EXECUTIVE SUMMARY
Pursuant to Florida Statute 318.18(13)(b) the Clerk of the Circuit Court is required
to file the amount of traffic infraction surcharges collected under Florida Statute
318.18(13)(a)(1) with the Board of County Commissioners.
OBJECTIVE: To meet the filing requirement established by Florida Statute
318.18(13)(b) to file, on a quarterly basis, the amount of traffic infraction surcharges
collected under Florida Statute 318.18(13).
CONSIDERATIONS: The Board of County Commissioners adopted Ordinance 2004-
43, pursuant to Section 318.18, Florida Statutes, establishing a $15.00 surcharge for
traffic infractions. The surcharge was established to fund state court facilities. During
the 2009 legislative Session the Legislature amended Section 318.18(13) increasing the
maximum surcharge to $30.00. On July 28, 2009 the Board of County Commissioners
amended Ordinance 2004 -43, by adopting Ordinance 2009 -41, which increased the traffic
infraction surcharge from $15.00 to $30.00. Section 318.18 was further amended to
require the Clerk of Courts to submit a report of revenues collected under this statute with
the Board of County Commissioners in a format developed by the Office of the State
Courts Administrator. The required submission is attached to this executive summary.
The statutes also require that the report be provided to the chief judge of the circuit, the
Governor, the President of the Senate and the Speaker of the House of Representatives.
GROWTH MANAGEMENT IMPACT: None.
FISCAL IMPACT: None.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the
County Attorney's Office and is legally sufficient for Board action —SRT.
RECOMMENDATION: That the Board of County Commissioners accepts the
submission of the required quarterly traffic infraction surcharge report.
