EXECUTIVE SUMMARY
Recommendation to provide after-the-fact approval to request an extension of the period of
performance of the South Florida Water Management District (SFWMD) Grant Agreement
#4600003760 to June 30, 2019 for construction of Lely Branch Canal Weir to maintain adequate
flood protection level of service (LOS) and enhancement of regional water supplies. The cost of
project was estimated at $497,000, which funds are budgeted under project No. 60202).
OBJECTIVE: To receive after-the-fact approval from the Board of County Commissioners for request
of extension of the period of performance from the South Florida Water Management District Grant
(SFWMD) Agreement #4600003760 to June 30, 2019 for construction of Lely Branch Canal Weir to
maintain adequate flood protection level of service (LOS) and enhancement of regional water supplies.
County CMA #5330 Grant Coordination requires that the Board of County Commissioners approve all
grant applications and agreements thereof.
CONSIDERATIONS: On January 8, 2018, the Collier County and SFWMD signed grant agreement
for funding of up to $200,000 with estimated cost of $497,000 for construction of the Lely Branch
Canal Weir with a period of performance of the grant agreement expiring on January 7, 2019. Si nce the
construction of the project will not be completed by January 7, 2019, and an extension of the agreement
to June 30, 2019 has been requested from SFWMD.
Collier County CMA No. 5330 authorizes the County Manager to approve the submittal of grant
applications and agreements thereof with subsequent Board of County Commissioners action at the next
available Board meeting to ratify the approval as “after-the-fact.”
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as
to form and legality, and requires majority vote for approval. -JAK
FISCAL IMPACT: The grant agreement provided for SFWMD to fund up to $200,000 with an
estimated required local match, which is budgeted in GMD Grant Fund 711, GMD Match Grant Fund
712, and Stormwater Capital Fund 325, Project 60202. If the period of performance of the grant
agreement is not extended, the agreement will be null and void, and the funding will be lost.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact for this project.
RECOMMENDATION: To provide after-the-fact approval for extension of the period of performance
of the South Florida Water Management District Grant Agreement #4600003760 to June 30, 2019 for
construction of Lely Branch Canal Weir to maintain adequate flood protection level of service (LOS)
and enhancement of regional water supplies.
