Agenda 10/26/2010 Item #16A 9Agenda Item No. 16A9 October 26, 2010 Page 1 of 14 EXECUTIVE SUMMARY Recommendation to enter into a Landscape Maintenance Agreement with the Kings Lake Homeowners Association to allow the Association to perform maintenance along Kings Lake Boulevard and other landscaped areas that may be within the County right of ways within the HOA's jurisdiction and that the Board of County Commissioners waive the Right of Way Permitting fee in the amount of $2,000. OBJECTIVE: To obtain approval from the Board of County Commissioners to allow its Chairman to sign a Landscape Maintenance Agreement with the Kings Lakes Home Owners Association for the maintenance of the median islands along Kings Lake Boulevard and all other landscaped areas within the HOA jurisdiction that may be within the County right of ways. In addition, staff recommends that the Board of County Commissions waive the Right of Way Permitting fee in the amount of $2,000. CONSIDERATIONS: For the past 26 years the Kings Lake Home Owners Association has maintained the landscaped medians along Kings Lake Boulevard and street cul -de -sacs without incident. Due to recent work performed in the median, Right of Way permitting staff discovered that no permit or maintenance agreement had been entered into with Collier County. FISCAL IMPACT: Waiving the one time permitting fee will result in a fiscal impact of $2,000.00 and recording fees associated with this agreement. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office and is legally sufficient for Board action. A copy of a draft Landscape Maintenance Agreement is attached which the Association will be required to execute along with the submission of its landscape maintenance plans. —SRT GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact associated with this Executive Summary. RECOMMENDATION: That the Board of County Commissioners waives the Right Of Way permit fee in the amount of $2,000.00 due to the longevity of the Kings Lake Homeowner Association's maintaining the medians and cul -de -sac's in an exemplary manner without an agreement or ROW permit on record. Further, that the Board authorize its Chairman to execute a standard Landscape Maintenance Agreement to govern future maintenance activities conducted by the Homeowner Association within County right of way. Records of all specification requirements shall be kept and made available to the County's representative upon request. A. MOWING AND EDGING: Mowing and edging shall include medians as well as thos '` ,eas, if existing, along the outside edge of the sidewalks of adjacent properties.
