McLean, P.E. of Agnoli, Barber and Brundage, Inc., is requesting a Conditional Use to expand the existing provisional use as a church to allow a school in the Residential Single- Family (RSF -3) Zoning District, with an ST/W -4 Special Treatment Overlay pursuant to Land Development Code (LDC) Subsection 2.03.02 A.l.e.3. The proposed new Conditional Use will permit expansion of an existing church and school by adding a new 7,200 square -foot building to be used primarily as a school. The 4.01f acre site is located at 4300 20 Street S.W. in Golden Gate, Unit 2, Block 30, Plat Book 5, Page 68, in Section 22, Township 49 South, Range 26 East, Collier County, Florida. OBJECTIVE: To have the Board of County Commissioners (BCC) consider an application for Conditional Use in the Residential Single- Family (RSF -3) Zoning District for an expansion of a church and a school, as specified in Section 2.03.02 AA.c.3 of the Collier County Land Development Code (LDC); and to insure that the community's interests are maintained. CONSIDERATIONS: On January 9, 1968, a provisional use was approved for the subject property under Petition R- 175 -C, to allow a Church within a RSF -3 zoning district. The Church use is still an allowable use and there is a ministry food pantry that is an accessory use to the Church. School uses that have taken place since .tune 2004 include educational classes for the community such as early childhood /parenting, after school tutoring programs, summer school day camp, and adult ESOL (English Speakers of Other Languages) classes. The applicant is seeking a Conditional Use for these additional private school and child day care uses. The Conceptual Site Plan (see Collier County Planning Commission Staff Report) dated March 2010, depicts the proposed 7,200 square -foot building, playground, courtyard, water management areas and 6 -foot height wall and /or fence along the southern property boundary along with the existing 4,700 and 3,200 square -foot buildings and playground. The Conceptual Site Plan also depicts a 15 -foot wide Type B landscape buffer along the south property boundary, and a 10 -foot wide Type D landscape buffer along the street right -of -way boundaries. Site ingress /egress is depicted from two access points on 21" Avenue S.W. Water and sewer service is provided by the Florida Governmental Utility Authority. FISCAL IMPACT: Approval of the Conditional Use, in and of itself, would have no fiscal impact on Collier County. There is no guarantee that the project, at build out, would maximize its authorized level of development, however, if the use were approved, a portion of the existing land would be CU- PL2010 -277, GRACE PLACE July 12, 2010 Page 1 of 3 Agenda Item No. 17E July 27, 2010 Page 2 of 92 developed and the new development would result in an impact on Collier County public facilities. The County collects impact fees prior to the issuance of building permits to help offset the impacts of each new development on public facilities. These impact fees are used to fund projects identified in the Capital Improvement Element of the Growth Management Plan as needed to maintain adopted Level of Service (LOS) for public facilities. Additionally, in order to meet the requirements of concurrency management, the developer of every local development order approved by Collier County is required to pay a portion of the estimated Transportation Impact Fees associated with the project in accordance with Chapter 74 of the Collier County Code of Laws and Ordinances. Other fees collected prior to issuance of a building permit include building pen-nit review fees. Please note that impact fees collected were not included in the criteria used by staff and the Planning Commission to analyze this petition. GROWTH MANAGEMENT PLAN (GMP) IMPACT: Future Land Use Element (FLUE): The subject property is identified on the Golden Gate Area Master Plan Future Land Use Map (GGAMP FLUM), within the Urban Mixed Use District, Urban Residential Sub district, and is currently zoned RSF -3. The Urban Mixed Use district is intended to accommodate a variety of residential and non- residential land uses, including Community Facilities such as churches and (private) schools. Transportation Element: Transportation Planning staff has reviewed the petitioner's Traffic Impact Statement (TIS) and has determined that the adjacent roadway network has sufficient capacity to accommodate this project within the 5 year planning period. Therefore, the subject application is consistent with Policy 5.1 of the Transportation Element of the Growth Management Plan (GMP). Mitigation is not required. Staff finds the requested conditional uses consistent with the Golden Gate Area Master Plan and Golden Gate Area Master Plan Future Land Use Map and Map Series, and the Future Land Use Element of the Growth Management Plan. (Please note that the complete GMP analysis is contained in the staff report.) ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATIOON: Pursuant to LDC Section 8.06.03 0.1 Powers and Duties, the EAC did not review this petition because the site is less than ten acres and is not in a Special Treatment (ST) area or an Area of Critical State Concern (ACSC). COLLIER COUNTY PLANNING COMMISSION (CCPC) RECOMMENDATION: The CCPC heard petition CU- PL2010 -277 .tune 17, 2010, and by a vote of 6 to 0 recommended to forward this petition to the Board of Zoning Appeals (BZA) with a recommendation of approval. Because the CCPC recommendation for approval was unanimous and no letters of objection have been received, this petition has been placed on the Summary Agenda. A conditional use is a use that is permitted in a particular zoning district subject to certain restrictions. Decisions regarding conditional uses are quasi - judicial. As such this item requires ex parte disclosure, and all testimony given must be under oath. The attached report and recommendations of the Planning Commission required are advisory only and are not binding on you. Petitioner has the burden of demonstrating that the necessary requirements have been met, and you may question Petitioner, or staff, to satisfy yourself that the necessary criteria has been satisfied. In addition to meeting the necessary criteria, you may place such conditions and safeguards as you deem appropriate to allow the use, provided that there is competent, substantial evidence that these additional conditions and safeguards are necessary to promote the public health, safety, welfare, morals, order, comfort, convenience, appearance, or the general welfare of the neighborhood. As a further condition of approval of the conditional use, you may require that suitable areas for streets, public rights -of -way, schools, parks, and other public facilities be set aside, improved, and /or dedicated for public use, subject to appropriate impact fee credits. Approval or denial of the petition is by Resolution, with approval of the conditional use requiring four affirmative votes of the Board (supermajority vote). The proposed Resolution was prepared by the County Attorney's Office and is legally sufficient for Board action. As long as the Church has been in existence, the church use is still considered an allowable use. The applicant is seeking accessory uses through the Conditional Use process. School uses that have taken place since June 2004 include uses such as educational classes for the community such as early childhood/parenting, after school tutoring programs, summer school day camp and adult English Speakers of Other Languages (ESOL) classes, require a Conditional Use as provided for in the currently zoned RSF -3 zoning district. CU- PL2010 -277, GRACE PLACE Page 5 of 10 Revised: 5 -26 -10 Agenda Item No. 17E July 27, 2010 Page 11 of 92 Depending on the operational characteristics for the food pantry, it is necessary for regular worship services to occur at the property for the ministry food pantry uses to be permitted at the property. The following address other policies contained with the Future Land Use Element. Each policy below is followed by staff analysis in bold print. Policy 7.1 "The County shall encourage developers and property owners to connect their properties to fronting collector and arterial roads, except where no such connection can be made without violating intersection spacing requirements of the Land Development Code." The project site does not abut an arterial or collector road, so may be found consistent with this policy. Policy 7.2 "The County shall encourage internal accesses or loop roads in an effort to help reduce vehicle congestion on nearby collector and arterial roads and minimize the need for traffic signals. "As depicted within the Application under item b. of the "Evaluation Criteria ", it states, "The proposed improvements include the expansion of parking and the creation of an internal driveway loop to increase onsite traffic control, flow and access," and may be found consistent with this policy. Policy 7.3 "All new and existing developments shall be encouraged to connect their local streets and their interconnection point with adjoining neighborhoods or other developments regardless of land use type. " The Conceptual Site Plan does not indicate access to pre - existing RMF -12 Multi - Family property located to the south of the subject site. That RMF -12 property is developed; interconnection is not feasible. Further, the property abuts 21' Avenue S.W. to the north, 43rd Terrace S.W. to the west and 42 "d Street S.W, to the east. Therefore this project may be found consistent with this policy. Policy 7.4 "The County shall encourage new developments to provide walkable communities with a blend of densities, common open spaces, civic facilities and a range of housing prices and types. " As required by County regulations, the Conceptual Site Plan indicates proposed sidewalks to be provided along the frontage of 21" Avenue S.W. and including frontage along 42 "d Street S.W.. The property being a non - residential use, the range of housing prices and types are not applicable. This project maybe found consistent with this policy. Based on the above analysis, staff finds the requested conditional uses consistent with the Golden Gate Area Master Plan and Golden Gate Area Master Plan Future Land Use Map and Map Series, and the Future Land Use Element of the Growth Management Plan. Transportation Element: Transportation Planning staff has reviewed the petitioner's Traffic Impact Statement (TIS) and has determined that the adjacent roadway network has sufficient