Agenda 10/23/2018 Item #11A10/23/2018 EXECUTIVE SUMMARY Recommendation to approve the proposed Collier County State and Federal Legislative and Administrative Priorities for 2019 and adopt the attached resolutions. OBJECTIVE: To formalize and endorse Collier County’s State and Federal Legislative and Administrative Priorities for 2019 and adopt applicable resolutions. CONSIDERATION: Each year, prior to the convening of the State Legislature in Regular Session, staff prepares a proposed list of State and Federal Legislative and Administrative Priorities for the upcoming year for consideration and subsequent endorsement by the Board of County Commissioners (Board). Each member of the Board has previously been provided the attached Government Affairs Memorandum for review. Three resolutions on applicable issues are also attached for approval. The Collier County Legislative Delegation is scheduled to conduct its public hearing for local bills and local budget requests on Friday, November 30, 2018, at 9 a.m., at the North Collier Regional Par k located at 15000 Livingston Road, Naples, FL 34109. Applicable issues from the Priorities document will be presented at that meeting. This year, the State Legislature convenes on March 5, 2019, and concludes its Regular Session on May 3. FISCAL IMPACT: This executive summary has no immediate fiscal impact. GROWTH MANAGEMENT IMPACT: This executive summary has no immediate growth management impact. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal issues, and requires majority vote for approval. -JAK RECOMMENDATION: That the Board of County Commissioners approves the proposed Collier County State and Federal Legislative and Administrative Priorities for 2019, adopt the attached resolutions, and authorize the Chairman to sign the resolutions. Ochs, Jr., County Manager Nick Casalanguida, Deputy County Manager FROM: John Mullins, Government Affairs Manager SUBJECT: Proposed State and Federal Legislative and Administrative Priorities for 2019 This memo contains proposed State and Federal Legislative and Administrative Priorities for 2019. It is based on prior Board direction, legislative and project needs identified by County staff in support of Board-approved programs and projects, ongoing or unresolved legislative and administrative issues from 2018, and legislative priorities shared with FAC and NACo. Our contract lobbyists/partners provided valuable input throughout this process, and they work very hard to continually identify and monitor legislative trends, issues, administrative activity, and opportunities throughout the year. Once reviewed and approved by the Board of County Commissioners, the County’s legislative and administrative priorities will guide all advocacy efforts in Tallahassee, FL, and Washington, DC, for the upcoming year. The following priorities are for the Board’s review, consideration, and input: ISSUES: REQUIRING STATUTORY CHANGE ____________________________________________________________________________________________________________________ 1. Title: Public Safety Center at Mile Marker 63 Need: To remove the statutory expiration date and make permanent the toll revenue stream covering the operating costs for the Public Safety Center at mile marker 63 on Alligator Alley. This station exclusively serves travelers of I-75 and responds to emergency calls along the interstate span between mile markers 52 and 107. During the 2018 Regular Session, HB 141 extended the toll expiration date through June 30, 2019. (The current estimated annual operating cost is approximately $1.48 million.) Action: BILL/AMENDMENT (STATE) – In partnership with Greater Naples Fire Rescue District, amend section 338.26, F.S., striking the expiration date language and continuing reimbursement of a local governmental entity for direct costs of operating the Public Safety Center at mile marker 63 on Alligator Alley. ------------------------------------------------------------------------------------------------------ 11.A.1 Packet Pg. 293 Attachment: Gov_Affairs_Memo_2019_Legislative_Priorities (6941 : State & Federal Legislative Priorities) Pg. 2 2. Title: RESTORE Act Debt Financing Need: To pass legislation authorizing the Secretary of the Treasury to use debt instruments, as part of the RESTORE Act, to be financed by $20 billion in BP Oil civil penalties, providing more immediate access to moneys for restoration and program/project improvements that would otherwise take years to accumulate. Collier County is one of 15 “non-disproportionately” affected counties eligible for project grants under RESTORE. Action: AMENDMENT/ADVOCACY (FEDERAL) – Continue to advocate for debt financing language currently in HR 2923 (Rep. Diaz-Balart co-sponsor) and S.1373, or similar legislation that may be introduced in 2019 by the 116th Congress. ------------------------------------------------------------------------------------------------------ 3. Title: Long-Term, Transparent National Flood Insurance Program (NFIP) Reauthorization