Comments on PBSD Resolution Agenda Item: /® C January 10, 2012
Good Afternoon Commissioners and Happy New Year. I'm optimistic that 2012 will be one
of increased ecotourism and I'm prepared to help move this along as much as possible in
my newly added role of Sierra Club Calusa Group Outings Chair by highlighting our area.
I believe that you are serious about protecting the safe recreation of ALL persons who enjoy
the many in -water opportunities of Clam Pass /Clam Bay. I'm a resident of Collier County
who has come before you many times due to my commitment of keeping the Clam Pass/
Clam Bay NRPA Preserve protected and preserved for current and future generations.
I'm one of thousands who regularly enjoy and appreciate passive recreational opportunities
at Clam Pass. I'm one of nearly 500 members of a local Paddlers Club. I'm also one of the
millions Sierra Club members and I serve on the Executive Board of the Sierra Calusa Group.
I respectfully request that you approve the PBSD Resolution, which would clarify the 1998
Clam Bay Restoration and Management Plan attached to the 1998 FDEP Joint Coastal permit,
for modification of one ambiguous sentence in the Plan. This would clarify the Plan and
hopefully cure that sentence being the cause of a divisive interpretation disagreement.
I additionally request that you endorse and affirm the Information and Canoe Boat Trail
markers as the FDEP Modification to page 9 of the 1998 Joint Coastal Permit.
BACKGROUND INFORMATION:
There is a deficiency on page 9 of the 1998 FDEP Joint Coastal Permit. This part of the 1998
FDEP permit required two sets of waterway signage (markers) in 5 locations of Clam Pass/
Clam Bay. One set of signage /markers continued and added a few more locations of what
had been initiated by Ordinance 96 -16, known as the "Water Safety and Vessel Control"
Ordinance. The other set of permit- required signs mistakenly combined Informational and
Regulatory language. In 2008 Florida Fish and Wildlife Commission (FWC) identified the
combined language was not legal. FDEP determined an Administrative Modification would
be done to correct signage /markers language through consultation and approval by FWC.
The Information and Canoe Boat Trail markers for the Clam Pass /Clam Bay Preserve were
approved, in consultation with the FWC for language recommended by a majority of the
2011 Clam Bay Marker Work Group, as the most appropriate way to improve Safety of ALL
recreational uses and maintain protection of natural resources in the Clam Bay Preserve.
SUMMARY:
It's a reasonable request by the PBSD Board to the Collier County Commission to approve a
PBSD Resolution that clarifies intent of the Clam Bay Restoration and Management Plan by
modification of one ambiguous sentence that's been the cause of a divisive and expensive
disagreement on its interpretation. It's also reasonable for the BCC to affirm the Clam Pass/
Clam Bay markers approved by FWC, as the Administrative Modification to page 9 in the
1998 FDEP permit, to ensure language of waterway signage /markers is legally sufficient.
Please approve the PBSD Board's Resolution Petition and also affirm the information and
Canoe Boat Trail markers as the FDEP Administrative Modification to page 9 of the 1998
FDEP permit. This action by the Commission today corrects defective language in the
permit, protects the safety of ALL recreational users, and protects sensitive natural
resources for the benefit of current and future generations to enjoy the Clam Bay NRPA.
