Agenda 10/26/2010 Item #16B 3Agenda Item No. 1663 October 26, 2010 Page 1 of 24 EXECUTIVE SUMMARY Recommendation for the Community Redevelopment Agency (CRA) to approve and execute a Site Improvement Grant Agreement between the CRA and a Grant Applicant within the Bayshore Gateway Triangle area. (2741 Riverview Drive, $8,000) OBJECTIVE: To approve and execute a Site Improvement Grant Agreement between the Community Redevelopment Agency (CRA) and a Grant Applicant within the Bayshore Gateway Triangle Community Redevelopment area. (2741 Bayview Drive, $8,000) CONSIDERATIONS: The Site Improvement Grant Program (SIG) is a redevelopment initiative funded and administered by the CRA as partial reimbursement for exterior improvements to buildings for residents and non - profit organizations within the Redevelopment Area. The CRA provides a project cost -match of 33% from Tax Increment Funds capped at $8,000 for exterior improvements. Remaining project dollars are provided by the applicant. The CRA's Site Improvement Grant Program is funded annually at a level that satisfies existing grant obligations from prior fiscal years and funds future grant opportunities. For FY11, a total of $151,000 is budgeted for all grant programs. From this allocation, zero dollars are committed to date. The Site Improvement Grant application (Exhibit A) submitted by Richard and Michele Jarvis, The Trustees of the Richard and Michele Jarvis Family Trust, owners of the residential property at 2741 Bayview Drive, Naples Florida, 34112, was recommended for approval by the Bayshore /Gateway Triangle CRA Local Advisory Board. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office and is legally sufficient for Board consideration and approval. STW FISCAL IMPACT: Sufficient budget exists within Fund (187) FY11 budget to satisfy this application. This project totals $29,297, and the request is for up to $8,000 for exterior projects (with a 73% grantee match); for a total fiscal CRA impact of $8,000. GROWTH MANAGEMENT IMPACT: None. RECOMMENDATION: That the CRA Board approves and authorizes the Chairman to execute the Site Improvement Grant Agreement between the Community Redevelopment Agency and Richard and Michele Jarvis, The Trustees of the Richard and Michele Jarvis Family Trust, owners of the property at 2741 Bayview Drive, Naples Florida, 34112 in the amount of $8,000.00. JARVIS, hereinafter referred to as Trustees, of this trust known as THE RICHARD AND MICHELE JARVIS FAMILY TRUST. Trustors or any other person or persons may by instrument in writing, by will, or by naming the Trustee as beneficiary of life insurance or employee benefit plan proceeds, deliver to the Trustee at any time and from time to time additional assets and properties acceptable to the Trustee, which additional assets and properties shall be held, administered, and distributed pursuant to this agreement. No gift, change or transfer of community property or separate property interests is intended by the terms of this trust during the joint lives of Trustors. Investment or income - producing assets and property added to this trust during the joint lives of Trustors, and the income therefrom, shall be considered as community property of the Trustee unless when delivered said property is designated in writing to be the separate property of the Tmstors. The Trustee shall maintain records and accounts to appropriately identify such property, with all income being designated and identified as to community property of Trustors; provided, however, that the Trustee shall have no duty to characterize property of the trust as community or separate property and shall have the right to rely on representations of Trustors, or either of them, as to such property's character. Any property subsequently withdrawn from the trust estate shall have the same character as community or separate property which it would have had if it had never become Part of the trust estate. Grantee acknowledges to the CRA that Grantee has received a copy of the Collier County Community Redevelopment Agency Site Improvement Grant Program Information and Application (hereinafter referred to as "Grant Program "), that Grantee has read the Grant Program, and that Grantee has had ample opportunity to discuss the Grant Program with Grantee's counsel or advisor. Grantee further acknowledges to the CRA that Grantee understands and agrees to abide by all of the terms and conditions of the Grant Program. 2. Grantee has agreed to make certain improvements to the property pursuant to the CY grant application submitted to the CRA dated "! , 1, PO attached hereto as Exhibit A and incorporated herein by reference. 4. Grantee is prohibited from paying contractors and /or vendors with cash; all payments for approved projects must be in the form of a check or credit card drawing on funds from Grantee's accounts. CRA has approved a grant to Grantee in the amount of $ Br COO to be administered pursuant to the terms of this Agreement based on an estimated cost of $,2171Z-,,7 . If the actual costs are less than the estimated costs to construct the site improvements and less than $24,000, the grant amount shall be reduced dollar for dollar in matching CRA funds as determined by ratio of matching private funds required. 6. Unless prior disclosure is included in the grant application, no Grantee, or any immediate relative of Grantee, shall serve as a contractor or subcontractor for the construction of the Site Improvements and no Grantee, or any immediate relative of Grantee, shall receive compensation for labor for the construction of the site improvements. An immediate relative of Grantee shall include mother, father, brother, sister, son, daughter, aunt, uncle and cousin or family member by marriage to include mother -in -law, father -in -law, brother -in -law and sister -in- law. Grantee has verified that all contractors who have provided bids for the approved work are actively licensed by Collier County. Grantee acknowledges that the total grant award shall not exceed the sum of lowest bids /price quotes for all projects. Grant funds for work performed by contractors shall only be disbursed upon verification that said contractors are actively licensed by Collier County. 7. Grantee agrees to obtain all necessary permits and submit any required plans to the County's Growth Management Division. Upon completion of the work, Grantee shall submit to the CRA staff a project summary report, two (2) 8 inch by 10 inch photos of the project after improvements are. completed, a list of materials and construction techniques used, a list of architects and/or contractors, and any other information specific to the project or requested by the CRA staff. The CRA, through its staff, shall confirm that the site improvements were constructed pursuant to the terms of the application approved by the CRA. 8. Within forty -five (45) days after confirmation that the site improvements were constructed pursuant to the terms of the approved application; Grantee shall be issued a check in the amount of the grant. However, if Grantee fails to make the improvements pursuant to the terms of the approved application, or if the project is not completed within one (1) year of CRA approval, or if Grantee fails to fund at least 67% of the cost of the Site Improvements, the grant shall be deemed automatically revoked and Grantee shall be entitled to no funding. 9. This Agreement shall be governed and construed pursuant to the laws of the State of Florida. 10. This Agreement contains the entire agreement of the parties and their representatives and agents, and incorporates all prior understandings, whether oral or written. No change, modification or amendment, or any representation, promise or condition, or any waiver, to this Agreement shall be binding unless in writing and signed by a duly authorized officer of the party to be charged. 11.
