year; and
WHEREAS, on June 6, 2006 the Board of County Commissioners adopted an Ordinance
No. 2006 -27, entitled the Collier County Water -Sewer District Uniform Billing, Operating and
Regulatory Standards Ordinance, and increased the water -sewer user rates and directed staff to
update the user rates after one year; and
WHEREAS, Collier County uses water and sewer user rates to recover system operation,
maintenance, renewal enhancement, replacement and debt service costs from residential and
non - residential property owner system users within the boundaries of the Collier County Water -
Sewer District; and
WHEREAS, on June 24, 2008 the Board of County Commissioners adopted Resolution
No. 2008 -203 amending Ordinance No. 2006 -27 and increasing the water and sewer user rates in
Schedule One; meter tapping charges and backflow devise charges in Schedule Four; equipment,
labor and administration charges in Schedule Five; and miscellaneous charges in Schedule Six;
and
WHEREAS, On June 10, 2003 the Board of County Commissioners adopted
Resolution No. 2003 -211 amending Ordinance No. 2001 -73 and increasing the water rate in
Schedule Two; Goodland Water- Sub - District; and
WHEREAS, Resolution No. 2008 -203 also proclaimed the price indexing rate
adjustment in the mid -cycle years when the Water -Sewer District does not conduct a rate study;
and the increase is to be calculated by applying one hundred percent (100 %) of the percentage
change in the Miami -Fort Lauderdale Consumer Price Index (CPI) for all urban consumers as
reported by the Bureau of Labor Statistics as of April each year or 2.7% whichever is greater, to
the monthly service availability charges and consumption / volumetric charges. This indexing
will go into effect on October 1, of each mid -cycle year when the Water -Sewer District does not
conduct a rate study; and

WHEREAS, the Staff has recommended increasing the water and sewer user rates
applicable to single family residential, multi - family residential, and commercial customers as
specified in the attached amending Schedule One; increase the water rates for the Goodland
customers as specified in the attached amending Schedule Two; change the term Backflow
Device to Cross Connection Control Device, and also include language to charge actual costs
where work is undertaken by subcontractors in Schedule Four; insert rates for equipment not
previously included, for staff grades not previously included, and other charges not previously
included, in order to fully reflect the equipment, labor, and administrative costs of work
undertaken in Schedules Five and Six; and
WHEREAS, the Board finds that it is in the health, safety and welfare to accept the
recommendations of the staff.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
The Board of County Commissioners, after advertised public hearing:
1. Accepts the staff's recommendation and proclaims that the water and sewer user rates
for the water -sewer district and water rates for the Goodland Sub - District as set forth in
the amended Schedule One and Schedule Two to Appendix A of Ordinance No. 2006 as
amended, titled the Collier County Water -Sewer District Uniform Billing, Operating and
Regulatory Standards Ordinance, which amended Schedule is incorporated herein. These
revised water and sewer user rate schedules will take effect at 12:01 A.M. on Friday,
October 1, 2010 for Fiscal Year 2011 and at 12:01 A.M. on Friday, October 1, 2010 for
Fiscal Year 2011 for Schedules Two, Four through Six.
This Resolution is adopted after motion; second and majority vote favoring adoption this
_day , 2010.

3. Fire Systems (Dedicated and Compound):
(a) Fire Meter
(i) Fire Service meter size will refer to the largest diameter meter register
installed for fire protection.
(ii) Fire Service meter connections that have consumption in excess of 5,000
gallons in any one billing period are deemded to have provided domestic
or other water usage and shall be billed according to regular water
monthly availability and usage charges as described herein.

Pursuant to Chapter 40E -21 of the Florida Administrative Code (FAC)
The surcharge will be applicable to the volume charge for all single family and multi-
family residential accounts for all consumption greater than Block 2, to non - residential
accounts for all consumption greater than Block 1, and to irrigation accounts only for all
consumption. The Block Structures are specified in Section One above. The surcharge is
not assessed against the service availability charge.
The water restriction surcharge will start on the first billing cycle of the month following
the imposition of the restrictions. The surcharge will cease on the first billing cycle of the
month following the revocation or lifting of the restrictions.

