Agenda 10/12/2010 Item #16A 6 EXECUTIVE SUMMARY Agenda Item No. 16A6 October 12, 2010 Page 1 of 9 Recommendation to adopt a resolution requesting that the Florida Department of Transportation quitclaim to Collier County certain right-of-way situated in the southeast quadrant of the Immokalee Road and Interstate 1-75 interchange and declaring that the right-of-way is to be used for public purpose only. (Project No. 60109.) Estimated fiscal impact: $35,50, OBJECTIVE: To adopt a resolution requesting that the Florida Department of Transportation ("FDOT") quitclaim to Collier County certain right-of-way situated in the southeast quadrant of the lmmokalee Road and Interstate 1-75 interchange and declaring that the right-of-way is to be used for public purpose only. CONSIDERATIONS: Pursuant to Resolution No. 2006-42, adopted by the Board of County Commissioners on February 28th, 2006, County conveyed certain lands to FOOT for the aInount of$10.00. These lands included certain right-of-way ("the FDOT surplus right-of-way") situated in the southeast quadrant of the Immokalee Road and Interstate 1-75 interchange, more fully described in Exhibit "A" attached to the proposed resolution, and were required by FDOT for the construction of on and off ramps at this interchange. Subsequently the ramps were redesigned, resulting in the right-of-way footprint being reduced and the FDOT surplus right-of-way no longer being required for the project. Construction of the project has been completed and FDOT now wishes to convey this surplus right-of-way back to County via quitclaim deed. Before the FDOT surplus right-of-way can be conveyed back to County, a request must be made by formal resolution of the Board. The resolution must also declare that this right-of-way is to be used for public purpose only. Staff recommends adoption of the proposed resolution. The FDOT surplus right-of-way - will be a valuable asset for the County and can possihly be used in the future for a Park and Ride facility. FISCAL IMP ACT: FOOT will not be seeking compensation from County for transfer of legal title to the right-of-way. Therefore, the only fiscal impact will be the recording costs of a Quitclaim Deed from FDOT, which should not exceed $35.50. Source of funds is Gas Tax Fund 313, Project No. 60109. GROWTH MANAGEMENT IMPACT: This recommendation is consistent with the County's Growth Management Plan. LEGAL CONSIDERATIONS: This item has hecn reviewed by the County Attorney and is legally sufficient for Board approval. -JAK RECOMMENDATION: That the Board of County Commissioners of Collier County, Florida: I. Adopt the attached Resolution; 2. Authorize its ChaiI1TIan to execute the attached Resolution on behalf of the Board; 3. Accept the conveyance of the FDOT surplus right-of-way from the Florida Department of Transportation via quitclaim deed and authorize the County Manager or his designee to record SaIne in the public records of Collier County, Florida; 4. Authorize the payment of all costs and expenses necessary to close foresaid transaction; and 5. WHEREAS, in accordance with provisions of Section 335.0415, Florida Statutes, the State of Florida Department of Transportation (hereinafter referred to as "FDOT") has the authority to transfer jurisdiction of roads and rights-of-way from the State Highway System to local governmental entities, provided there is mutual approval of the transfer by FDOT and the affected local government entity; and WHEREAS, FDOT currently has title to certain right-of-way situated in the southeast quadrant of the ImmokaJee Road and Interstate 1-75 interchange, more fully described in Exhibit "A", attached hereto and incorporated herein (hereinafter referred to as "the right-of-way"); and WHEREAS, Collier County desires for FDOT to transfer jurisdiction of the right-of-way from the State Highway System to the jurisdiction of Collier County; and WHEREAS, the Collier County Board of County Commissioners has determined that it is in the best interest of the citizens of Collier County for the County to accept title to the right- of-way and the jurisdiction therefor; and WHEREAS, the right-of-way is to be conveyed for public purpose use only.
