EXECUTIVE SUMMARY
Recommendation to approve an amended and restated Agreement authorizing affordable housing
density bonus and imposing covenants and restrictions on Real Property as a companion item to the
Esperanza Place RPUD. (This is a companion to Agenda Item 17.A)
OBJECTIVE: To support the affordability of housing in Collier County through the Collier County
Affordable Housing Density Bonus Program.
CONSIDERATIONS: The Collier County Affordable Housing Density Bonus Ordinance No. 90-89,
codified by Ordinance 04-41, as amended, as Land Development Code 2.06, authorizes the Board of
County Commissioners (Board) to enter into an Affordable Housing Density Bonus Agreement with an
owner or developer to encourage the development of additional rental or homeownership housing that is
affordable for Collier residents. The Affordable Housing Density Bonus Agreement shall be a lien on the
property.
The owner of the Esperanza Place RPUD entered into an Affordable Housing Density Bonus Agreement
with the Board on June 10, 2008. This request to amend the existing agreement will reduce the gross
density of the property from 8.28 units per gross acre to 5.03 units per gross acre and reduce the total
number of housing units from 262 to 159 units. This amendment reduces the number of density bonus
units from 135 to 33. Currently, there are forty-six (46) multi-family units on the site and four (4) single-
family homes. Ten (10) of the existing rental units are leased to tenants who are at or below fifty (50%)
percent of the County median income (very-low income) with thirty-six (36) units rented to tenants at
low-income or fifty-one to sixty (51-60%) percent of County median.
This amended and restated Affordable Housing Density Bonus Agreement is a companion Item to
Summary Agenda Item #6474 Esperanza Place RPUD, PUDA PL20170001326 amending Ordinance No.
2008-28.
FISCAL IMPACT: There is no Fiscal impact.
GROWTH MANAGEMENT IMPACT: The Affordable Housing Density Bonus Program assists the
County in meeting the goals and objectives of the Housing Element of the Growth Management Plan.
LEGAL CONSIDERATIONS: This Item is approved for form and legality and requires a majority vote
for Board approval. -JAB
RECOMMENDATION: To approve and authorize the Chairman to sign the amended and restated
Agreement authorizing affordable housing density bonus and imposing covenants and restrictions on Real
Property as a companion item to the Esperanza Place RPUD.
