CONSIDERATIONS: On December 2, 2008, the Board of County Commi~oners approved
Resolution No. 2008-353 authorizing the co~n of land and easements necessary for the
construction of roadway, drainage and utiIity easements required for the expansion of Collier
Boulevard from Green Boulevard to Golden Gate Boulevard. After originally offering the owner
$48,060, the County ~Parce1s 158FEE and 158TCE by depositing the smn of $92,390 into
the registry of the courtlbllowin& the Order ofT~ on October 19,2010. Through negotiations,
the County and ResponcI.eJJt.; Haitian Bethesda Bat*t Church, Inc., have negotiated a settlement of
$125,000 for full compeusation plus attorney's fees and costs. The disparity between the original
offer and the settlement figure stems from the ~'s consultants being unable to locate the exact
location of the drainfield at the time of the original offer and being under the initial impression that
the existing drainfield could remain in place. It was subsequently proven to Co1B1ty staff that the
existing drainfield would not meet Health Department setbacks from the . ,
1re.llfmP.nt swale being constructed along Collier Boulevard. The septic field has to ' .
rear of the building with a cQst to cure of$77,400. This $77,400, when added to the
$48,060, results in the current' settlement of S 125,000. If the settlement is appnwed'"N

THIS CAUSE having come before the Court upon Joint Motion made by Petitioner,
COLLIER COUNTY, FLORIDA, by and through the undersigned counsel, and Respondent,
HAITIAN BETHESDA BAPTIST CHURCH, INC., by and through its undersigned counsel for
entry of a Stipulated Final Judgment as to Parcels 158FEE and 158TCE, and it appearing to the
Court that the parties are authorized to make such motion, the Court fmding that the compensation
to be paid by Petitioner, COLLIER COUNTY, FLORIDA, is the full compensation due
Respondent, HAITIAN BETHESDA BAPTIST CHURCH, INC., and the Court being otherwise
fully advised in the premises thereof, it is thereupon,
ORDERED AND ADJUDGED that Respondent, HAITIAN BETHESDA BAPTIST
CHURCH, INC., have and recover from Petitioner, COLLIER COUNTY, FLORIDA, the sum of
One Hundred Twenty-Five Thousand Dollars and No/lOO ($125,000.00) as full payment for the
. property interests taken and for damages resulting to the remainder, if less than the entire property
was taken, business damages, and for all other damages in connection with said parcels; it is further

73.092, F.S.; it is further
ORDERED that Respondent, HAITIAN BETHESDA BAPTIST CHURCH, INC., receive
from Petitioner, COLLIER COUNTY, FLORIDA, the sum of Twenty-Five Thousand Nine
Hundred Forty-Six Dollars and No/tOO ($25,946.00) for expert fees and costs incurred in the
defense of this case; it is further
ORDERED that except as provided herein, no additional fees or costs shall be awarded to
Respondent; it is further
ORDERED that Petitioner, COLLIER COUNTY, FLORIDA, has previously deposited the

amount of Ninety-Two Thousand Three Hundred Ninety Dollars and No/tOO ($92,390.00) into .
the registry of the Clerk of the Circuit Court toward the acquisition of Parcels 158FEE and 158TCE
at which time title to said parcels as described in Exhibit "A" vested in the name of Petitioner; it is
further
ORDERED that Petitioner, COLLIER COUNTY, FLORIDA, shall deposit an additional
Thirty-Two Thousand Six Hundred Ten Dollars and No/tOO ($32,610.00) into the registry of the
Circuit Court subject to approval of the Board of County Commissioners within thirty (30) days of
the date of this Stipulated Final Judgment; it is further
ORDERED that the Court reserves jurisdiction to apportion and disburse the award of One
Hundred Twenty-Five Thousand Dollars and No/I00 ($125,000.00) referred to above; it is

BELLA Y. PATEL TRUST ACCOUNT, c/o Bella Y. Patel, Esquire, 13026 Waterford Run Drive,
Riverview, Florida 33569 for the payment of expert fees and costs; it is further
ORDERED that within thirty (30) days of receipt by Petitioner of the Stipulated Final
Judgment entered by the Court, Petitioner, COLLIER COUNTY, FLORIDA, shall disburse the total
amount of Twenty-Five Thousand Three Hundred Ninety Dollars and No/tOO ($25,390.00) to
BELLA Y. PATEL, ESQUIRE, 13026 Waterford Run Drive, Riverview, Florida 33569 for
statutory attorney's fees; it is further
ORDERED that title to Parcel 1 58FEE, a Fee Simple Interest, and Parcel 158TCE, a
Temporary Construction Easement, being fully described in Exhibit "A" attached hereto and
incorporated herein, which vested in Petitioner, COLLIER COUNTY, FLORIDA, pursuant to the
Order of Taking dated October 19, 2010, and the deposit of money heretofore made, is approved,
ratified, and confirmed; it is further
ORDERED that this Court reserves jurisdiction to enforce the terms of this Stipulated Final
Judgment; it is further
ORDERED that this Stipulated Final Judgment is subject to approval by the Board of
County Commissioners of Collier County, Florida; it is further
ORDERED that the Notice of Lis Pendens filed in this action and recorded in Official
Record Book 4559, Page 1177, et seq., of the Public Records of Collier County, Florida be
dismissed as to Parcels 158FEE and 158TCE; it is further
