Agenda 07/27/2010 Item # 9CAgenda Item No. 9C July 27, 2010 Page 1 of 5 EXECUTIVE SUMMARY Consider a request by Mayor Sammy Hamilton to discuss the possible acquisition of the Everglades Airpark by the City of Everglades City. OBJECTIVE: That the Board of County Commissioners reviews and discusses the practicality of transferring ownership and control of the Everglades Airpark to the City of Everglades City. CONSIDERATIONS: By way of discussions with Commissioner Coletta, Mayor Sammy Hamilton has expressed an interest in Everglades City acquiring the 52 +/- acre Everglades Airpark. (See attached letter) Mayor Hamilton will be presenting this concept and requesting the Board's consent for County staff to research and analyze the feasibility and practicality of transferring ownership and control of this airport. Preliminary research by the County Attorney Office indicates that the Airport property and operation of the Airport can be transferred by the Board to Everglades City. Our FAA representative has provided the following comments by e -mail: "At a minimum, Everglades City would have to sign certifications that obligate them in the same way that Collier County is obligated because of accepting grants and possibly because of surplus property conveyances (how the airport was originally deeded to the county.) Also, Everglades City would have to go through the local state process of becoming an airport sponsor before the airport could be transferred. After the state process, the City would have to go through the federal NPIAS process before the airpark could ever be conveyed." If conveyed, the County Attorney would recommend that the deed restricts the property to airport use, with the property reverting to the County should such use be terminated. FISCAL IMPACT: None at this time. GROW'T'H MANAGEMENT IMPACT: None at this time. LEGAL CONSIDERATIONS: The County Attorney will commence a detailed legal review of this matter upon appropriate Board direction. RECOMMENDATION: That the Board of County Commissioners considers the request by Mayor Sammy Hamilton relating to the possible acquisition of the Everglades Airpark by the City of Everglades City and directs staff accordingly.
