Recovered materials as described above are not solid waste. Rule 62-701.200 (95). F.A.C. "Reeycling" has the meaning given to it in Kale 62 701.2QQ (67) P./..C. "Recvcling" means anv process bv which solid waste. or materials which would otherwise become solid waste. are collected. separated. or processed and reused or returned to use in the form of raw materials or products. Rule 62- 701.200 (99). F.A.C. "SoM waste" has the meafling gi';en te it in Rule 62 701.2QO(73) L^..C. "Solid Waste" means: sludge that is not regulated under the federal Clean Water Act or Clean Air Act. as well as sludge from a waste treatment works. water supplv treatment plant. or air pollution control faeility: or garbage. rubbish. refuse. special waste. or other discarded material. including solid. liquid. semi-solid. or contained gaseous material resulting from domestic. industrial. commercial. mining. agricultural. or governmental operations. Materials not regulated as solid waste pursuant to this chapter are: recovered materials: nuclear source or byproduct materials regulated under Chapter 404. F.S.. or under the Federal Atomic Energv Act of 1954 as amended: suspended or dissolved materials in domestic sewage effluent or irrigation retum flows. or other regulated point source discharges: regulated air emissions: and fluids or wastes associated with natural gas or crude oil exploration or production. Rule 62-701.200 (107). F.A.C. "Soil" means fragmental material composed of earth. sand and rock. It also includes ash. mineral particles. other non-odorous earth-like materials or combinations thereof. suitablv graded crushed concrete. Posi-Shell and such other material as mav be agreed bv the County and Contractor to be equivalent or better than soil for the pUrPoses for which the material will be used. A material meeting the definition of soil herein is soil for pUrPoses of this Agreement including. but not limited to. reimbursement pursuant to Section 2.26: provided. however. that where Section 2.26 calls for reimbursement of that specific material. for example. as Posi-Shell or mulch. such specific requirements shall prevail. Rule 62-701.200 (113). F.A. C. 4 16C 1 "Tea" means a shert toa, 2000 j3ouaas. "Ton" means a short ton. 2000 pounds (0.9078 metric tons). Rule 62-701.200 (119). F.A.C. "Working Face" means that portion of a solid waste disposal unit where waste is deposited. spread. and compacted before placement of initial cover. Rule 62-701.200 (134). F.A.C. "Yard Trash" means vegetative matter resulting from landscaping maintenance or land clearing operations and includes materials such as tree and shrub trimmings, grass clippings, palm fronts, trees and tree stumps, and associated rocks and soils. Rule 62-701.200 (135). F.A.C. Section 2.14 Cover Material Any use of tarpaulins in lieu of Initial cover material shall be for the working face only and shall require the prior written approval of the County Manager. In no event shall the Landfill working face exceed a fifty (50) foot by one hundred (100) foot area when daily work ceases on the working face. Subiect to the provisions of this paragraph and the requirements and procedures set forth in Section 2.26(5) and 2.26(6). the Contractor shall be allowed to use ADC if the use of such material is requested in writing bv the County. accepted bv the Contractor and approved bv the Department. For the purposes of this paragraph onlv. the alternate initial cover material shall consist of: biomass (e.g.. mulch); construction and demolition debris (not including gypsum wallboard); a combination of biomass and construction and demolition debris; 6f a combination of biomass. construction and demolition debris. and soit;. a combination of Posi-Shell. soil and biomass; or a combination ofPosi-Shell and soil. If the ADC is used in coni unction with initial cover material containing soiL the Contractor shall be reimbursed for the soil and ADC pursuant to the provisions of Subsection 2.26(5) of this Agreement. Section 2.26 (I) (g) The Contractor shall promptly install an upgraded blower and flare system with a lRiRimHlR manufacturer's rated flow capacity of at least 3,000 standard cubic feet per minute. This system shall be designed, maiffiaine", aHa oj3eratea to ensure that the slo'.ver ana flare are operatea continHously ana restart automatically, if necessary with an automatic restart feature and manuallv activated redundant blower unit. The svstem shall be maintained to minimize downtime and operated continuous Iv to the extent practical. The Countv shall be notified of anv downtime within one hour or scheduled maintenance with at least one week of advance notice. The Contractor shall maintain an inventorv of critical parts in accordance with the manufacturer's recommendations and specifications and utilize best management practices to ensure prompt and efficient return to operations in the event of an outage. 2.26 (1): The Contractor shall e reimbursed $9.36 for each ton of soli" waste that is "i5j3ose" of in a lincd cell at the ~Jaj3les Um"fill. This pavrnent is compensation for the use of soil. mulch and Posi-Shell. or a combination thereof as approved bv the Department. The base rates to be utilized for each component are set forth in Attachments A-I. A-2, A-3 and A-4 attached hereto and made a part hereof. The base rates are established pursuant to the methodology set forth in Attachment A-2. Attachment A-I contains base rates for compensation for (i) dailv cover material/odor control (shown as Material Reimbursement) and (ii) airspace reimbursement. The Airspace Reimbursement-Per Ton Rate pavrnent is for airspace consumed in the Collier Countv Landfill as a result of implementing the requirements of Subsection 2.26 (n(a) and (b), above. As referenced in Attachment A-I. Note 2. the $0.36 per ton of sa lid waste reimbursement will cease when the Collier Countv Landfill has received or will receive 9.3 million tons of solid waste for disposal in the lined cells after Mav 1. 