EXECUTIVE SUMMARY
Recommendation to waive interest and authorize the Chairman to sign a
satisfaction of civil judgment entered against Angel and Blanca Carrasco, relating
to litter violations at 1801 55th Terrace SW, Collier County, Florida.
OBJECTIVE: To have the Board of County Commissioners (Board) waive accumulated
interest and authorize the Chairman to sign a satisfaction of judgment relating to
property located at 1801 55th Terrace SW in the County Court action entitled Collier
County vs. Angel and Blanca Carrasco (County Court case no. 00-9766-COA).
CONSIDERATIONS: On December 23, 2002, a civil judgment in the amount of $500
was entered in favor of Collier County, against Angel and Blanca Carrasco. The
judgment was recorded in the official public records (see Attached Exhibit A). The
judgment provided for assessment of interest at the rate of 9% per year. In June 2010,
a title company (Ticor Title Insurance Co.) representing the owner that took title via
foreclosure sale (Ralph P. Frengel Trust) approached the Clerk of Court to pay the civil
judgment. The Clerk provided them with an amount due of $500, and the title company
(in good faith) paid this amount and received a receipt indicating that the judgment was
paid in full (see attached Exhibit B). The case docket was updated to "fully paid" (see
attached Exhibit C). However, due to a clerical error, the Clerk did not charge 9%
interest, which had grown to approximately $336.

After paying the $500 principal and obtaining proof of payment, the title company
contacted the County (Code Enforcement Department and County Attorney's Office) to
obtain a satisfaction of judgment. Because issuance of satisfaction of judgment
involves formal waiver of the right to $336 in accrued interest, Board approval is
necessary for the satisfaction of judgment.
FISCAL IMPACT: On June 21, 2010, the date of the $500 payment, accrued interest
had reached $336, calculated at 9% interest for approximately 7.48 years. Approval of
this item will result in formal waiver of any right to collect $336 in accrued interest.
GROWTH MANAGEMENT IMPACT: There is no growth management impact
associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item is legally sufficient for Board action. -JW
RECOMMENDATION: That the Board of County Commissioners (Board) waive $336
in accrued interest, and authorize the Chairman to sign a satisfaction of judgment as
described herein.

RELEASE AND SATISFACTION OF CIVIL JUDGMENT
KNOW ALL MEN BY THESE PRESENTS: That the BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA is the owner and holder of a
certain Civil Judgment against:
Angel K. Carrasco and Blanca Carrasco, Defendants
The Civil Judgment was recorded on August 24, 2002, in Official Records Book 3184,
Page 0952. The judgment secures the principal sum of five hundred dollars and zero
cents, plus interest at the rate of 9% per year.
Collier County, a political subdivision of the State of Florida, by execution of this Release
and Satisfaction of Civil Judgment, acknowledges full satisfaction of the jUdgment and
hereby cancels and releases said jUdgment
The Clerk of the Circuit Court is hereby directed to record this Release and Satisfaction of
Civil Judgment in the Official Records of Collier County, Florida, to acknowledge that the
judgment and any lien created thereby ceases to exist.
