Agenda 05/11/2010 Item #16A 2 Agenda Item No. 16A2 May11,2010 Page 1 of 14 EXECUTIVE SUMMARY Recommendation that the Board of County Commissioners (Board) receives and approves the Collier County Floodplain Management Plan 2009 Progress Report. OBJECTIVE: To provide the Board of County Commissioners with the fifth annual progress report on the Collier County Floodplain Management Plan that was developed as a requirement of the County's participation in the Community Rating System of the National Flood Insurance Program. CONSIDERATIONS: Collier County is a voluntary participant in the Community Rating System (CRS) of the National Flood Insurance Program. Because the County has a Class 6 rating in the CRS progralll and there are more than ten (10) properties in the County that have filed multiple flood insurance claims within any ten-year period, thus establishing them as Repetitive Loss Properties, the County is required to develop and maintain a Floodplain Management Plan. The purpose of a Floodplain Management Plan is to promote awareness of floodplain and flooding issues, identifY known flood hazards, discuss past flooding events, assess the current floodplain/flooding problems, and set goals along with a strategy to make the community more resistant to flooding. One key component is to address ways to mitigate the Repetitive Loss Properties so they no longer arc susceptible to flooding from the I-percent annual chance storm event. Collier County is receiving an improved rating as a Class 6 community in the CRS program, which provides up to a 20 percent discount on the premium rates charged to flood insurance policy holders. The County is required to annually provide a progress report on the accomplishments of goals in the Floodplain Management Plan. At least every five (5) years, the Floodplain Management Plan must be updated. For Collier County, the Floodplain Management plan was developed as a portion of the adopted Hazard Mitigation Plan. The attached "Collier County Floodplain Management Plan 2009 Progress Report" (hereafter referenced as REPORT) includes a reporting of progress made toward fulfilling the Action Plan for 2009 items which were derived from the goals, objectives and policies of the cun'ent Floodplain Management Plan that was approved by the Board on 12-11-07. The REPORT also includes the recommended Floodplain Management Plan Action Plan for 20] 0, with a prioritization given to those items that are mandatory (identified a~ category A), those items selected as thc "Top Five" for completion by the Floodplain Management Planning Committee (identified as category B), and all of the other Action Items (identified as category C) included in the Action Plan for 2009. Staff is providing this annual repOlt to keep the Board of County Commissioners informed on progress in floodplain management and seeking recommendations lor additional direction and efforts the Commissioners would desire to achieve to make Collier County more resistant to flood damage. It is included in the Hazard Mitigation Plan (now called the Local Mitigation Strategy) which is adopted by the Board of County Commissioners (Board) at a regularly scheduled and noticed public meeting. This report is then submitted as a part of the subsequent year's CRS annual recertification documentation. County staff has prepared the Floodplain Management Plan 2009 Progress Report for presentation and review with the Floodplain Management Planning Committee (FMPC) and the Board based upon the Action Plan approved by the Board on 7-28-09 [Agenda Item 16(A)(l6)]. The purpose of the annual progress report is to help ensure that there is a continuing and responsive floodplain management planning and implementation process. Notifications on the availability of this progress report are made through the standard public advertising process for all items on the Board's agenda, of which this Progress Report was included for discussion on May 11. 2010. When an item is placed on the Board's agenda, it is available for review and inspection in the Board's office, the Office of the County Manager, and on the County's web site (www.colliereov.net). There is also a public notification process for each meeting of the FMPC, of which this Progress Report was included for discussion on the April 5, 20 10. In 2006, the Board established the FMPC to further promote the development and implementation of sound floodplain management practices within the County. The FMPC consists of ten (10) volunteer members of the public, ten (10) County stall members representing ten (10) key departments involved in activities impacting the floodplain, and one (I) representative from each of the three (3) municipalities. Page I of I Agenda Item No. 16A2 May 11, 2010 Page 5 of 14 During 2009, the FMPC met seven (7) times in regular meetings to discuss floodplain management plan implementation issues and progress. The FMPC also held five (5) special information gathering evening meetings in different locations around the County. There were three (3) sub- committee meetings in 2009. The Collier County Floodplain Management Plan (FMP) was totally revised and adopted by the Board in 2008. The County was notified in 2009 that the FMP did not sufficiently address all of the plan development steps as outlined in the CRS Coordinator's Manual. As of the date of this Progress Report, staff is still working on developing the appropriate revisions to the FMP for approval and adoption by the Board in 2010. The 2009 FMP Action Plan is located in Section 7.10 of the FMP to identifY those items deemed important for accomplishment in the following year to meet the intentions of the FMP's goals, objectives and policies. The 2009 Action Plan is listed below along with a brief explanation for each Action Item. The table contains a numbering system in the first two columns to identifY if the Action Item is (A) mandatory, (B) selected as one of the "Top Five" by the FMPC, or (C) one of the previously listed items that may be addressed if the situation arises or staff completes the list of (A) and (B) items. Staff was able to complete or work on all items identified as category A or B, but there was some slippage in schedule due to staff availability and work load priorities with other duties. Category C activities did not fare well for completion, except for C7 and C8. Activity CIO is a long range multi-agency planning initiative that will start to become more active upon completion and implementation of the new Watershed Management Planning effort underway by the County. Revisions to the Floodplain Management Plan in 20 I 0 will have an impact on the 20 10 Action Plan. A new Action Plan, with a modified prioritization methodology, is expected to be developed for adoption later in the year. The Floodplain Management Plan 2009 Progress Report was reviewed by the FMPC on 4-5-10, and their suggested editing was incorporated into the document. Under the current stressed and declining economic situation with reductions in budget and staffing, it is recognized that for 20 I 0 there should be a focus on completing the annual priority "A" activity items and finalizing those priority "B" activity items not completed in 2009. One new activity proposed for high priority "B" designation, is for the necessary revisions to the Flood Damage Prevention Ordinance. It was anticipated that a new ordinance would be adopted in 2009, but disagreement with content and a subsequent total rewrite have delayed the adoption into 2010. Also, one previous priority "B" activity (mapping mobile homes in the SFHA and locations of flood insurance policy coverage) has been completed, to the extent practical, and the priority reduced to "C" for remapping on a biennial schedule. The meeting schedule of the Floodplain Management Planning Committee will be revised to have quarterly meetings instead of monthly meetings. This will allow time for meaningful task accomplishment to occur between meetings. During 2010, staff will make revisions to the Floodplain Management Plan to address comments received from the Insurance Services Office. While addressing the needed revisions to the Floodplain Management Plan, staff will also look at the current goals, objectives and policies to update and remove items that have already been completed or reword to make them address items over a regularly repeating time frame. Approval of the "Action Plan for 2010" by the Board will have the effect of amending Section 7.10 of the FMP until such time that the revised FMP is brought back to the Board for approval. The 2009 approved Action Plan will be replaced with the "Action Plan for 20 10". The following "Action Plan for 2010" table continues to utilize a numbering system in the first two columns to identify if the Action Item is (A) annually mandatory, (B) selected as high priority by the FMPC, or (C) one of the previously listed items that may be addressed if the situation arises or staff completes the list of A and B items. Note that with the internal reorganization of the Community Development and Environmental Services Division (CDES), there has been a merging of the Engineering and Environmental Services Department, the Comprehensive Planning Department, and the Zoning and Land Development Review Department.
