Agenda 10/09/2018 Item #11D10/09/2018 EXECUTIVE SUMMARY Recommendation to approve an Interlocal Agreement between the District Schools of Collier County (District) and the Board of County Commissioners (Board), that supersedes the prior Interlocal Agreement and meets new reimbursement guidelines implemented by the Federal Emergency Management Agency (FEMA), authorize the payment of $3,038,402.12 to the District for shelter and transportation cost incurred during Hurricane Irma, and authorize all necessary budget amendments. OBJECTIVE: To reimburse the District for its cost associated with evacuation sheltering and transportation. These expenses are FEMA reimbursable and have been submitted by the County to FEMA for reimbursement. CONSIDERATIONS: The Board and the County Division of Emergency Management have maintained an excellent working relationship for disasters and emergencies for over a decade. Florida Statute provides for the local government and county emergency management use of schools and universities for emergency shelter and transportation. Historically, the Florida Division of Emergency Management has directed school districts statewide to file directly with FEMA for shelter and transportation cost. The District has been reimbursed on numerous occasions by applying directly to FEMA for reimbursement in the years before Hurricane Irma. Following Hurricane Irma, FEMA and the Florida Division of Emergency Management determined that school districts, while eligible applicants for FEMA reimbursement in most all of FEMA’s eligible categories, were not eligible for direct reimbursement for their shelter and evacuation costs contrary to previous practice. FEMA’s guidance now requires counties to reimburse the District for shelter and transportation costs and submit those costs in concert with its other eligible expenses. The District has been a strong partner in working with the County and Emergency Management toward the development of a new Interlocal Agreement that provides substantially more clarity with respect to these changes as well as roles, responsibilities, training, reimbursement, and mutual support. The District has requested the Board to execute this new Interlocal Agreement first. Following the Boards approval, the District will place the new Interlocal Agreement on their earliest convenient meeting for final execution. The Interlocal Agreement contains a 90-day mutual termination provision for convenience and a 30-day mutual termination provision for cause. Staff also recommends the payment of $3,038,402.12 to the District for its cost associated with the County’s request for shelter operations and transportation during the Hurricane Irma event. The County has filed these expenses with FEMA, however, reimbursement cannot be made until they are paid by the County. FISCAL IMPACT: The District is owed for the shelter operations and transportation costs in support of our community’s response to Hurricane Irma in the amount of $3,038,402.12. Future shelter operations and transportation costs are totally event dependent. Funding for this obligation will require a draw on FY 2019 General Fund (001) reserves in the full amount of that sum owed to the District. These dollars will be transferred from the General Fund to General Governmental Capital Fund (301) for accounting and tracking purposes. This transaction is classified as a loan from the General Fund and reserves will be restored once expected reimbursement from FEMA occurs. 11.D Packet Pg. 141 10/09/2018 GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact resulting from this action.