Need: To seek the long-term reauthorization of the NFIP to provide housing market stability while ensuring transparency and fairness in rate setting. Action: BILL/ADVOCACY (FEDERAL) – Support the language of S.1368, cosponsored by Senators Rubio and Nelson, that provides for a six-year reauthorization, freezes interest payments on NFIP debt, provides low interest loans for homeowner mitigation projects, and provides additional funding for current mitigation assistance grant programs. In July, Congress passed S.1182 to extend the current program until November 30, 2018, to keep the program from expiring during hurricane season and to allow time to negotiate a long-term reauthorization before the end of the year. ------------------------------------------------------------------------------------------------------ 4. Title: Emergency Shelter Registration Lists – Public Record Exemption Need: Counties are taking more responsibility for operating emergency shelters from the Red Cross. Where registration information, as gathered by the Red Cross, remains confidential, county registration and other disaster-related forms and software that may contain personal information may be subject to Florida public records laws. Hesitance to have their personal information made public might dissuade some from seeking shelter in an emergency and needlessly put first responders and others in jeopardy. Action: BILL/AMENDMENT (STATE) – After many pieces of disaster-related legislation ran out of time last legislative session due to the Parkland shooting, follow-up legislation has been filed for the 2019 Regular Session to protect/exempt county-operated emergency shelter registration lists, damage assessments, and WebEOC database information from Florida public records laws. In August, new bill language was submitted by Collier County to FAC which was subsequently adopted into their 2019 FAC Legislative Action Plan. ------------------------------------------------------------------------------------------------------ 5. Title: FEMA Deobligation Need: To pass legislation regarding recovery of FEMA assistance funds, providing that FEMA may not take any action to recoup previously-awarded disaster funds for projects that have been certified complete by the state for at least three years. Action: BILL/ADVOCACY (FEDERAL) – The deobligation language was added to the FAA Reauthorization bill conference report which passed the House on September 27, and, under a 11.A.1 Packet Pg. 294 Attachment: Gov_Affairs_Memo_2019_Legislative_Priorities (6941 : State & Federal Legislative Priorities) Pg. 3 previously adopted extension, the Senate on October 3. ------------------------------------------------------------------------------------------------------ 6. Title: Texting as a Primary Offense Need: To pass legislation making texting while driving a primary offense. Currently, tickets for texting while driving can only be issued if a driver is pulled over for committing another traffic violation. As of 2018, Florida is one of 47 states that ban texting while driving; however, it is only one of only five states that do not enforce it as a primary offense. Action: BILL/ADVOCACY (STATE) – Support legislation to make driving while texting a primary offense. A similar bill died during the 2018 Regular Session over concerns of racial profiling and difficulties in training officers on how to accurately identify when someone is texting while driving. ------------------------------------------------------------------------------------------------------ FUNDING REQUESTS: STATE & FEDERAL ____________________________________________________________________________________________________________________ 1. Title: County Funding Streams Need: Full funding of grants and continued appropriations for programs or funds applicable to Collier County, including by not limited to, Payment in Lieu of Taxes (PILT), Community Development Block Grant (CDBG), Home Investment Partnerships Program (HOME ), Institute of Museum and Library Services (IMLS), Airport Improvement Program (AIP), Emergency Management Performance Grants (EMPG), Stafford Act, Fire Management Assistance Grant Program (FMAGP), Rainy Day Fund, Local Housing Trust Fund, Sadowski Act, State Housing Initiatives Partnership (SHIP), the Land Acquisition Trust Fund (LATF), and the Rural Development Grant Program. Action: Advocate for full funding of grants and continued appropriations for programs or funds applicable to Collier County and oppose State or Federal actions that would utilize moneys for other purposes than originally intended. (STATE/FEDERAL) ------------------------------------------------------------------------------------------------------ 2. Title: Plantation Island Hurricane Irma Waterway Recovery Project Need: Hurricane Irma’s impact on Plantation Island has left its canal systems full of debris and silt. This project will restore Plantation Island’s waterways to a usable condition and improve water quality by enhancing