EXECUTIVE SUMMARY
Recommendation to approye a Stipulated Final Judgment in the amount of $241,000 for
Parcel 125FEE in the lawsuit styled Collier COllllty v. Pascal ,I. Mllrray, el. aL, Case No. 07-
4784-CA (Santa Barhara Boulevard Extension Project #60091 (Fiscal Impact $44,471).
OBJECTIVE: That the Board of County Commissioners approve a Stipulated Final Judgment for
payment of full compensation including statutory interest, attorney fees, expert fees and costs for
the taking of Parcel No, 125FEE in the lawsuit styled Collier County v. Pascal J. Murray, et. ai.,
Case No. 07-4784-CA (Santa Barbara Boulevard Extension Project #60091). (See attached
Stipulated Final Judgment)
CONSIDERATIONS: Collier County acquired by condcmnation 1.01 acre parcel described as
Parcel No. 125FEE, for construction of a roadway, fhlln property owners Michael and Marie T.
Thompson. The County's initial offer in 2007 which included a settlement incentive was $232,300,
which was rejected. An Order or Taking was entered on March 7, 200R. and the County deposited
the sum of$207,300 in the Court Registry.

This acquisition was a partial take or the owners' larger residential parent tract which reduced the
remainder property to less than the allowahle minimum lot size in the "E" Estates zone. However,
Section 9.03.07 of the Collier County Lmd Development Code deems the reminder property to be a
legally nonconforming lotfllr which a singlc-fUmily residential structure is still allowable under this
zoning district. The County will allow an access driveway to the rcn1aindcr property along the
Cope Lane frontage upon application by the Thompsons. The issue in this case is severance
damages. Owner claims a higher damage resuiting in a value of full compensation of
approximately $275,500 excluding attorney fees, expert fees and costs. Note that two earlier reports
obtained by the County valued Parcel 125 at $2(7)00 on June 2lJ. 2007 and S207,300 on January
17, 2008.
The parties mediated the case on September .10, 200l) and the mediation was not successful. The
Board approved an Offer 0 l' Judgment li,r $241,40] on December I, 200lJ and ii,rwarded its Notice
of Serving OfTer of Judgment on same date. (See allachl'll Nutiec urSc/Ting Ojfi'r Judgment) The
Of Tel' of Judgment expired. The matter was then sct lill' tri:1I on October ]2.2010. Upon further
negotiations, the malter was settled prior to the Trial delte in the amount of $24] ,000 Illr
compensation and $10,771 Illr attorney', fces and expert rees and costs. The settlement far
compensation was below the $275.500 the Respondents requested at mcdiation and below the
$24 I ,401 OtTer of Judgment.
Given the above, staff recommends settlement in the amount of $241,000
$10,771 lar attorney's fCes and expert fces and costs.

and recordcd in Official Rccord Book 4308, Page 1793, of the Public Records of Collier County,

concerning Parcel Number ] 25FEE, Illr 011] cOlnpctlsation, includillg scverance damages,
busillcss damages, costs to cure, together with the value of the taking, statutory interest and any
other claims of Respondents arising out of the taking of Parcel .125FEE for the sum of
$241,401.00, which includes the amount of $207,300.00 deposited pursuant to thc Order of
Taking dated March 7, 2008. This Offer ofJudgmcnt is subject to apportionment, if any.
There are no nOlH1l01letary terms or other relevant conditions to this offer except that this
oiTer does include illterest Ih)]J1 the dale of the Order of Taking but does not include at(omey's
fees and eosts.

The construction plans and specifications for the project on which the otTer is based have
been previously lUld continue to be available for the Respondent's review upon reasonable notice
