EXECUTIVE SUMMARY
Recommendation to approve an agreement between the Diocese of Venice in Florida, Quality
Enterprises, Inc. and Collier County to construct a gravity wall to address an unsafe slope
condition on a waste water pump station relocation project.
OBJECTIVE: To maintain reliable wastewater collection in compliance with Florida Department of
Environmental Protection agency regulations.
CONSIDERATIONS: On October 27, 2015, as Agenda Item 16.C.1, the Board of County
Commissioners (Board) approved Request for Quotation 14-6213-45 with Quality Enterprises, Inc. (QE)
for the relocation of wastewater pump station (PS) 302.09. In the same time frame, The Diocese of
Venice in Florida was constructing a parking lot expansion at Saint Peter the Apostl e Catholic Church
(Church) on Rattlesnake Hammock Road.
Pump station 302.09 was originally located on Church property where it conflicted with the Church’s
plans to expand their parking lot. The Collier County Water-Sewer District (CCWSD) agreed to relocate
the pump station within its easement in a manner that allowed for more Church parking and eliminated
the need for lengthy bypass pumping during pump station construction.
The Church and the CCWSD coordinated their projects during pump station design; however, field
changes made to both projects resulted in an unsafe slope along the Church’s property line. Quality
Enterprises, Inc. installed the pump station wet well at a location different than what was specified by the
County. While the resulting wet well location was within the easement, it was closer to the edge of
property, but did not create an issue with the Church’s original design. The Church changed their site
elevations to avoid cap rock field conditions discovered during the County’s project. The Church’s
design change, combined with the as-built wet well location, necessitated the addition of a 13.5 foot long
gravity wall to address the unsafe slope.
To resolve this issue, all three parties agreed to equally share $12,000 in cost for the Church to construct
the gravity wall (See Attachment 1 - Settlement Agreement). The cost to the CCWSD is $4,000. The
$12,000 was based on an initial estimate provided by the Diocese of Venice; actual construction costs
were higher (See Attachment 2 - Change Order).
FISCAL IMPACT: Funding is available in, and is consistent with, the FY2018 Capital Budget
approved by the Board on September 21, 2017. The source of funding is the Wastewater User Fee Fund
(414).
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to ensure the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item is approved as to form and legality. A majority vote is
needed for Board approval. -HFAC
RECOMMENDATION: That the Board of County Commissioners, as the Governing Body of Collier
County and the Ex-officio Governing Board of the Collier County Water -Sewer District, approves an
agreement between the Diocese of Venice in Florida, Quality Enterprises, Inc. and Coll ier County, and
authorizes the Chairman to sign and execute the agreement.