flushing via installation of culverts interconnecting existing man-made dead-end canals. Action: Request $500,000 in State appropriations for the Plantation Island Hurricane Irma Waterway Recovery Project. (STATE) ------------------------------------------------------------------------------------------------------ 3. Title: Spay Collier Rural Mobile Veterinary Clinic Need: To purchase a fully functional mobile veterinary clinic to service rural, impoverished areas of Collier County by offering free or low cost spay and neuter surgeries of dogs and cats to residents that cannot afford said services and/or have limited transportation to reach private 11.A.1 Packet Pg. 295 Attachment: Gov_Affairs_Memo_2019_Legislative_Priorities (6941 : State & Federal Legislative Priorities) Pg. 4 veterinary clinics. This mobile facility will also administer rabies vaccinations as required by state law and by local ordinance. The goal is to decrease animal intake at Collier County Domestic Animal Services, the only open-admission animal shelter. Action: Request $270,700 in State appropriations for the Spay Collier Rural Mobile Veterinary Clinic. (STATE) ------------------------------------------------------------------------------------------------------ ISSUES: REQUIRING ADMINISTRATIVE ACTION ____________________________________________________________________________________________________________________ 1. Title: FEMA – FDEM Disaster Reimbursement for Hurricane Irma Need: When disasters occur in the United States, the federal government, through FEMA, provides Public Assistance grants which reimburse state and local governments. The County depends upon timely approval of this assistance for disaster-related costs, including repairs to damaged infrastructure, public services and facilities, and debris removal. These funds are also used to reimburse emergency services such as police, fire, and emergency management for extraordinary expenses for overtime pay to protect and assist our residents during a disaster. Action: ADMINISTRATIVE (FEDERAL) Timely approval of public assistance grants to relieve the post- disaster burden on Collier County which fronts the recovery expense at the cost of capital projects and program delay. ------------------------------------------------------------------------------------------------------ 2. Title: Strategic Intermodal System Long Range Cost Feasible Plan Need: Currently, the 2018 edition of the Florida Department of Transportation (FDOT) Strategic Intermodal System Long Range Cost Feasible Plan for FY 2029 -2045 does not provide for any construction of capacity improvements for I-75 or SR 29 in Collier County. The Systems Implementation Office updates the SIS CFP every 3 to 5 years to adjust the planning horizon consistent with the long-range planning needs of FDOT and MPOs throughout the state. Action: ADMINISTRATIVE (STATE) – Work with FDOT District 1 representatives, applicable adjacent counties and coalitions, and local legislative delegation members to encourage an FDOT update to the Long Range Cost Feasible Plan that incorporates capacity improvements for I -75 and SR 29 in Collier County. ------------------------------------------------------------------------------------------------------ 3. Title: Southwest Florida Promise Zone / Opportunity Zones Need: To actively support the mission of the Southwest Florida Promise Zone (SFPZ) in improving economic opportunity through education, crime prevention, infrastructure improvement, and economic development; to monitor and support Opportunity Zones/Funds applicable to Collier County as federal guidelines are produced and released by the U.S. Treasury Department and the Internal Revenue Service. Action: ADMINISTRATIVE (FEDERAL) - Mobilize elected officials to support specific initiatives from the SFPZ, including congressional passage of federal tax incentives for employers, prompting participation of the U.S. Dept. of Transportation in Promise Zone grant preference benefit , and 11.A.1 Packet Pg. 296 Attachment: Gov_Affairs_Memo_2019_Legislative_Priorities (6941 : State & Federal Legislative Priorities) Pg. 5 to address any concerns with applicable agencies that may arise from forthcoming Opportunity Zones/Funds guidelines. ------------------------------------------------------------------------------------------------------ 4. Title: FEMA Remapping Need: To expedite FEMA approval for Collier County flood remapping which is five years behind schedule. Two-thirds of Collier’s population is represented by outdated maps. Of the two Physical Map Revisions (PMR) pending completion for this update, PRM1 will be completed this fall. Action: ADMINISTRATIVE (FEDERAL) – Engage agency officials and congressional delegation to prompt FEMA approval for Collier flood remapping completion. Support continued increases in funding for the Flood Hazard Mapping and Risk Analysis Program which was funded at $262 million for FY18, an $85 million increase over