Attachment 90 RESOLUTION NO. 2018- 15 4 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, RELATING TO THE ASSESSMENTS FOR THE CASSENA ROAD MUNICIPAL SERVICE BENEFIT UNIT PROVIDING FOR POTABLE WATER FACILITIES AND SERVICES TO PROPERTIES LOCATED ON A PORTION OF CASSENA ROAD, AMENDING THE ESTIMATED PROJECT COSTS, OBLIGATIONS, AND ASSESSMENTS, WHILE CONFIRMING ALL OTHER PORTIONS, PROVIDED IN RESOLUTION NO. 2017-243; ADOPTING THE ANNUAL ASSESSMENT ROLL; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on December 12, 2017, the Board of County Commissioners (Board)adopted Resolution No. 2017-243, the Initial Rate Resolution, creating the Cassena Road Potable Water Municipal Service Benefit Unit (MSBU) to assess and collect assessments for the construction of potable water facilities servicing the properties within the MSBU and adopting the uniform method for collection of the non-ad valorem assessments; and WHEREAS, since December 12, 2017, the County Manager or his designee has finalized the Capital Cost of the Project and the Annual Assessment Roll as required in Section 4.04 of Resolution No. 2017-243; and WHEREAS, on this date, September 11, 2018, the Board held a public hearing where the Board heard public comment, including all written objections, of affected property owners. NOW, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, THAT: SECTION ONE: Updating Capital Costs for Cassena Road Potable Water Project; Confirmation of Resolution No. 2017-243. A. The estimated figures provided in Resolution No. 2017-243 shall be updated as follows: 1. The "Capital Cost" as estimated in Section 4.01 of Resolution No. 2017- 243 is hereby updated to reflect the project cost of $312,369.00 before administrative fees, collection fees and interest. 2. The "Obligation" as defined in Article I of Resolution No. 2017-243 shall reflect the cost per Tax Parcel as$24,028.39 before administrative fees,collection fees and interest. 3. The per Tax Parcel share in"Appendix B"attached to Resolution No. 2017- 243 shall be updated and supplemented by the attached Exhibit "A" reflecting the initial 1 (A 90 assessment to be assessed on the 2018 tax roll for each Tax Parcel, which includes all administrative fees, collection fees and interest. B. Except as modified, amended and supplemented herein, the provisions of Resolution No. 2017-243 are hereby ratified and confirmed. SECTION TWO: Adoption of the Non-Ad Valorem Assessment Roll. A. The 2018 non-ad valorem assessment roll on file with the County Manager's Office for the Cassena Road Potable Water MSBU is hereby adopted and shall be certified by the Chair to the Collier County Tax Collector. Pursuant to Section 197.3632, Florida Statutes, the assessment rolls shall be certified prior to September 15, 2018. B. Special assessments imposed within the Cassena Road Potable Water MSBU shall constitute a lien against assessed property equal in rank and dignity with the liens of all state, county, district or municipal taxes and other non-ad valorem assessments. Except as otherwise provided by law,such lien shall be superior in dignity to all other liens,mortgages,titles and claims until paid in full pursuant to the Uniform Assessment Collection Act. C. The adoption of the Assessment Roll as provided herein shall be the final adjudication of the issues presented(including,but not limited to,the apportionment methodology, the rate of assessment,the Assessment Roll,and the levy and lien of the Assessment),unless proper steps are initiated in a court of competent jurisdiction to secure relief within 20 days from the date of Board adoption of the Assessment Roll. SECTION THREE: Effective Date. This Resolution shall become effective upon approval by the Board.