capacity to accommodate this project within the 5 year planning period. Therefore, the subject application is consistent with Policy 5.1 of the Transportation Element of the Growth Management Plan (GMP). Mitigation is not required. CU- PL2010 -277, GRACE PLACE Page 6 of 10 Revised: 5 -26 -10 Agenda Item No. 17E July 27, 2010 Page 12 of 92 Golden Gate Parkway Impacts: The first concurrency link that is impacted by this project is Link 22, Golden Gate Parkway (CR -886), between Santa Barbara Boulevard and Collier Boulevard (CR -951). The project generates 2 new p.m. peak hour, peak direction trips, which represents a 0.10 percent impact. This segment of Golden Gate Parkway (CR -886) currently has a remaining capacity of 226 trips, and is currently at LOS "D" (Level of Service "D ") as reflected by the 2009 AUIR (Annual Urban Inventory Report). No subsequent links beyond this segment of Golden Gate Parkway are significantly impacted by this project. ANALYSIS: Before any Conditional Use recommendation can be offered to the Board of Zoning Appeals (BZA), the Collier County Planning Commission (CCPC) must make findings that: 1) approval of the Conditional Use will not adversely affect the public interest and will not adversely affect other property of uses in the same district of the neighborhood; and 2) all specific requirements for the individual Conditional Use will be met; and 3) satisfactory provisions have been made concerning the following matters, where applicable: 1. Section 2.03.02 A.l.c.3., of the LDC permits conditional uses in the Residential Single - family (RSF -3) zoning district. The requested use for a School is permitted as conditional uses in the Residential Single - family (RSF) zoning district, subject to the standards and procedures established in section 10.08.00, conditional uses procedures, of the LDC. 2. Consistency with the Land Development Code (LDC) and the Growth Management Plan (GMP). This request is consistent with the Growth Management Plan (GMP) and this project will be in compliance with the applicable provisions of the Land Development Code (LDC). 3. Ingress and egress to the property and proposed structures thereon, with particular reference to automotive and pedestrian safety and convenience, traffic flow and control, and access in case of fire or catastrophe. Existing ingress and egress to the subject property is provided by two points along 21' Avenue S.W. There is a proposed additional access point along 42nd Street S.W. for the provision of dumpster access. In addition, the petitioner has provided an internal driveway loop to increase the onsite traffic control, flow and access. The minimum parking requirements will be provided per the LDC at the time of SDP. The petitioner will also provide a sidewalk along their 21" Street S.W. and 42nd Street S.W. street frontages. The Fire Code official's office has no objection to the ingress /egress, and will review the Site Development Plan (SDP) upon its submission to ensure compliance with applicable fire codes. The affect the Conditional Use would have on neighboring properties in relation to noise, glare, economic or odor effects. If approved, the proposed expansion of an existing Church and school by adding a 7,200 square -foot school building to a site that has been in existence for over 30 years should have minimal impact on neighboring properties in relation to glare, economic or noise effects. This is because activities at the subject property are generally concentrated inside the church and school buildings. To mitigate for any noise or glare impacts to the existing and future neighbors, the applicant will provide a 15 -foot wide Type B along landscape buffer with a fence or a wall along the south property boundary. Along the street right -of -ways a 15 -foot wide Type D landscape buffer will be provided. 5. Compatibility with adjacent properties and other property in the district. This Church has been in existence for over 30 years and the school for over 5 years. The proposed school building will be set back 93.9 feet from the southern property line (the same setback as one of the existing structures) and 283.6 feet from the eastern property line. Also, the proposed building will not exceed 35 feet in height. Furthermore, the proposed addition of a new school building will be mitigated by the provision of the required landscape buffers. Impacts on surrounding neighbors would be minimized and compatibility with the surrounding properties insured, as required by Policy 5.4 of the FLUE. Based on the above findings, this conditional use is recommended for approval. In addition, two letters of support regarding this petition have been received from neighboring properties and they are attached to the end of this Staff Report, ENVIRONMENTAL ADVISORY COUNCIL (EAC) RECOMMENDATION• The EAC did not review this petition because the site is under the size threshold (10 acres) to require an Environmental Impact Statement. NEIGHBORHOOD INFORMATION MEETING (NM: Synopsis provided by Matthew McLean, P.E., Agnoli, Barber & Brundage, Inc. and edited by Nancy Gundlach, Collier County Principal Planner: The meeting was duly noticed by the applicant and held on April 22, 2010, at 6:15 p.m. at the Grace Place sanctuary, located at 4300 21" Avenue