Agenda 04/27/2010 Item #16A 8 Agenda Item No. 16A8 April 27,2010 Page 1 of 4 EXECUTIVE SUMMARY Recommendation to approve a one-year traffic reservation extension associated with the approval of the Traffic Impact Statement submitted with the Fiesta 3 SDP AR #11621. OBJECTIVE: To obtain Board of County Commissioners' (Board) approval for a one-year traffic reservation extension associated with an approved Traffic Impact Statement (TIS) for 26,208 square feet (of which 17,117 square feet are proposed) of Supermarket and Retail uses submitted with the Fiesta 3 approved SDP AR #11621. CONSIDERA TION: On February 9, 2009, the TIS submitted as part of the Site Development Plan (SDP) application for 17,117 additional square feet was approved. The traffic reservation associated with the TIS approval expired on February 9, 2010. The applicant would like to extend the traffic reservation for an additional one-year extension, through February 9,2011. Pursuant to Section 1O.02.07.CA.f. of the Land Development Code, traffic capacity reservations will "expire in one (1) year, from TIS approval and determination of available capacity, unless ...the Board approves an extension to the one (1) year time period." The applicant is requesting the Board approve a one-year extension retroactively to now include the dates beginning February 9, 2010 and ending February 9, 2011 for the traffic reservation. The applicant is still waiting to begin the project but would like to extend the traffic reservation. Based on Transportation Services' updated 2009 AUIR and concurrency database, the adjacent roadway network has a sufficient amount of remaining capacity. SR-29, from New Market to N. 15th Street (Link 84), has a remaining capacity of747 peak hour, peak direction trips. This roadway is at LOS B at this time. There are no anticipated projects proposed in the area that would eliminate capacity for this project through the requested 2011 extension. FISCAL IMPACT: There is no fiscal impact for this extension approval. LEGAL CONSIDERATIONS: This item has been approved by the County Attorney's Office and is legally sufficient for Board action.-SRT GROWTH MANAGEMENT IMPACT: The proposed traffic reservation extension for this project IS consistent with the County's Growth Management Plan. RECOMMENDATION: The Board approves a one-year extension retroactively from February 9, 2010 to February 9, 2011 for the traffic reservation associated with the TIS approval, and authorizes the County Manager or his designee to prepare the necessary documentation to comply with the Board's direction. Traffic Capacity Reservation for all or part of the proposed development may be approved and secured at application pending approval of the final sub-division plat, site development plan or building permit upon acceptance of the TIS by the Transportation Administrator as part of a complete Application Request (AR) deemed sufficient for review for the proposed development by the CDES Division. The Transportation Administrator will notify the applicant of any traffic capacity reservation via facsimile per section 10.02.07 C.4.c. Traffic capacity reservations will be awarded to the development upon: approval of the COA and final development order per section 10.02.07 C.4.e. payment of road impact fees in accordance with section 10.02.07 CA.e.; and Proportionate Share Payment, if applicable, in accordance with section 6.02.01. Traffic capacity reservations approved under this section will expire in one (1) year, from TIS approval and determination of available capacity, unless the final local development order for the development is approved, or the Board approves an extension to the one (1) year time period.
