Thank you First Amendment to 16D1 Agreement between Collier County and Collier County Community Redevelopment Agency (CRA) Immokalee First Street Plaza Public Facility Project Catalog of Federal Domestic Assistance # 14.218 HUD Grant # B- 10 -UC -12 -0016 This Amendment, is entered into this day of 2013, by and between the parties to the original Agreement, Collier County Com unity Redevelopment Agency (CRA) Immokalee ", a public entity created by Collier County pursuant to Chapter 163, Florida Statutes, having its principal office at 1320 N. 15th Street, Immokalee, FL 34142, and its Federal Tax Identification number as 59- 6000558 & DUNS # 076997790, herein after referred to as SUBRECIPIENT and Collier County, Florida, herein after to be referred to as "COUNTY," collectively stated as the "Parties." RECITALS Whereas, on January 24, 2012, the County entered into an Agreement with the Community Development Block Grant Program funds to be used for land acquisition and construction/design -build activities /line items /services (hereinafter referred to as the "Agreement "); and Whereas, the Parties desire to further amend the Agreement to reference additional HUD language and make housekeeping type modifications to the agreement including the Scope of Services. The SUBRECIPIENT agrees to comply with the requirements of Title 24 of the Code of Federal Regulations Part 570 (the U.S. Housing and Urban Development regulations concerning_ Community Development Block Grants (CDBG) ) including subpart K of these regulations except that (1) the SUBRECIPIENT does not assume the recipient's environmental responsibilities described in 24 CFR 570.604 and (2) the SUBRECIPIENT does not assume the recipient's responsibility for initiating, the review process under the provisions of 24 CFR Part 52 The SUBRECIPIENT also agrees to comply with all other qpplicable Federal state and local laws regulations and policies governing the funds provided under this contract The SUBRECIPIENT further agrees to utilize funds available under this Agreement to supplement rather than supplant funds otherwise available. VII. ADMINISTRATIVE REQUIREMENTS B. DOCUMENTATION AND RECORDKEEPING 2. All reports, plans, surveys, information, documents, maps, and other data procedures developed, prepared, assembled, or completed by the SUBRECIPIENT for the purpose of this Agreement shall be made available to the COUNTY by the SUBRECIPIENT at any time upon request by the COUNTY or HHVS. Upon completion of all work contemplated under this Agreement copies of all documents and records relating to this Agreement shall be surrendered to HHVS if requested. In any event the SUBRECIPIENT shall keep all documents and records for sib) four 4 years after expiration of this Agreement. GRANT CLOSEOUT PROCEDURES SUBRECIPIENT's obligation to the COUNTY shall not end until all closeout requirements are completed. Activities during this closeout period shall include, but not be limited to: making final payments, disposing of program assets (including the return of all unused materials, equipment, program income balances, and receivable accounts to the COUNTY), and determining the custodianship of records. In addition to the records retention outlined in Section VILI the SUBRECIPIENT shall comply with Section 119.021 Florida Statutes regarding records maintenance, preservation and retention. PROJECT SCOPE: The Immokalee Community Redevelopment Agency (CRA) will use Community Development Block Grant (CDBG) funding in the amount of $810,000.00 for the acquisition of two adjacent parcels of land and subsequent design and building of the First Street Public Plaza in the downtown area of Immokalee, Florida. The design will include twe one gateways for the central commercial district. The Plaza 9ne will be located on at the NE corner of First and Main Street; and the other- en First and �4inth Stfeett. Construction/design -build activities /items /services may include but not be limited to: closing costs, impact fees, pre- design/design, permitting, pedestrian walkway sidewalk, and roof structure; columns, fencing, bollards, fountain; earthwork to include stormwater, landscaping and installation of utilities (water and electric). The detailed project scope will be contained in the schedule of values awarded the project's construction contract. The project construction contract will include details sufficient to document the number, amount, and costs associated with all activities. B. BUDGET Collier County Housing, Human and Veteran Services is providing Eight Hundred and Ten Thousand Dollars ($810,000.00) in CDBG funding for the project scope described above.
