EXECUTIVE SUMMARY
Recommendation to reappoint an alternate member as a regular member on the Code Enforcement
Board.
OBJECTIVE: To reappoint alternate member Kathleen Elrod as a regular member on the Code
Enforcement Board, to the remainder of a vacant term expiring on February 14, 2019.
CONSIDERATIONS: This seven member board, plus two alternates, is established pursuant to Chapter
162 of the Florida Statutes by Ordinance No. 07-44, as amended, and is composed of individuals
representing the occupations of architect, business owner, engineer, general contractor, subcontractor and
realtor, and who are considered on the basis of their experience or interest in the areas of the codes and
ordinances to be enforced. Members are required to file a Form 1 Statement of Financial Interest each
year with the Supervisor of Elections. Terms are 3 years. This is a quasi -judicial board. A list of the
current membership is included in the backup.
Board member Lionel L’Esperance resigned on August 21, 2018, leaving a vacant seat. Staff would like
to reclassify the following alternate member as a regular member to fill this vacancy:

ATTENDANCE: Ms. Elrod has had no unexcused absences in the past two years.
STAFF RECOMMENDATION: As the Code Enforcement Board is a quasi-judicial board, no
committee recommendation is required. Staff recommends that Ms. Elrod be reclassified from an
alternate member to a regular member. A recommendation memo is included in the backup. The resulting
vacant alternate seat will continue to be advertised.
FISCAL IMPACT: None.
GROWTH MANAGEMENT IMPACT: None.
RECOMMENDATION: That the Board of County Commissioners adopts the Committee
Recommendation, and directs the County Attorney to prepare a resolution confirming the reappointment.

Please be advised that as of August 21, 2018 there is a vacancy for a regular
member on the Code Enforcement Board. In accordance with Ordinance 2007-
44, Article II, Section 2, the Code Enforcement Board shall be comprised of
seven members and two alternate members. Ms. Kathleen Elrod is a local
business woman who resides in Collier County and has held a member seat as
an alternate on the Code Enforcement Board from February 14, 2016 to present.
Ms. Elrod during this time had four excused absences. We are requesting Ms.
Elrod to be reclassified from alternate to regular member to fill the remaining
vacancy on the CEB.