2001 and the time of the Landfill's final closure. Attachment A-I sets forth base rates in four scenarios: (a) use of soil onlv; (b) use of soil and Posi-shell: (c) use of soil. Posi-Shell and mulch: and (d) use of soil and mulch on Iv. The parties have established multiple base rates to 6 16 C ';1 address the four scenarios in which one or more of the material components for dailv cover and odor control measures are unavailable due to failure of supplv, regulatory restrictions, Countv directive as allowed in this Agreement or similar reasons. It is expected that soil. mulch and Posi-Shell will be available so that such materials mav be used on an annual basis in approximatelv the following percentages for dailv cover: 25% Posi-Shell. 30% mulch and 45% soil. However, should one or more become unavailable, for the time of such unavailabilitv, the appropriate base rate in AttachmentsA-2a and A-3 (as subsequently modified as provided in this Agreement) shall be used to calculate the pavment to be made bv the County to the Contractor. In this regard. the County, at no charge, will cause to provide vegetative yard waste to Contractor for processing into mulch. The County and WMIF agree that the cost for this service is $14.84 per inbound ton, which includes a 15% margin. The County recognizes that the cost for performing the grinding, mulching and blending services may increase or decrease annually due to changes in contractual obligations between WMIF and their subcontractors. If the costs increase or decrease, WMIF must notify the County in \vriting of such changes within twenty (20) business days prior to commencement of the increase or decrease. If WMIF and the County are unable to agree upon the fee within ten (IO) business days from the notification, WMIF must obtain competitive, best value proposals fi-om three (3) qualified vendors, within twenty (20) business days and submit to the County. The County will have five (5) business days from the submittal date to review and approve the proposed new rate. Upon the County's approval of the per ton adjustment, the approved cost shall be utilized for reimbursement to WMIF by the County. In the event the County does not approve the new rate, or takes longer than five (5) business days to approve, WMIF will use stocked soil and mulch mix. In the event that the stocked soil and mulch mix is depleted, \VMIF will use either Soil Only or Soil and Posi-Shell. Upon changing the daily cover method the Soil Only or Soil and Posi-shell Per Ton (as applicable) Reimbursement Rate will be utilized for payment to WMIF by the County for each month during which the mulch could not be processed at an approved rate. Upon reaching a negotiated, mutually agreed price for the blending of mulch and soil, WMIF will re-commence the use of soil and mulch mix. In the event that vegetative waste is not utilized for blending with soil as set forth above, the unused vegetative waste will be diverted to an area within the Collier County Landfill or the Resource Recovery Park designated by the County Manager or its designee, where it will remain and be utilized by Collier County as needed. In the event that the County Manager or designee request that the unused vegetative waste be transported off-site, \VMIF will develop a process for the removal of the excess vegetative waste, which provides best value pricing for the reuse, recycle or disposal of excess, unused vegetative waste and submit the process to the County for review. The County will have five (5) business days from the submittal date to review and approve the proposed process. Upon the County's approval of the per ton adjustment, the approved cost shall be utilized for reimbursement to WMIF by the County. The worksheet contains two pages, the first is the annual impacts and the other is the 30 year impact. The following is a summary of the file: There are two components to the schedule, the odor control reimbursement part and the airspace benefit section. The odor control reImbursement savings is calculated by taking the cubic yards of soil that are saved by use of Posi-Shell and then reducing them further by replacing some soil usage with mulch. The net impact is we would be using 55% less soil in combination with Posi-Shell and mulch. This reduced soil lowers the odor control reimbursement amounts which on a 30 year basis are almost $8,000,000. A larger portion of the benefit to Collier County relates to the freed up airspace that can now be used to bury additional tons of garbage. The impact is calculated by taking the soil savings related to the use of Posi-Shell and converting it into tons. Savings of 716,580 cubic yards is reduced by the .25 inches of airspace used by the Posi-Shell (44,726 cu/yds) which results in a net airspace savings of 671,854 cubic yards. Those cubic yards are then converted to tons by multiplying by .65 which results in 436,705 additional tons of airspace available for disposal. At the current gate rate of $50.58 per ton the airspace value would be in excess of $22,000,000, The grand total benefit to Collier County is over $30,000,000 over the 30 year period for the combination of reduced odor control payments as well as additional airspace saved. Cleariy, as the tipping fees increase over the next 30 years, the value increases. I have used a similar format to the handouts we were using during our negotiating sessions.
