Agenda 09/11/2018 Item #16D 109/11/2018 EXECUTIVE SUMMARY Recommendation to approve and accept the conveyance of a bus stop shelter Revocable Easement on property owned by Circle K Stores, Inc. OBJECTIVE: To obtain a bus stop shelter easement to provide a safe, convenient waiting area that is compliant under the Americans with Disabilities Act (ADA) for the transit users within Collier County. CONSIDERATIONS: The Public Transit & Neighborhood Enhancement (PTNE) Division has a shelter construction program for which they have identified bus stop locations along the various routes that have ridership that requires improvements such as bus shelters, benches, bike racks, and trash cans. In most cases, there is adequate public right of way to accommodate the needed improvements. There are a few locations where easements are needed from adjacent property owners for the facilities associated with the bus stop improvements. Bus Stop #70, located at 1033 Airport-Pulling Rd. South, is one such location requiring an easement. In this case, PTNE is requesting that Circle K Stores, Inc. convey to the County a non-exclusive easement for the purpose of constructing, operating, maintaining, repairing, and replacing paving and facilities associated with a bus stop, shelter, and related facilities over, under, upon, and across the lands described in Exhibit "A" of the attached Revocable Easement Purchase Agreement. Circle K Stores, Inc. requires a payment of $2,000 as partial reimbursement for the attorney’s fees it incurred in the negotiation and processing of this easement. The in-house Senior Review Appraiser for Collier County Real Property Management has valued the easement at $4,330. FISCAL IMPACT: The cost for acquiring the easement from the property owner will not exceed $2,000, and the cost of recording the easement will not exceed $35.50. Funds in the amount of $2,035.50 are available in Fund (426) under Project No. 60083. GROWTH MANAGEMENT IMPACT: There is no Growth Management impact. LEGAL CONSIDERATIONS: This Item has been reviewed by the County Attorney. This is a revocable easement, which is unusual. The County Attorney has no concerns with this revocation right, as under the terms of the agreement between the parties, the owner may revoke the easement only if the bus shelter is destroyed and not replaced, is removed by the County, or if the County breaches the agreement, which contains no terms which are unusual or onerous for the County. With that noted, this Item has been approved for form and legality and requires a majority vote for approval. -JAK RECOMMENDATION: To approve the attached Revocable Easement Purchase Agreement and accept the attached Revocable Easement for bus stop and shelter, authorize the Chairman to sign the Revocable Easement Purchase Agreement and direct the County Manager, or his designee, to record the Revocable Easement in the Public Records of Collier County, Florida.
