Agenda 05/11/2010 Item #10B Agenda Item No. 10B May 11, 2010 Page 1 of 2 EXECUTIVE SUMMARY Recommendation to review and approve proposed language to be added to County Manager's Agency Policy (CMA) 5311, Code of Ethics, regarding employees who serve on non-profit boards. OBJECTIVE: To provide employees with guidance regarding service on the governing boards of non-profit organizations. CONSIDERATIONS: At its regular meeting of April 13, 2010, the Board discussed agenda item (10C), which was originally agenda item (16E3) and was moved to the regular agenda by the request of Commissioner Coyle, regarding proposed additional language to CMA 5311, Code of Ethics, that outlined a process for an employee wishing to serve on the Board of Directors of any non-profit organization receiving direct or indirect funding from the Board of County Commissioners. During that discussion, the Board provided additional direction and asked staff to return with revised language. After consulting with the County Attorney's Office, staff recommends the following revision to CMA 5311: M. Employees may not serve in a decision making capacity for any non-profit entity that receives funding (either directly or indirectly) from the Board of County Commissioners, including grant funding. If an agency makes a request for funding from the Board of County Commissioners, any employee serving the agency in a decision making capacity must resign from that position. The Board may, with good cause shown, waive this restriction upon a super majority vote. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's Office and is legally sufficient for Board action. - CMG FISCAL IMPACT: There is no fiscal impact associated with this Executive Summary. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this Executive Summary. RECOMMENDATION: That the Board approves staffs recommended revision to CMA 5311 providing guidance to employees wishing to or serving on boards with any decision making authority for non-profit organizations and provides for an effective date of thirty (30) days to allow employees to come into compliance.