FY17. ------------------------------------------------------------------------------------------------------ 5. Title: Roberts Home Stabilization and Rehabilitation Need: The Museum Division has applied for grant funding for the stabilization and rehabilitation of the Roberts Home at the Immokalee Pioneer Museum at Roberts Ranch. The Special Categories Grant provides for preservation of significant historic structures. (There is a ten percent local match available in Fund 314, Museum Capital Projects Reserves.) Action: ADMINISTRATIVE/BUDGET (STATE) – Monitor and advocate, as allowable, for grant application approval and awarding of $455,800 by the Florida Department of State, Division of Historical Resources. Roberts Ranch is currently ranked #5 on the Florida Historical Commission’s Special Category grants list. Lobby for an appropriation for the Special Category Grant budget line-item of at least $1.75 million to ensure funding of the Roberts Ranch project. ------------------------------------------------------------------------------------------------------ 6. Title: Margood Cottages Restoration Need: Collier County Parks & Recreation has applied for grant funding for completion of final designs for restoration of the Margood Cottages within the Goodland community. The County will engage a qualified design consultant to complete architectural drawings, site development plan, and a landscaping plan. (There is a $50,000 match in local funds for the project.) Action: ADMINISTRATIVE/BUDGET (STATE) – Monitor and advocate, as allowable, for grant application approval and awarding of $50,000 by the Florida Department of State, Division of Historical Resources. Lobby for an appropriation for the Small Matching Grant budget line-item of at least $1.4 million to ensure funding of the Margood Cottages Restoration Project . ------------------------------------------------------------------------------------------------------ 7. Title: Shore Protection Study Need: The Army Corps of Engineers has received funding to initiate a long-awaited shore protection study of Vanderbilt, Park Shore, and Naples Beaches that was authorized by Congress in 2007, and finally received funding in FY18. 11.A.1 Packet Pg. 297 Attachment: Gov_Affairs_Memo_2019_Legislative_Priorities (6941 : State & Federal Legislative Priorities) Pg. 6 Action: ADMINISTRATIVE (FEDERAL) Encourage expedited completion of this study so that construction funding may be initiated without delay. ------------------------------------------------------------------------------------------------------ ISSUES: RESOLUTIONS OF SUPPORT ____________________________________________________________________________________________________________________ 1. Title: Supporting a City of Naples State Appropriations Request for the Naples Bay Red Tide Septic Tank Mitigation Project Need: Though Karenia brevis (Red Tide) blooms naturally offshore, once close to the coastline, many scientists believe that the blooms may use both human-contributed and natural nutrients as fuel. The City of Naples and the County have partnered to convert septic tanks to a centralized sanitary sewer system and improve water quality by reducing nutrient loading in the sensitive, impaired waters of Gordon River/Naples Bay that enter the Gulf of Mexico. The project is located in unincorporated Collier County, but within the water and sewer service area of the City of Naples. As the construction of the sanitary sewer collection system is occurring, the County will be making stormwater management improvements on multiple streets between Goodlette Frank Road and US 41 to minimize disruption in the area. Action: ADOPT A RESOLUTION IN SUPPORT of a City of Naples State appropriations request of $1.2 million for the Naples Bay Red Tide Septic Tank Mitigation Project. (STATE) ------------------------------------------------------------------------------------------------------ 2. Title: Supporting Requests by the City of Everglades City for Funding of a Temporary Wastewater Bypass Plant and Design and Construction of a New Wastewater System Need: Hurricane Irma caused extensive damage to Everglades City and its wastewater system which is in disrepair and requires replacement. A temporary bypass plant is needed for proper water treatment while efforts to procure funding for design and construction of a new wastewater system occur. The wastewater plant is located at the intersection of the environmentally sensitive Ten Thousand Islands/Everglades National Park and the Big Cypress National Preserve. Action: ADOPT A RESOLUTION IN SUPPORT of Everglades City’s State appropriations request of $5,000,000 for the Everglades City Utility Wastewater Bypass Plant to Protect Environmentally Sensitive Public Lands and Waterways, an application for disaster assistance grant funding from the USDA, and an Action Plan for consideration of funding by the CDBG-DR program for wastewater system replacement. (STATE/FEDERAL) ------------------------------------------------------------------------------------------------------ 