Agenda 05/11/2010 Item #16G 2Agenda Item No. 16G2 May 11, 2010 Page 1 of 4 EXECUTIVE SUMMARY Recommendation to approve the sale and consumption of alcoholic beverages (beer and wine) during the CRA co-hosted event "Bayshore Festival of the Arts" on January 29-30, 2011 at Sugden Regional Park. OBJECTIVE: To receive BCC approval to sell alcoholic beverages (beer & wine) at the "Bayshore Festival of the Arts" event on January 29-30,2011 at Sugden Regional Park. CONSIDERATIONS: On this agenda is a CRA Advisory Board request for CRA Board approval to co- host the "Bayshore Festival of the Arts" at Sugden Regional Park January 29-30, 2011. On December 15, 2009, the CRA Board approved a Bayshore Gateway Triangle CRA Event Policy and Procedures Manual to govern CRA event operations. This Manual was crafted from the Collier Parks and Recreation Event and Fee Policy (BCC Resolution 2008-283). The CRA policy has strict guidelines governing alcohol sales operations and liability insurance requirements of $500,000 to additionally insure the County and CRA. Bayshore Cultural and Performing Arts, Inc. (CAP A) will serve as the alcohol beverage vendor for the event. They will staff and monitor the operation to include alcohol sales and age-identification services. They will acquire their alcohol sales permit from Alcohol, Tobacco and Firearms (ATF), Zoning Department approval, and insurance. Attached as back-up is the Bayshore CAP A letter outlining their mission and how the net proceeds will be used. Security and safety issues will be coordinated with the Collier Sheriff's Office, Fire Department and Collier Emergency Management Service. Precautionary measures will be taken to contain the sale and consumption of alcohol on site, and an "alcohol exclusion area" in and around the children's play area will be maintained and monitored. FISCAL IMPACT: There are no CRA expenses associated with this request. A Zoning event permit fee is included in the event budget. GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with this event. LEGAL CONSIDERATIONS: The provision of alcoholic beverages at a County-approved event on County property exposes the County to liability in the event of an accident or injury if the insurance is not sufficient to cover the cost of litigation and any liability. This is ultimately a business decision. This item is ready for Board consideration and approval. Bayshore Cultural and Performing Arts Inc. (CAPA) is co-sponsoring a "Festival of the Arts" event to be held at Sugden Park on January 29th and January 30th, 2011, and is requesting your permission to serve beer and wine in addition to food and non-alcoholic beverages. CAPA will obtain all required permits and insurance for this event in accordance with Collier County Parks and Recreation Department Policy. CAPA is a 501 (c) (3) organization whose mission is to create a state of the art Cultural and Performing Arts Center that showcases local visual and performing artists, thereby providing accessible, affordable cultural. performance and educational opportunities for the community. This two day event is free to the public. The Festival will raise public awareness of the proposed Cultural District while presenting some of Collier County's finest local talent to the community. (CAPA) wishes to co-sponsor The Bayshore Festival ofthe Arts in partnership with the Bayshore CRA on January 29'h and 30th at Sugden Park. We have commitments from 12 local performing organizations (200+musicians) to participate in the festival, which include: Naples Concert Band Paradise Coastmen Barbershop Chorus Naples Daily News Jazz Band Frontline Bluegrass Monroe Station Frank Corso Trio Stu Shelton Trio/ Rebecca Richardson Soloist The Trio! Bob Zottola's Expandable Jazz Band 2 High School Jazz Bands Opera Naples Young Artists There will also be Visual Artists, food, beverage and beer booths, and children's activities. This festival is within Bayshore CAPA's Mission that supports local visual and performing artists and offers affordable, accessible cultural enrichment to the community. On Wednesday, April 21st, 2010, the Collier County Parks and Recreation unanimously approved a recommendation to the Board of County Commissioners to permit the Bayshore CAPA/CRA Festival of the Arts to be held at Sugden Park and that the sale of beer and wine be allowed. This is a free event. The CRA and CAPA are working together to improve the quality of life of the community as the redevelopment of Bayshore continues to progress.
