Agenda 09/11/2018 Item #16A1809/11/2018 EXECUTIVE SUMMARY Recommendation to accept a Quitclaim Deed from South Florida Water Management District conveying 51.18 acres + of land (Parcel 120FEE) adjacent to Lake Trafford in Immokalee (ImmSIP Project 60143). Estimated Fiscal Impact: $44. OBJECTIVE: To accept a Quitclaim Deed from South Florida Water Management District (the “District”) conveying 51 acres + of land adjacent to Lake Trafford in Immokalee identified as District Tracts 09001-032, 09001-033, 09001-034 and 09001-100 (identified on the tax roll as folio numbers 00053960003, 00059640000, 53504880003, 53504920002, 53504960004 and herein collectively referred to as “Parcel 120FEE”). CONSIDERATIONS: Collier County wants to build a water quality treatment pond on Parcel 120FEE as part of the Immokalee Stormwater Improvement Program, Project No. 60143 (“ImmSIP”). Per Resolution No. 2018-0603, adopted on June 14, 2018 by its Governing Board, the District agreed to transfer Parcel 120FEE to the County for no consideration, subject to a restrictive covenant, a unity of title and a reverter and conditioned upon the closing occurring on or before September 30, 2018. In summary, this means that Parcel 120FEE must be used by the County, and all subsequent owners, in a manner consistent with the goals and objectives of the Corkscrew Regional Ecosystem Watershed Project and if not, then the County will be required to convey it back to the District. FISCAL IMPACT: Funds in the amount of approximately $44 to record the Quitclaim Deed are required. Source of funds is transfers from the General Fund (001) and Unincorporated Area General Fund (111). Operating and maintenance costs will be considered when the construction contract for the water quality treatment pond is brought before the Board for approval. LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a majority vote for Board approval. - JAB GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the applicable sections of the Stormwater Management and Conservation and Coastal Management elements of the Collier County Growth Management Plan. RECOMMENDATION: That the Board of County Commissioners performs the following: . Accepts conveyance of the 51.18 + acres of land (Parcel 120FEE) and authorize the County Manager, or his designee, to record the conveyance instrument in the public records of Collier County, Florida; . Authorizes the payment of all costs and expenses that Collier County is required to pay for recordation of the Quitclaim Deed from the District; . Authorizes the County Manager or his designee to take the necessary measures to ensure the County’s performance in accordance with the terms and conditions detailed in the Quitclaim Deed, including a restrictive covenant, unity of title and a reverter; and . Authorizes any, and all, budget amendments that may be required to carry out the collective will of the Board.