EXECUTIVE SUMMARY
Recommendation to adopt a Resolution amending schedules one, two, and four
through six of Appendix A to Section Four of the Collier County Ordinance No.
2006 -27, the Collier County Water -Sewer District Uniform Billing, Operating and
Regulatory Standards Ordinance. This amendment includes proposed water -sewer
rate increases of 2.7 percent for the Collier County Water -Sewer District and 5
percent for Goodland Sub - District, with an effective date of October 1, 2010.
OBJECTIVE: Adopt a Resolution amending schedules one, two, and four through six
of Appendix A to Section Four of the Collier County Ordinance No. 2006 -27, the Collier
County Water -Sewer District Uniform Billing, Operating and Regulatory Standards
Ordinance. This amendment includes proposed water -sewer rate increases of 2.7 percent
for the Collier County Water -Sewer District and 5 percent for Goodland Sub - District,
with an effective date of October 1, 2010.
CONSIDERATIONS: Water and sewer user fees, fire meter, and surcharge fees are
used to recover operation, maintenance, renewal, enhancement, replacement, and debt
service costs from residential and non - residential property owner system users within the
boundaries of the Collier County Water -Sewer District.
On June 24, 2008, the Board of County Commissioners (Board) adopted Resolution No.
2008 -203 amending Ordinance No. 2006 -27 and increasing the water and sewer user
rates in schedule one; meter tapping charges and backflow device charges in schedule
four; equipment, labor and administration charges in schedule five; and miscellaneous
charges in schedule six.
Resolution No. 2008 -203 also proclaimed the price indexing rate adjustment in mid -cycle
years when the Water -Sewer District does not conduct a rate study. The increase is
calculated by applying 100 percent of the percentage change in the Miami -Fort
Lauderdale Consumer Price Index (CPI) for all urban consumers as reported by the
Bureau of Labor Statistics as of April each year, or 2.7 percent, whichever is greater.
As of April 2010, the CPI change reported by the Bureau of Labor Statistics was 0.9
percent. Therefore, staff recommends a rate increase of 2.7 percent for water and
wastewater availability and consumption charges effective October 1, 2010. This
increase is fully compliant with the FY11 Budget presented to the Board on June 24,
2010.
On June 10, 2003, the Board adopted Resolution No. 2003 -211 to increase the water rates
for the Goodland Sub - District by amending schedule two of Appendix A to section four
of the Collier County Ordinance No. 2001 -73.

There has been no rate increase for the Goodland Water Sub - District since October 1,
2004. However, the cost of bulk water purchased from the City of Marco Island Utilities
has steadily increased each year since then. In addition, the aging infrastructure of the
Goodland service area demands more repairs and maintenance related work. To assess
the revenue requirements for the Goodland Sub - District, staff has retained the services of
Public Resource Management Group to make a recommendation regarding the
appropriate rates necessary to support the operation of that system. In the meantime, to
replenish the shortfalls in funds and to avoid jeopardizing maintenance of the system and,
thereby, avoid risking the customers' health and safety, staff recommends a rate increase
of 5 percent for Goodland rate payers, effective October 1, 2010. Staff met on April 20,
2010, with residents and representatives of the Goodland ratepayers to explain the
financial situation and the need for a rate increase. This increase is fully compliant with
the FYI I Budget presented to the Board on June 24, 2010.
The following changes are proposed to Collier County Ordinance No. 2006 -27, Appendix
A, schedules four, five, and six.
Schedule four is amended to replace the term "Backflow Device" with the term
"Cross Connection Control Device," and to also include language to charge actual
costs where work is undertaken by subcontractors.
Schedules five and six are amended to insert rates for equipment not previously
included, for staff grades not previously included, and other charges not
previously included, in order to fully reflect the equipment, labor, and
administrative costs of work undertaken.
Proposed changes to schedules one, two, four, five, and six are attached, with an effective
date of October 1, 2010. No changes are proposed at this time to schedules three
(Irrigation Quality Water) and seven (Allowance for Funds Prudently Invested).
FISCAL IMPACT: The additional revenue anticipated to be generated by the
recommended water and sewer user rate changes for FY11 totals $2,511,000 broken
down as follows.

LEGAL CONSIDERATIONS: The proposed Resolution has been approved for legal
sufficiency by the Office of the County Attorney. -JBW
GROWTH MANAGEMENT IMPACT: The proposed water and sewer rates are
designed to provide the requisite funding for the operation, maintenance, renewal,
enhancement, replacement, and debt service costs of the Collier County Water -Sewer
District. These rates also provide supplemental funding for water and sewer capital
improvements identified in the 2008 Water and Wastewater Master Plan Updates
approved by the Board on June 24, 2008.
RECOMMENDATION: Adopt a Resolution amending schedules one, two, and four
through six of Appendix A to Section Four of the Collier County Ordinance No. 2006 -27,
the Collier County Water -Sewer District Uniform Billing, Operating and Regulatory
Standards Ordinance. This amendment includes proposed water -sewer rate increases of
2.7 percent for the Collier County Water -Sewer District and 5 percent for Goodland Sub -
District, with an effective date of October 1, 2010.

