A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF
COLLIER COUNTY, FLORIDA RELATING TO PETITION NUMBER
ST- PL2012 -168 FOR A SPECIAL TREATMENT DEVELOPMENT
PERMIT TO DREDGE AND FILL ON STATE -OWNED PROPERTY IN
THE VICINITY OF WIGGINS PASS CHANNEL ZONED
AGRICULTURAL AND CONSERVATION WITH SPECIAL
TREATMENT OVERLAYS (A -ST AND CON -ST) IN SECTIONS 17,18
AND 20, TOWNSHIP 48 SOUTH, RANGE 25 EAST, COLLIER COUNTY,
FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes, has
conferred on all counties in Florida the power to establish, coordinate and enforce zoning and
such business regulations as necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code (LDC)
(Ordinance No. 2004 -41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County; and
WHEREAS, the Board of County Commissioners of Collier County has held a public
hearing after notice as in said regulations made and provided, and has considered the advisability
of allowing the dredging and filling on property as shown on the attached plans, Exhibit "A ", in
an Agricultural Zoning District and Conservation Zoning District with Special Treatment
Overlays (A -ST and CON -ST) wherein said property is located; and
WHEREAS, all interested parties have been given opportunity to be heard by this Board
in public meeting assembled and the Board having considered all matters presented.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA; that:
Petition ST- PL2012 -168 filed by Collier County with respect to property in the vicinity of
the Wiggins Pass channel is hereby approved for a Special Treatment Development Permit to
allow the dredging and filling on State -owned property as shown on the attached plans, Exhibit
"A ", in an Agricultural Zoning District and Conservation Zoning District with Special Treatment
Overlays (A -ST and CON -ST) wherein said property is located, and subject to the Conditions of
Approval found in Exhibit "B ". Exhibits "A" and `B" are attached hereto and incorporated
herein by reference.
BE IT FURTHER RESOLVED that this Resolution relating to Petition Number ST-
PL2012 -168 be recorded in the minutes of this Board.

Re: Wiggins Pass; Collier County
Thank you for your recent inquiry requesting a review of additional
information in the matter of the proposed maintenance dredging project
at Wiggins Pass. Your question was regarding the boundaries of a
parcel of land that may overlap the project area. The parcel is identified
by Collier County Property Appraiser's Parcel Identification No.
00156120009, as described in Special Warranty Deed recorded in Collier
County Official Record 2904 Page 0172. The area of interest is located in
Section 17, Township 48 South, Range 25 East.
Records indicate the submerged lands lying below the mean high
waterline within the area described by said parcel at the location of the
proposed maintenance dredging project site are state owned. Therefore,
pursuant to Section 253.77 (1), Florida Statutes, any activities affecting
the submerged lands at this site would require authorization from the
Board of Trustees.

Hi Bill,
1 am writing you to show my support of the ECA and the �Aiiggins Pass dredging project. I am a local
homeowner and a member /slip owner of Pelican Isle Yacht Club. The reason I chose this area in 2004 to
invest in was because I am a boater and what the area has to offer from a boating perspective. There
are many people in my community (Cove Towers) that are boaters and feel the same way, as well as the
many other homeowners that pay a premium for property and taxes to live on the water. Not to
mention the thousands of people not on the water who trailer their boats to the Collier County boat
ramp, who also buy fuel and bait at the county store. These people can easily trailer their boats
somewhere else, and support some other area more friendly towards boaters. Not so easy for slip
owners and homeowners on the water. However I would personally move to another area if Wiggins
Pass is not maintained for boating safety. The impact to the North Naples area is huge. Collier County
should take this into consideration when making decisions to maintain Wiggins Pass for boating safety,
after all they collect a premium in taxes for waterfront property which will become less valuable if
Wiggins Pass in not maintained. Thank you for your ongoing support and efforts to keep Wiggins Pass
safe for boaters.

i 'would like to let it be known that I support the plan: of the ECA to open Wigging Pass. My vessel has a
draft of 16" and I have found it very difFcult to enjoy boating from the marina at the PIYC. If the plan is not
passed, i have no choice but to move my vessel to another marina so I can enjoy boating without
worrying about damage to my vessel as i go in and out of Wiggins Pass. This situation seems to have
deteriorated over the last several years and i and other have reached a point where we have no choice
but to leave the PIYC marina which is so convenient and enjoyable to our friends and family and the
member of the PIYC.

Even though I am no longer administering the website 1 felt that this notification was critical

become dangerously shallow, but the markers have been moved as shoaling has taken
place to the point where the channel is now so narrow between the marker and the north

ECA learned yesterday that the next to final approval of the Wiggins Pass dredging project will be
voted upon by the Collier County Board of Commissioners on Tuesday, October 9th. The Commissioners
are being asked to confirm that all Collier County " Environmental Requirements" have been complied
with. However, there is reason to believe that opponents to the project will raise issues attacking
compliance. ECA believes that environmental compliance standards have been met and that opponents to
the project can be overcome by facts and public support. Your attendance at the Commission Hearing is
at the cross roads of our success.
It is critical that we have as many supporters at the Commission meeting as possible. To prepare
everyone who will 'sacrifice to attend', there will be a meeting of the Wiggins Pass Subcommittee of the
Coastal Advisory Committee on Monday, October 8th at 10:00am at the County Administrative Center. At
this meeting, the Wiggins Pass project will be fully discussed and any questions answered to prepare you
to understand the project and the issues expected. The County Commissioners meeting will be in the BCC
Chambers in the 31d Floor main County building.
Please email Bill Pitman by email ( 1onaa1es�wi!2ao!.com ) of your commitment to support what ECA
believes to be the best interest of our District 2 Collier County, boaters, property owners, potential tax
revenue, navigation safety, recreation, and the Golden Reputation of our Community. At this point you

We've been navigating Wiggins Pass for almost twenty years in a small boat. The channel has become
so narrow that, for the first time, boats cannot pass in opposite direction simultaneously for fear of
grounding.
As well, we've always seen people of all ages on the two beaches enjoying the fishing.
Now as we pass between them - Barefoot on the North and Delnor Wiggins on the South - we feel as if
we merely have to stretch our arms over the boat sides and, we'd be touching their fish lines.
CAN BOATERS AND FISHING FOLK CONTINUE TO PLEASURABLY AND SAFELY SHARE THIS
BEAUTIFUL NATURAL SPACE?