S.W., Naples, Florida. The meeting was attended by 16 people including the applicant's team and county staff. The applicant's attorney, Christopher J. Thornton, Esquire of Becker & Poliakoff, gave an overview of the past, current and proposed uses on the property. He explained that Grace Place is in the process of acquiring the property from the Methodist Church. During their due diligence, Grace Place, an organization which operates independently of the church, sought confirmation that they would be able to operate if the church uses were discontinued. CU- PL2010 -277, GRACE PLACE Page 8 of 10 Revised: 526 -10 Agenda Item No. 17E July 27, 2010 Page 14 of 92 Currently Grace Place has a maximum capacity of approximately 80 students. The future expansion goals proposed in the conditional use application include adding a 7,200 sq ft building to accommodate additional classrooms. With the expansion it is expected that the student capacity would double to around 160. The limiting factor for the student number is the amount of parking that can be accommodated onsite. The applicant, Reverend Stephanie Campbell of Grace Place for Children and Families, Inc., reiterated that Grace Place is a faith - based, nonprofit neighborhood center that teaches literacy, language and life skills to children and adults in the neighborhood. The applicant's project manager, Matt McLean, explained the existing and proposed project. An overview of the site improvements were discussed: - Sidewalks would be constructed around the entire site. - A storm water management system for rainwater will be constructed. Currently, there is no water management system on this site. - The access points on the property will remain. - An internal driveway loop is proposed so as to improve the dead end situation which currently exists. The meeting ended at approximately 6:30 p.m. COUNTY ATTORNEY OFFICE REVIEW: The County Attorney Office has reviewed the staff report for CU- PL2010 -277 revised on May 26, 2010. RECOMMENDATION: Staff recommends that the Collier County Planning Commission (CCPC) forward Petition CU- PL2010 -277 to the Board of Zoning Appeals (BZA) with a recommendation of approval subject to the following conditions: 1. The Conditional Use is limited to what is shown on the site plan, identified as "Grace Place — Conditional Use Master Concept Plan" prepared by Agnoli, Barber & Brundage, Inc., dated March 2010. The final design must be in compliance with all applicable federal, state and county laws and regulations. The Department of Land Development Services Director may approve minor changes in the location, siting, or height of buildings, structures, and improvements authorized by this conditional use, so long as these minor changes remain consistent with all applicable development standards. Applicant must conduct at least one Neighborhood Informational Meeting (NIM) after initial staff review and comment on the application and before the Public Hearing is scheduled with the Planning Commission. Written notice of the meeting shall be sent to all property owners who are required to receive legal notification from the County pursuant to Section 10.03.05.8.8. Notification shall also be sent to property owners, condominium and civic associations whose members are impacted by the proposed land use change and who have formally requested the County to be notified. So long as the Church has been in continuous use as a Church since the adoption of the original provisional use, it is allowed under the current zoning. The ministry food pantry, depending upon its operational characteristics, may be allowed as an accessory use to this permitted Church use if limited to the Church members and their guests only. Some of the uses that have taken place since 2004 such as child care and adult care centers, after school tutoring programs, summer day camp, and adult ESOL classes, require a Conditional Use as provided for in the RSF -3 zoning district. Is it necessary that regular worship services occur at the property for the Grace Place uses to be permitted at the property? Depending upon the operational characteristics of the ministry food pantry, it is necessary for regular worship services to occur at the property for the ministry food pantry uses to be permitted at the property. The other Grace Place uses (child care and adult care centers, after school tutoring programs, summer day camp, and adult ESOL classes) require a Conditional Use which can be operated independently from the Church use. What approvals, if any, are required,for the Grace Place uses to be allowed on the property? As previously stated, a Conditional Use approval would be required for most of the Grace Place uses to be allowed on the property. Can the Grace Place uses be approved at the property by conditional use without a rezone or comprehensive plan amendment? The Grace Place uses may be approved by obtaining a Conditional Use without a rezone or a Comprehensive Plan amendment. Are church or the Grace Place uses legal nonconforming uses on the property? So long as the Church has been in continuous use as a Church pursuant to the Provisional Use that was approved, it is deemed to be a conforming use on the property. Conversely, Grace Place is not a legally nonconforming use.
