EXECUTIVE SUMMARY
Recommendation to approve eight (8) mortgage satisfactions for the State Housing Initiatives
Partnership (SHIP) Loan Program in the combined amount of $51,460.
OBJECTIVE: To support the affordability of housing in Collier County through the utilization of State
SHIP funds for down payment and rehabilitation assistance.
CONSIDERATIONS: The SHIP Program allows communities to design programs that provide housing
assistance for down payment and closing costs for first-time homebuyers, emergency repairs to a newly
acquired home, rehabilitation assistance to income-qualified homeowners, and other programs to address
local housing needs. As a condition of receiving SHIP funding, the homeowner must repay the financial
assistance upon sale, refinance, or loss of homestead exemption.
Staff has identified five (5) Mortgages where the County received payment for the down payment
assistance in 2001-2002 and the Satisfaction was not recorded for these homeowners who still reside in
the property.
Staff has identified three (3) mortgages where the homeowner is entitled to have to have their original
down payment assistance and or residential rehabilitation assistance forgiven. None of the mortgages
include a maturity date. Section 95.281(1)(b) F.S. allows this debt to be forgiven if the mortgage is more
than twenty (20) years old and the final maturity of an obligation secured by the mortgage is not
ascertainable or previously set forth in the mortgage. Under such circumstances, the mortgage is
considered terminated and for record purposes, the down payment amount rehabilitation may be forgiven.
The following two (2) tables provide the details regarding homeowners who repaid the SHIP funds to
Collier County and residential rehabilitation homeowners who have met their term of assistance. As such,
Satisfaction of Mortgage is required but was not executed at the time of repayment.

FISCAL IMPACT: The repaid amount of $20,000 satisfies the mortgage amount due to the recapture
provision as noted above. These repayments are considered program income and were deposited in the
originally established SHIP Fund (121) now known as Urban Improvement Grant Fund. Such funds were
reused for eligible SHIP activities. Eight (8) recording fees of $10 will be paid by SHIP Administrative
account 33525.
GROWTH MANAGEMENT IMPACT: The SHIP Program furthers the goals and objectives of the
Housing Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote
for Board approval. -JAB
RECOMMENDATION: To approve and authorize the Chairman to sign eight (8) mortgage satisfactions
for owner-occupied affordable housing units for which repayment or term commitment was provided to
Collier County.
