Agenda 09/14/2010 Item #16D17 Agenda Item No. 16017 September 14, 2010 Page 1 of 7 EXECUTIVE SUMMARY Recommendation to approve and authorize the Chairman to sign an amendment to the Habitat for Humanity of Collier County Acquisition-Rehabilitation-Resale Sub recipient Agreement approved on September 15, 2009 (Item 16D3) for $460,000. This amendment will allow for a revision of the Agreement's Exhibit A to reflect the following language change; Acquisition-Rehabilitation-Resale to state only Acquisition, the amendment will also allow for a three month extension through October 31, 2010. OBJECTIVE: To approve and authorize the Chairman to sign an amendment to the Habitat for Humanity of Collier County Acquisition-Rehabilitation-Resale Subrecipient Agreement approved on September 15, 2009 (Item 16D3) for $460,000. This amendment will allow for a revision of the Agreement's Exhibit A to reflect the following language change; Acquisition-Rehabilitation-Resale to state only Acquisition, the amendment will also allow for a three month extension through October 31, 2010. CONSIDERATIONS: On April 28, 2009, the Board adopted Resolution No. 2009-116 approving the 2009-2010 Action Plan (Item 16D3), and authorized its submission to the U.S. Department of Housing and Urban Development (HUD). The Habitat for Humanity of Collier COWlty Acquisition-Rehabilitation-Resale Project was included as one of the activities outlined in the Action Plan submission. On August 14, 2009, HUD provided the FY 2009-2010 entitlement funding letter and agreement to the County in the amount of $3,198,282. The Board of County Commissioners approved receipt of the entitlement funds on September 15, 2009 (Item 16D20), and approved the subrecipient agreement template and the subrecipient agreement with Habitat for Humanity of Collier COWlty on the same day (Item 16D9). Habitat for Humanity was able to acquire eight properties and expend the funding on one activity. Because the funds were spent on acquisition and the agreement permitted the use of funds for acquisition, rehabilitation OR resale, the Clerk's Office has suggested removal of the sections in the scope related to rehabilitation or resale via this amendment to allow the payment to be processed. In summary, the proposed amendment: 1. Removes the terms "Rehabilitation" and "Resale" from the Agreement. 2. Allows for three month extension through October 31, 2010. 3. Updates the department name to Housing, Human, and Veteran Services (HHVS). 4. Requires that HHVS will ensure that CDBG grant requirements are in place. FISCAL IMPACT: No general funds are associated with this amendment. Expenditures for the CDBG project associated with this amendment have already been budgeted in CDBG Grant Fund (121) for FY09. GROWTH MANAGEMENT IMPACT: The project associated with this amendment is consistent with the Growth Management Plan. Statement of Understanding RE: Contract # B-09-UC-12-0016 #14.218 "Habitat for Humanity of Collier County, CDBG- Acquisition Rehabilitatisa Resale" In order to continue the services provided for in the original Contract document referenced above, the Sub- Recipient agrees to amend the Contract as follows: II. SCOPE OF SERVICES . The SUBRECIPIENT shall, in a satisfactory and proper manner, as determined by HIlS HHVS (formerly HHS), perform the tasks necessary to conduct the program outlined in Exhibit "A." III. TIME OF PERFORMANCE The effective date of the Agreement between HUD and Collier County shall be July 1,2009. Subrecipients are authorized to incur eligible expenses after that date and prior to execution of this Agreement subject to HH8 HHVS (formerly HHS) prior written approval. The services of the SUBRECIPIENT shall be undertaken and completed in light of the purposes of this Agreement. The Department of Housing and Urban Development's (BUD) National Objectives: 1. Benefiting Low- and Moderate- Income Persons 2. HUD defines the term 'low- and moderate income persons' as families and individuals whose incomes are no more than 80 percent of the median income of the area involved. 3. Your project must serve LMI clients. 4. Eight (8) units of Low-and Moderate-Income housing must be completed and sold to qualified LMI clients. 5. Habitat staff will manage the entire homeowner selection process, qualifying the homeowners, and verifying that they fall at or below 80% of Median Family Income or (MFI). 6. HHVS will monitor this proJect until reaching full occupancy.
