EXECUTIVE SUMMARY
Recommendation to approve an Underground Facilities Conversion Agreement (UFCA) with
Florida Power & Light Company (FPL) for Phase IV of the Vanderbilt Beach Municipal Service
Taxing Unit (MSTU) Utility Conversion Project and to approve payment to FPL in the amount of
$287,680 for materials and services as received and provided by FPL.
OBJECTIVE: To convert the FPL overhead utilities to underground to complete hurricane hardening
and area beautification for Phase IV of the Vanderbilt Beach MSTU.
CONSIDERATIONS: The Board of County Commissioners (Board) entered into a Right-of-Way
Agreement with FPL on December 11, 2007, to demonstrate its commitment to initiate the conversion of
overhead power to underground within the Vanderbilt Beach MSTU District. The Vanderbilt Beach
MSTU is now well underway with its four-phase FPL Aerial to Underground Conversion project. Phase I
of the project was completed in September 2013. Phases II and III have been under construction since
January 2015 and initially scheduled to be complete in April 2018 but was delayed to avoid conflicts with
a Public Utilities project in the same area. The coordination with Public Utilities is moving along as
scheduled and Phases II and III are roughly expected to be complete by August 2019.
On October 28, 2014, the Board approved payment for the non-refundable Engineering Deposit for the
completion of the design and planning of Phase IV. The design is now complete and the next step is to
enter into a UFCA with FPL. The Agreement is required by the Florida Public Service Commission Tariff
Section 12.1 to receive a twenty-five (25%) percent Government Adjustment Factor (GAF) cost reduction
from FPL. The Agreement will also provide for payment to FPL for material, as received, for Phase IV of
the Conversion Project. Upon execution of the UFCA, Phase IV of the project can move forward with
construction of the underground distribution facilities.
The MSTU used lessons learned from Phase I to improve upon its approach for the construction of Phase
II and III, which will also be incorporated for Phase IV. In Phase I, FPL supplied the material and
performed all construction activity to bury the electrical system. For phases II and III, the MSTU has
elected to utilize the County bidding process for the construction; with the exception of a portion of the
work that FPL requires to be performed by its personnel. This approach, which will also be used for
Phase IV, ensures the lowest cost for construction and places the project timing and quality control in the
hands of the County (MSTU) rather than FPL.
On September 6, 2018, the Vanderbilt Beach MSTU Committee voted (4-0) to approve up to $287,680
for payment to FPL for materials and services as received and provided, for Phase IV of the Conversion
project, which consists of Vanderbilt Drive, from Immokalee Road to Wiggins Pass within the MSTU
boundaries.
FISCAL IMPACT: Funds in the amount of $287,680 are available within Vanderbilt Beach MSTU
Fund (143).
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact.
LEGAL CONSIDERATIONS: This Item is approved as to form and legality and requires majority vote
for Board approval. -SRT
