Agenda 10/09/2018 Item #16E 410/09/2018 EXECUTIVE SUMMARY Recommendation to award Invitation to Negotiate (ITN) #18-7321, “Gas and Diesel Fuel Multi- Agency Cooperative Purchase,” to Palmdale Oil Company, Inc., authorize the Chairman to execute the agreement, and terminate the award of #18-7406 “Emergency Fuel.” OBJECTIVE: To provide gasoline and diesel fuel for County vehicles and equipment. CONSIDERATIONS: On an annual basis, Collier County uses over 1,000,000 gallons of Gasoline and Diesel Fuel in its over 900 vehicles, fuel trucks, tanks, generators, and other fuel storage assets. That fuel is delivered by transport tanker to County owned refueling sites and by tank wagons to generator sites located throughout the County. On April 27, 2018, the Procurement Services Division released notices for ITN #18-7321, “Gas and Diesel Fuel Multi-Agency Cooperative Purchase,” to 1233 vendors. Interested vendors downloaded forty- seven (47) solicitation packages, and the County received four (4) proposals as reflected in the below table. Staff concluded that the proposals from all responding parties were responsive and responsible. A selection committee met on June 13, 2018 to discuss the proposals and to score and short list vendors for oral presentations. The selection committee voted to bring Mansfield Oil Company, Palmdale Oil Company and ProEnergy LLC back for oral presentations on July 11, 2018. After the presentations, the committee voted to enter into negotiations with Palmdale Oil Company and Pro Energy, LLC. On Aug 14, 2018, the selection committee ranked Palmdale Oil Company number one and ProEnergy, LLC number two. The selection committee recommends awarding to Palmdale Oil Company. E.9), the Board approved the award of ITB #18 - 7406 “Emergency Fuel” to Palmdale Oil Company Inc. and Pro Energy LLC, as interim vendors. Staff is requesting the Board’s direction to terminate for convenience the Purchase Order that was opened related to the award of ITB #18-7406, “Emergency Fuel” to Palmdale Oil Company Inc. and Pro Energy LLC, with termination to be effective as of November 8, 2018. Section 18, the Termination clause of the County’s Standard Purchase Order, allows the County to terminate for convenience upon thirty (30) days written notice to vendors. FISCAL IMPACT: Funds for motor fuel to run County vehicles and equipment are budgeted annually in the Fleet Management Fund 521 operating budget. Actual expenditures will depend on daily spot prices and usage each fiscal year, with $3,753,200 budgeted for FY 2019. GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan standards to ensure the adequacy and availability of viable public facilities. Prices are tied to the OPIS rack average, Tampa and/or OPIS rack average, Port Everglades fuel index Surcharges will not be accepted in conjunction with this contract, and such charges should be incorporated into the pricing structure. DETAILED SCOPE OF WORK These specifications are intended to provide information by which prospective proposers may understand the requirements of the County relative to the furnishing and delivering of unleaded gasoline and diesel fuel on an as -needed basis to government agencies and locations throughout Collier County, Lee County, and Charlotte County. The quantities listed herein are approximate and the County Agencies reserve the right to increase or decrease the quantities as needed. Gasohol or alcohol additives, must not exceed 10% b y volume. All unleaded gasoline must have a minimum of a "maintenance" detergent dose of injector cleaning additive. The No. 2 diesel fuel must be suitable for use in diesel engines and free from water, foreign matter and must meet or exceed State and Federal specifications. Ultra-Low Sulfur Diesel must have a sulfur content of 15PPM or less and meet all Federal standar ds for use in mandated diesel engine low emission systems. No. 2 diesel shall have a cetane rating of 42 or higher based on standard industrial testing. INVITATION TO NEGOTIATE (ITN) PROCESS 1.1 The Proposers will submit proposal which will be scored based on the Grading Criteria for Ranking Proposals, which will be the basis for short-listing the vendors. The Proposers will need to meet the minimum requirements outlined herein in order for their proposal to be evaluated and scored by the County Agencies. The County Agencies will then grade and rank to at least the top three short-listed vendors and enter into negotiations with the top ranked vendor or multiple vendors to establish cost for the services needed. The County Agencies reserves the right to issue an invitation for oral presentations to obtain additional information after grading and before the final ranking. With successful negotiations, a contract will be developed with the selected firm, based on the negotiated price and/or scope of services and submitted for approval by the Board of County Commissioners . 