EXECUTIVE SUMMARY
Recommendation to approve an Amendment and Extension to an Option Agreement for
Excavation Material between RP Orange Blossom Owner, LLC and Collier County to provide an
option to purchase excavated fill for use on County projects.
OBJECTIVE: To formalize an Amendment and Extension to an Option Agreement for Excavation
Material to purchase excavated fill for use on County projects.
CONSIDERATIONS: On October 25, 2016 (Agenda Item #16A27), the County entered into an Option
Agreement (the “Agreement”) with RP Orange Blossom Owner, LLC., allowing for Collier County to
purchase up to 500,000 cubic yards of fill to be excavated as part of the residual development of the
Orange Blossom Mixed Use Planned Unit Development. The Agreement provides that the 500,000 cubic
yards of fill will be made available for purchase by the County for a period of two (2) years from the
October 25, 2016 execution date. The Parties wish to amend the Agreement by extending the Option
Period to February 20, 2019.
FISCAL IMPACT: If the price of fill is more than $6 per cubic yard at the time of construction of
several projects, such as Big Corkscrew Island Regional Park, and the Collier County Sports Complex,
the County will save the amount it would have otherwise spent.
GROWTH MANAGEMENT IMPACT: There is no Growth Management impact.
LEGAL CONSIDERATIONS: This Item is approved as to form and legality and requires majority vote
for Board approval. -SRT
RECOMMENDATION: To approve the attached Amendment and Extension to an Option Agreement
for Excavation Material between RP Orange Blossom Owner, LLC and Collier County, which provides
the County an option to purchase excavated fill for use on County projects, and to authorize the Chairman
to sign the Amendment.
