EXECUTIVE SUMMARY
Recommendation to grant final approval of the roadway and drainage
improvements for the final plat of City Gate Commerce Center, Phase One
with the roadway and drainage improvements within "Tract R-2" being
privately maintained, and "Tract R-1" being maintained by Collier County
and authorizing the release of the maintenance security.
OBJECTIVE:
To grant final approval of the infrastructure improvements associated with that
subdivision known as City Gate Commerce Center, Phase One,
CONSIDERATIONS:
1. On September 14, 2006, the Land Development Services Department
granted preliminary acceptance of the roadway and drainage
improvements in City Gate Commerce Center, Phase One.
2. The roadway and drainage improvements will be maintained by the
project's master property owners' association.
3. The required improvements have been constructed in accordance with the
Land Development Code. The Land Development Services Department
has inspected the improvements and is recommending final acceptance of
the improvements.
4. A resolution for final acceptance has been prepared and approved by the
County Attorney's Office. A copy of the document is attached.
5. This PUD has been found to be in substantial compliance.
FISCAL IMPACT:
The roadway and drainage improvements will be maintained by the project's
homeowners association, The existing security in the amountpf $23,087.86 will
be released upon Board approval. The original security ih the amount of
$1,880,796.17 has been reduced to the current amount of $23,087.86 based on
the previous work performed and completed. Maintenance for the County portion
of City Gate Commerce Center, Phase One will come from the Transportation
Services Operations and Maintenance budget.
GROWTH MANAGEMENT IMPACT: There is no growth management impact.

LEGAL CONSIDERATIONS:
The County Attorney's Office has reviewed and approved the Resolution for legal
sufficiency. This item is ready for Board consideration and approval. STW
RECOMMENDATION:
Grant final acceptance of the roadway and drainage improvements in City Gate
Commerce Center, Phase One and release the maintenance security.
1. Authorize the Chairman to execute the attached resolution authorizing
final acceptance.
2. Authorize the release of the maintenance security.

WHEREAS, the Developer has constructed and maintained' the roadway and
drainage improvements in accordance with the approved plans and specifications as
required by the Land Development Code (Collier County Ordinance No, 04-41, as
amcnded); and
WHEREAS. the Developer is requesting linal acceptancc of the roadway and
drainage improvcments and release of his maintenance security; and
WHEREAS, the Land Devclopmcnt Scrvices Department has inspected the
roadway and drainage irnpro\'elllcllls, and is recommending acceptance of said facilities,
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMJSSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance is hereby
granted ror those roadway and drainage improvements in City Gate Commerce Center,
Phase One. pursuant to the plat thereof recorded in Plat Book 41, pages 6 througl, 7, and
the Clerk is hereby authorizcd to rei case the maintenance security.

1312 IT FURTHER RESOLVED AND ORDERED that the roadway and drainage
improvements within Tract "R-2" (City Gate Boulevard North & portion of White Lake
Boulevard as indieated on the recorded plat) will be maintained privately, and will not be
the responsibility of Collier County, The roadway and drainage improvements within
Tract "R-]" (portion of Whitc Lake Boulevard as indicated on the recorded plat) will be
maintained by Collier COllnty as Public road right-of-way.
This Resolution adopted after motion, seeond and majority vote favoring same,
this day of ___,2010.
