EXECUTIVE SUMMARY
Recommendation to approve four (4) State Housing Initiatives Partnership Program (SHIP)
Impact Fee releases of lien for the associated owner-occupied affordable housing dwelling units
where the fifteen (15) year obligation has been met.
OBJECTIVE: To support the affordability of housing through the implementation of SHIP Program
strategies.
CONSIDERATIONS: Pursuant to Article IV of Chapter 74 the Collier County Code of Ordinances, the
County shall defer the payment of the impact fees for any new owner-occupied unit which qualifies as
affordable housing. Collier County Ordinance No. 2001-13, the Collier County Consolidated Impact Fee
Ordinance, provides for waivers of impact fees for new owner -occupied dwelling units qualifying as
affordable housing.
Section 74-401(a) (3) of the Code authorizes the County Manager to enter into a SHIP impact fee deferral
agreement with the Owner/Developer.
Under the SHIP Impact Fee Deferral Program, from 1997-2004, when an eligible applicant was approved
for an impact fee deferral, the SHIP Program paid the required impact fees in full to the County on behalf
of the owner and deferred the SHIP repayment until the property was sold, refinanced, or no longer their
primary residence. Three (3) of the original liens were filed in the name of the developer, Habitat for
Humanity of Collier County, Inc. and one (1) was filed in the name of the homeowner. Therefore, three
(3) releases are for Habitat for Humanity of Collier County, Inc and one (1) for an own er, Froylan
Resendiz. The deferred impact fees were a SHIP lien on the property for a 15 -year term commencing on
date the certificate of occupancy was issued. All the owners have met the 15-year term of the agreements.
The SHIP repayment obligation has been fulfilled and a release of the four (4) liens is needed. The
following table contains details about the SHIP liens associated with this Item.

FISCAL IMPACT: There is no Fiscal impact associated with the Release of Lien. The $40 in recording
fees will be paid by SHIP Grant Fund (791), Project 33525.
GROWTH MANAGEMENT IMPACT: The SHIP Program assists the County in meeting some of its
goals and objectives in the Housing Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote
for Board approval. -JAB
RECOMMENDATION: To approve and authorize the Chairman to sign four (4) SHIP releases of lien
for the associated owner-occupied affordable housing units where the fifteen (15) year obligation has
been met.
