EXECUTIVE SUMMARY
Recommendation that the Board of County Commissioners approves Pelican Bay
Services Division to hold a workshop to explore the possibility of becoming an
Independent District.
OBJECTIVE: To explore the possibility of Pelican Bay becoming an Independent
District and to use the law firm of Nabors, Giblin & Nickerson, P.A. who has a current
retention agreement with the County Attorney's Office and has an extensive
background through their Tallahassee office in the creation of special purpose
independent districts, to consult at any workshops held for this purpose.
CONSIDERATION: A Pelican Bay Services Division Board Meeting was held on
April 7, 2010 in which a motion was made, seconded and unanimously approved that
directed the Administrator, Neil Dorrill, to schedule and workshop to explore Pelican
Bay becoming an Independent District and to discuss with the County Attorney the
possibility of engaging, on a temporary basis, the services of a law firm as co-counsel
to Pelican Bay Services Division's exploration of becoming an independent district.
FISCAL IMPACT: The funds for this service are available in the Pelican Bay
Services Division Funds 109 and 778 and will be split with the County Attorney's
Office. The source of funds is assessment revenue benefiting properties within the
Pelican Bay Municipal Service Taxing and Benefit Unit.
lEGAL CONSIDERATIONS: This Agreement has been reviewed for legal
sufficiency and is ready for Board consideration and approval. - JAK
GROWTH MANAGEMENT IMPACT: There is no Growth Impact associated with this
