EXECUTIVE SUMMARY
Recommendation to approve a Bill of Sale to the City of Marco Island, Florida, for
the conveyance of the required water utility facilities for the Marco Island Library
Rose Hall Addition, at a cost not to exceed $30.
OBJECTIVE: Obtain approval from the Board of County Commissioners to convey a Bill of
Sale to the City of Marco Island, Florida to operate and maintain water utilities to the Marco
Island Library.
CONSIDERATIONS: On March 24, 2009, the Board approved the award of a Construction
Contract to Boran Craig Barber Engle Construction Inc. for the site work for construction of the
Marco Island Library Rose Hall Addition (Project 54004.1), The construction is now complete
and, prior to project closeout, the Bill of Sale must be processed to meet the requirements of the
City of Marco Island, '
The City of Marco Island is the water and wastewater utility service provider and will be
providing water and wastewater utility service to the Marco Island Library. As a condition to
providing this service, the potable water and fire line facilities constructed by the County and
running from the connection points at the backflow preventers/meters within the site property
boundary to the connection point at the property line must be transferred to the City of Marco
Island for servicing and maintenance of the transferred backflow preventers and meters.
FISCAL IMPACT: Funds in the amount of $30.00 for recording of the Bill of Sale are available
in the project budget 54004.1.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan
related to this action.
LEGAL CONSIDERATION: This item has been reviewed and approved by the County
Attorney's Office and is legally sufficient. - JBW
RECOMMENDATION: That the Board:
1) Approves and authorizes the Chairman to execute the Bill of Sale necessary for the
conveyance of the utility facilities; and 2) Directs the County Manager or his designee to
proceed to follow all appropriate closing procedures and to record the aforementioned
document in the Public Records of Collier County, Florida,

BILL OF SALE
KNOW ALL MEN BY THESE PRESENT:
THAT COLLIER COUNTY, a potnical subdivision of the State of Florida, whose mailing
address is 3301 Tamiami Trail East, Naples, Florida 34112, of the first part, for and in
consideration of the sum of Ten Dollars ($10.00), in lawful money (and other good and
valuable considerations unto rt moving) to it paid by CITY OF MARCO ISLAND,
FLORIDA, a Florida corporation, whose mailing address is 50 Bald Eagle Drive, Marco
Island, Florida 34145, of the second part, the sufficiency and receipt of whiCh is hereby
acknowledged by it, has granted, bargained, sold, transferred, set over, and delivered,
and by these presents does grant, bargain, sell, transfer, set over and deliver unto the
party of the second part, assigns all those certain goods and chattels, described as
follows:
See attached Exhibit "A" which is incorporated herein by reference.
TO HAVE AND TO HOLD the same unto the party of the second part, CITY OF
MARCO ISLAND, FLORIDA, and assigns forever.

And the party of the first part, for itself and its successors, hereby covenants to and with
the party of the second part, CITY OF MARCO ISLAND, FLORIDA, and assigns that it
is the lawful owner of the said goods and chattels; that they are free from all liens and
encumbrances; that it has good right to sell the same as aforesaid, and that it will
warrant and defend the same against the lawful claims and demands of all persons
whomsoever.
