Pascal ,I. Mllrray, el. aL, Case No. 07- 4784-CA (Santa Barhara Boulevard Extension Project #60091 (Fiscal Impact $44,471). OBJECTIVE: That the Board of County Commissioners approve a Stipulated Final Judgment for payment of full compensation including statutory interest, attorney fees, expert fees and costs for the taking of Parcel No, 125FEE in the lawsuit styled Collier County v. Pascal J. Murray, et. ai., Case No. 07-4784-CA (Santa Barbara Boulevard Extension Project #60091). (See attached Stipulated Final Judgment) CONSIDERATIONS: Collier County acquired by condcmnation 1.01 acre parcel described as Parcel No. 125FEE, for construction of a roadway, fhlln property owners Michael and Marie T. Thompson. The County's initial offer in 2007 which included a settlement incentive was $232,300, which was rejected. An Order or Taking was entered on March 7, 200R. and the County deposited the sum of$207,300 in the Court Registry. ~ This acquisition was a partial take or the owners' larger residential parent tract which reduced the remainder property to less than the allowahle minimum lot size in the "E" Estates zone. However, Section 9.03.07 of the Collier County Lmd Development Code deems the reminder property to be a legally nonconforming lotfllr which a singlc-fUmily residential structure is still allowable under this zoning district. The County will allow an access driveway to the rcn1aindcr property along the Cope Lane frontage upon application by the Thompsons. The issue in this case is severance damages. Owner claims a higher damage resuiting in a value of full compensation of approximately $275,500 excluding attorney fees, expert fees and costs. Note that two earlier reports obtained by the County valued Parcel 125 at $2(7)00 on June 2lJ. 2007 and S207,300 on January 17, 2008. The parties mediated the case on September .10, 200l) and the mediation was not successful.