1.2 The County Agencies will use a Selection Committee in the ITN selection process. 1.3 The intent of the scoring of the proposal is for respondents to indicate their interest, relevant experience, financial capability, staffing and organizational structure. 1.4 The intent of the oral presentations, if deemed necessary, is to provide the vendors with a venue where they can conduct discussions with the Selection Committee to clarify questions and concerns before providing a final rank. 1.5 Based upon a review of the proposals, the County Agencies will rank the Proposers based on the discussion and clarifying questions on their approach and related criteria, and then negotiate with one or more vendors as authorized in Section 11, Paragraph 7 of County Procurement Ordinance Number 2017-08. 1.6 The County Agencies reserves the right to negotiate any element of the proposal s in the best interest of the cooperative County Agencies. GRADING CRITERIA FOR RANKING PROPOSALS: 1.7 For the development of a shortlist, this evaluation criterion will be utilized by the Selection Committee to score each proposal. Proposers are encouraged to keep their submittals concise and to include a minimum of marketing materials. Proposals must address the following criteria: Evaluation Criteria Maximum Points 1. Volume of work shall be calculated based upon total dollars paid to the proposer in the twenty -four (24) months prior to the ITN submittal deadline. Payment information will be retrieved from the County’s financial system of record. The tie breaking procedure is only applied in the final ranking step of the selection process and is invoked by the Procurement Services Division Director or designee. In the event a tie still exists, selection will be determined based on random selection by the Procurement Services Director before at least three (3) witnesses. ----------------------------------------------------------------------------------------------------------------------------------------------- Each criterion and methodology for scoring is further described below. EVALUATION CRITERIA NO. 1: COVER LETTER/MANAGEMENT SUMMARY (0 Total Points Available) Provide a cover letter, signed by an authorized officer of the firm, indicating the underlying philosophy of the firm in providing the services stated herein. Include the name(s), telephone number(s) and email(s) of the authorized contact person(s) concerning proposal. Submission of a signed Proposal is Vendor's certification that the Vendor will accept any awards as a result of this ITN. EVALUATION CRITERIA NO. 2: CERTIFIED MINORITY BUSINESS ENTERPRISE (5 Total Points Available) Submit certification with the Florida Department of Management Service, Office of Supplier Diversity as a Certified Minority Business Enterprise. EVALUATION CRITERIA NO. 3: BUSINESS PLAN (20 Total Points Available) Proposers must state the number and type of fuel delivery vehicles they intend to use with evidence of either ownership/lease/contracts, and the location of their intended fuel sources with evidence of contracts/agreements to verify the vendors access to the source of supply. Proposers must outline delivery times from order and hours of operation. The desired response time is at least twenty-four (24) hours, this will include but not be limited to: • Provide information that details and locations of fueling depots and delivery capabilities • Length of time between placement of order and delivery • Provide information on the number of transport/tank wagon vehicles owned EVALUATION CRITERIA NO. 4: COST OF SERVICES (30 Total Points Available) In this tab include, but not limited to: • Provide contract price of #2 Off Road Ultra Low Sulfur Diesel delivered via transport and tank wagon. Palmdale has the ability to utilize our fleet of over 100 company owned trucks (combined) and drivers to deliver the product needed for the Coop on time. We do not use common carriers to deliver our products which gives us complete control over our deliveries. We are a locally family owned company and can have a representative in any agency office in less than an hour. The primary sources of fuel will be picked up at the following terminals: Port Tampa (7 different terminals), Port Manatee (1 terminal), and Port Everglades (11 Terminals). Palmdale