WHEREAS, on December 16, 1997, the Board of County Commissioners (Board) adopted Ordinance No. 97-82, which created the Bayshore Avalon Beautification Municipal Service Taxing Unit now known as the Bayshore Beautification Municipal Service Taxing Unit; and WHEREAS, the Board subsequently amended Ordinance No. 97-82 through its adoption of Ordinance Nos. 98-15, 98-29, 08-20, 13-68;and WHEREAS, considering the recommendations of staff and the Bayshore Beautification Advisory Committee, the Board wishes to further amend Ordinance No. 97-82, as amended, to expand the Taxing Unit boundaries as further set forth in Exhibit"A,"attached hereto. Section Two is hereby amended to revise the geographic boundaries of the Bayshore Beautification Municipal Service Taxing Unit as shown on Exhibit "A," Bayshore Development Area Expanded Legal Description,attached hereto and incorporated herein by reference. SECTION TWO: CONFLICT AND SEVERABILITY. In the event this Ordinance conflicts with any other Ordinance of Collier County or other applicable law, the more restrictive shall apply. If any court of competent jurisdiction holds any phrase or portion of the Ordinance invalid or unconstitutional, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portion.