3. Title: Supporting a University of Florida Institute of Food and Agricultural Sciences Southwest Florida Research and Education Center State Appropriations Request for Irrigation and Drainage System Improvements Need: To renovate existing outdated irrigation and drainage system technology that is frequently in disrepair and hampers agricultural research and education. The inability to adequately control water during low and high rainfall periods causes reduction in plant growth, yield, drop of fruit, and death of the study plants. Title: Medical Marijuana Dispensaries Watch: Any proposed legislation that might provide more local discretion in dispensary location. Title: Mental Health & Substance Abuse Watch: Any proposed legislation, appropriation, grant, or program that could enhance Collier County’s mental health and substance abuse programs, including the expansion of authority of county court judges to refer defendants for treatment. (STATE/FEDERAL) ------------------------------------------------------------------------------------------------------ 3. Title: Harmful Algal Blooms (HABs)/Lake Okeechobee/Everglades Restoration Watch: Any proposed legislation or administrative action regarding harmful algal blooms (HABs), including red tide, related to research, prevention, and mitigation; Lake Okeechobee water storage, treatment, and reservoir conveyance; Everglades restoration and preservation via the Comprehensive Everglades Restoration Plan (CERP). (STATE/FEDERAL) ------------------------------------------------------------------------------------------------------ 4. Title: Inland Oil Drilling & High-Pressure Well Stimulation (Fracking) Watch: Any proposed legislation that changes the status of inland oil drilling and high-pressure well stimulation. Currently, high-pressure well stimulation remains essentially unregulated and permissible. Legislation introduced in 2018 provided for a ban on high-pressure well stimulation but never advanced out of its house of origin. (STATE) ------------------------------------------------------------------------------------------------------ 5. Title: Offshore Drilling in the Gulf of Mexico Watch: Any proposed legislation or administrative action that would extend the current moratorium on offshore oil and gas drilling and prevent drilling leases within 125 miles of Florida’s Gulf Coast. Title: I-75 Interchanges Watch: Funding opportunities to improve I-75 interchanges in Collier County, improving traffic flow and safety for motorists. Title: Autonomous Vehicles Watch: Any proposed legislation that would impact local regulation of safety standards for autonomous vehicles and related technology. (STATE/FEDERAL) ------------------------------------------------------------------------------------------------------ 10. Title: Community Redevelopment Agency (CRA) Watch: Any proposed legislation that restricts home rule authority to create, operate, or sunset county CRAs. During the 2018 session, a significant amount of committee time was spent working on transparency and creation/sunsetting of CRAs. The bill failed in the final hours of the session when the House and Senate could not resolve the differences in their bills. Title: Short Term Rentals Watch: Any proposed legislation that preempts or otherwise restricts local laws, ordinances, or regulation regarding vacation rental frequency or duration. Title: School Resource Officer (SRO)/Guardian Program Funding Watch: Any proposed legislation or administrative action regarding funding of the School Resource Officer (SRO) and/or Guardian Program. Title: Millage Rates Watch: Any proposed legislation that undermines local government discretion in establishing millage rates. (STATE) 14. Title: EMS Balance Billing Watch: Any proposed legislation or administrative action that could shift unpaid balances for emergency transport to taxpayers. Title: Workers Compensation Reform Watch: Any proposed legislation or administrative action that mitigates unfunded liabilities. Reform bills in 2017 failed and, in 2018, the bill was pulled from consideration at the request of the business community after rate reductions were implemented. Title: Hazardous Waste Disposal Funding/Collection Bills Watch: Any proposed legislation that limits collecting appropriate fees for services. (STATE) ------------------------------------------------------------------------------------------------------ 19. Title: FAA Air Traffic Control Privatization Watch: Any introduced legislation in the 116th Congress that would privatize air traffic control services to airports. Similar legislation failed in 2018, during FAA reauthorization discussions. (FEDERAL) ------------------------------------------------------------------------------------------------------ 20. Title: Fuel Station Generators Watch: Any proposed legislation or regulatory efforts that strengthen the emergency generator requirement for commercial fuel stations near the interstate and inland multi-pump stations.