PERCENT, WATER RATE INCREASE OF 5 PERCENT FOR
GOODLAND SUB - DISTRICT, WITH AN EFFECTIVE DATE OF
OCTOBER 1, 2010.
WHEREAS, on December 11, 2001 the Board of County Commissioners adopted an
Ordinance No. 2001 -73, entitled the Collier County Water -Sewer District Uniform Billing,
Operating and Regulatory Standards Ordinance, and increased the water -sewer user rates and
directed staff to update the user rates after one year; and
WHEREAS, on June 6, 2006 the Board of County Commissioners adopted an Ordinance
No. 2006 -27, entitled the Collier County Water -Sewer District Uniform Billing, Operating and
Regulatory Standards Ordinance, and increased the water -sewer user rates and directed staff to
update the user rates after one year; and
WHEREAS, Collier County uses water and sewer user rates to recover system operation,
maintenance, renewal enhancement, replacement and debt service costs from residential and
non - residential property owner system users within the boundaries of the Collier County Water -
Sewer District; and
WHEREAS, on June 24, 2008 the Board of County Commissioners adopted Resolution
No. 2008 -203 amending Ordinance No. 2006 -27 and increasing the water and sewer user rates in
Schedule One; meter tapping charges and backflow devise charges in Schedule Four; equipment,
labor and administration charges in Schedule Five; and miscellaneous charges in Schedule Six;
and
WHEREAS, On June 10, 2003 the Board of County Commissioners adopted
Resolution No. 2003 -211 amending Ordinance No. 2001 -73 and increasing the water rate in
Schedule Two; Goodland Water- Sub - District; and
WHEREAS, Resolution No. 2008 -203 also proclaimed the price indexing rate
adjustment in the mid -cycle years when the Water -Sewer District does not conduct a rate study;
and the increase is to be calculated by applying one hundred percent (100 %) of the percentage
change in the Miami -Fort Lauderdale Consumer Price Index (CPI) for all urban consumers as
reported by the Bureau of Labor Statistics as of April each year or 2.7% whichever is greater, to
the monthly service availability charges and consumption / volumetric charges. This indexing
will go into effect on October 1, of each mid -cycle year when the Water -Sewer District does not
conduct a rate study; and
WHEREAS, the Staff has recommended increasing the water and sewer user rates
applicable to single family residential, multi - family residential, and commercial customers as
specified in the attached amending Schedule One; increase the water rates for the Goodland
customers as specified in the attached amending Schedule Two; change the term Backflow
Device to Cross Connection Control Device, and also include language to charge actual costs
where work is undertaken by subcontractors in Schedule Four; insert rates for equipment not
previously included, for staff grades not previously included, and other charges not previously
included, in order to fully reflect the equipment, labor, and administrative costs of work
undertaken in Schedules Five and Six; and
WHEREAS, the Board finds that it is in the health, safety and welfare to accept the
recommendations of the staff.
NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
The Board of County Commissioners, after advertised public hearing:
1. Accepts the staff's recommendation and proclaims that the water and sewer user rates
for the water -sewer district and water rates for the Goodland Sub - District as set forth in
the amended Schedule One and Schedule Two to Appendix A of Ordinance No. 2006 as
amended, titled the Collier County Water -Sewer District Uniform Billing, Operating and
Regulatory Standards Ordinance, which amended Schedule is incorporated herein. These
revised water and sewer user rate schedules will take effect at 12:01 A.M. on Friday,
October 1, 2010 for Fiscal Year 2011 and at 12:01 A.M. on Friday, October 1, 2010 for
Fiscal Year 2011 for Schedules Two, Four through Six.
This Resolution is adopted after motion; second and majority vote favoring adoption this

3. Fire Systems (Dedicated and Compound):
(a) Fire Meter
(i) Fire Service meter size will refer to the largest diameter meter register
installed for fire protection.
(ii) Fire Service meter connections that have consumption in excess of 5,000
gallons in any one billing period are deemed to have provided domestic or
other water usage and shall be billed according to regular water monthly
availability and usage charges as described herein.

Pursuant to Chapter 40E -21 of the Florida Administrative Code (FAC)
The surcharge will be applicable to the volume charge for all single family and multi-
family residential accounts for all consumption greater than Block 2, to non - residential
accounts for all consumption greater than Block 1, and to irrigation accounts only for all
consumption. The Block Structures are specified in Section One above. The surcharge is
not assessed against the service availability charge.
The water restriction surcharge will start on the first billing cycle of the month following
the imposition of the restrictions. The surcharge will cease on the first billing cycle of the
month following the revocation or lifting of the restrictions.