has supply contracts with refiners in these terminals (Proof of Supply Contracts attached). Palmdale has other supply points as back up in West Palm Beach, Cape Canaveral, and Orlando Florida as well. Palmdale will contract 100% of the additional Coop’s volume to ensure fuel supply. The Tank wagon deliveries will be supplied from our company owned Bulk Plants in Fort Myers (primary) and Tampa (secondary) Florida. Our combined storage in these 2 facilities is roughly 300,000 gallons. We also maintain a fleet of more than 15 trucks in Port Everglades that would provide back up to the 2 Bulk Plants if needed. Between Fort Myers and Tampa Bulk Plants we employ over 30 drivers, 3 dispatchers, 2 administrative and 1 general manager. Our Bulk plants are open from 7 am to 5 pm Monday through Friday. We have 24 hour emergency phone numbers as well. Palmdale also owns additional bulk plants as back up in Okeechobee, Boynton Beach, West Palm Beach, Riviera Beach, Ft Pierce, and Orlando Florida. The transport delivery team is centralized in Okeechobee city and we have 3 dispatchers that work 8 hour shifts around the clock because we have trucks on the road 24 hours a day 7 days a week. Our tractor trailers are domiciled between all of the terminal supply points in Florida as well as our Bulk Plants. This gives us the ability to get you fuel fast and not be interrupted by supply disruptions at a port. We have the ability to deliver the same day and always deliver within 24 hours of the order. Our transport department is open 7 days a week 24 hours and can accept orders with a response at any time. With the size of our fleet, our strategic footprint of Bulk Plants and supply points, we believe that our service will exceed the Coop’s expectations. Palmdale has a proven track record of supplying all of our customers during a natural disaster including 6 hurricanes that made landfalls in our marketing areas. Some of the largest companies have depended on and continue to rely on Palmdale Oil for emergency fuel needs such as Florida Power and Light, Tampa Electric, Publix Super Markets, Tenet Health Group, South Florida Water Management and many more. Palmdale will have the Coop’s fuel contracted with refiner suppliers to ensure consistent supply. We will have multiple supply points scattered strategically across the state so that if a hurricane makes landfall we will have multiple options from unaffected terminals and bulk plants. Palmdale will keep our tank capacity at maximum levels throughout hurricane season including our back up hurricane supply terminal in Ft Pierce, Florida which holds over 500,000 gallons. At maximum capacity we have well over 1 million gallons of our own storage. All of our bulk plants have back generators to keep fuel flowing. The size of our fleet allows us the availability to move quickly across Florida to all of the supply terminals if one has been impacted by a storm. Palmdale has a centralized hurricane emergency response team and center that is staffed by the management of the company to help facilitate supply and priority of delivery. We have the ability to forward communications via the internet to any of our offices in the state as well as various cell phones. Back up phones and two way radio technologies are also used when cellular towers have been disrupted. The Coop will have direct access to our Hurricane Emergency team as well as back up cell phone numbers to our lead managers on the team. Palmdale strongly recommends that when storm season begins that all emergency generators are topped off in order to avoid any last minute delivery issues. In the event of an approaching storm, we recommend that all tanks are filled at least 72 hours before a storm makes landfall. If the Governor declares a state of Emergency, Palmdale will run the fleet around the clock until the winds are sustained at 45 miles per hour. After the storm passes deliveries will resume as long as there are no natural impediments such as impassable roads or conditions that would endanger the safety of our employees and others. All drivers report to their managers after the storm as long there is communications otherwise they report directly to their local plants for instructions. The Coop will also have the ability to get fuel at our various gas stations in Charlotte and Lee Counties including our Local Bulk Plant in Ft Myers, FL which includes a commercial card lock and retail station. Palmdale will work closely with other agencies in the Coop to provide additional equipment for rent such as tanks and pumps, tank wagons, and excess storage trailers.
