I: Forms/ County Forms/ BCC Forms/ Original Documents Routing Slip W WS Original 9.03.04, Revised 1.26.05, Revised 2.24.05 16A 2 RESOLUTION NO. 2012 -1 12 A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA AUTHORIZING FINAL ACCEPTANCE OF CERTAIN ROADWAY AND DRAINAGE IMPROVEMENTS IN ROYAL PALM GOLF ESTATES UNIT ONE, ACCORDING TO THE PLAT THEREOF RECORDED IN PLAT BOOK 12, PAGES 13 THROUGH 18; RELEASE OF THE MAINTENANCE SECURITY; THE MAINTENANCE RESPONSIBILITY FOR THE ROADWAY AND DRAINAGE IMPROVEMENTS WILL BE THAT OF THE ROYAL PALM GOLF ESTATES HOMEOWNERS' ASSOCIATION, INC. WHEREAS, the Board of County Commissioners of Collier County, Florida, on August 24, 1976 approved the plat Royal Palm Golf Estates Unit One for recording; and WHEREAS, the majority of the Lots and roadway infrastructure fell into the receivership of the Resolution Trust Corporation in 1989. Boyne South LLC purchased the majority of the Lots and associated infrastructure in 1994. Boyne subsequently re- paved the roadways and installed drainage improvements; and WHEREAS, on December 14, 2004, the Board of County Commissioner approved Resolution 2004 -378 which vacated the Publics' interest and maintenance responsibility with respect to the roadways within Royal Palm Golf Estates Unit One; and WHEREAS, the Developer has constructed and maintained the roadway and drainage improvements in accordance with the approved plans and specifications as required by the Land Development Code (Collier County Ordinance No. 04 -41, as amended); and WHEREAS, the Developer is requesting final acceptance of the roadway and drainage improvements and release of his maintenance security; and WHEREAS, the Land Development Services Section of the Growth Management Department has inspected the roadway and drainage improvements, and is recommending acceptance of said facilities. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby granted for those roadway and drainage improvements in Royal Palm Golf Estates Unit 16A One, pursuant to the plat thereof recorded in Plat Book 12, pages 13 through 18, and the Clerk is hereby authorized to release the maintenance security. BE IT FURTHER RESOLVED AND ORDERED that the future maintenance and other attendant costs for those roadway and drainage improvements will be the responsibility of the Royal Palm Golf Estates Homeowners' Association Inc., and Collier County has no maintenance responsibility with respect to said improvements.
