EXECUTIVE SUMMARY
Recommendation to approve a Second Amendment to Real Estate Conveyance
Agreement with the David Lawrence Mental Health Center, Inc. for conveyance of a
portion of County owned land located at 425 1st Street North, Immokalee, at no additional
cost to the County.
OBJECTIVE: To approve and have the Chairman execute the Second Amendment to Real
Estate Conveyance Agreement (Second Amendment) extending the timeframe for the Due
Diligence period agreed upon in the Real Estate Conveyance Agreement (Agreement) between
the David Lawrence Mental Health Center, Inc. (DLC) and Collier County (County).
CONSIDERATIONS: At the October 27, 2009 meeting, under agenda item 16D11, the Board
approved the Agreement. The Agreement provides DLC with a 120 day due diligence period,
after which DLC will report its findings to the County. Subsequently, the Board approved an
Amendment to the Agreement on March 23, 2010 under agenda item 16D5, approving an
additional 120 day due diligence period which will expireon June 24, 2010.
The Second Amendment is requested by DLC to extend the current due diligence period an
additional 120 days up to and including October 22,2010.
FISCAL IMPACT: There is no additional fiscal impact as a result of the Second Amendment.
GROWTH MANAGEMENT IMPACT: There is no impact to the Collier County Growth
Management Plan.
LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County
Attorney's Office and is legally sufficient-JBW.
RECOMMENDATION: That the Board of County Commissioners approves the Second
Amendment and authorizes the Chairman to execute the Amendment.
