Agenda 10/09/2018 Item #16A 610/09/2018 EXECUTIVE SUMMARY Recommendation to approve and Authorize the Chairman to sign the Utility Facilities Quit -Claim Deed and Bill of Sale between Collier County and Minto Sabal Bay, LLC, in order to correct an error in the previous recorded Utilities Facilities Warranty Deed and Bill of Sale for Isles of Collier Preserve Phase 8 - Dog Park PL20180001856, in which the Developer mistakenly conveyed sanitary sewer facilities to the County even though no such facilities exist. OBJECTIVE: To correct the erroneous conveyance of the sanitary sewer utility facilities to the County for the Isles of Collier Preserve Phase 8 - Dog Park development project. CONSIDERATIONS: The Utility Facilities Warranty Deed and Bill of Sale from Minto Sabal Bay, LLC, recorded on August 17, 2018, at (OR) Book 5544, (PG) Page 814, conveyed potable water and sanitary sewer utility facilities located within the Isles of Collier Preserve Phase 8 - Dog Park, to the County. However, there are no sanitary sewer utility facilities in the subject location, and thus the Warranty Deed and Bill of Sale should have only included language conveying the potable water facilities to the County. The Warranty Deed and Bill of Sale was recorded after preliminary acceptance of the utility facilities f or the project, in accordance with the Utility Facility Standards and Procedures Ordinance No. 2004-31. However, the error in the conveyance document language was discovered at the time Minto Sabal Bay, LLC requested the Board of County Commissioners’ (BOCC) final approval and acceptance of the utility’s facilities for the project. The purpose of the attached Quit -Claim Deed and Bill of Sale is to correct the erroneous language and ensure there is no confusion as to what utility facilities have been conveyed to the County. Minto Sabal Bay, LLC is aware of the error and has agreed to accept the attached Quit -Claim Deed and Bill of Sale. FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action.
