Agenda 04/27/2010 Item #16A 4 Agenda Item No. 16A4 April 27, 2010 Page 1 of 7 EXECUTIVE SUMMARY To inform the Board of County Commissioners of setback issues concerning the replacement of a pool screen enclosure, OBJECTIVE: To inform the Board of County Commissioners of the staffs intent to issue a conditional building permit for a replacement pool screen enclosure that was erroneously permitted in 1991. Due to this error, it is requested that the permit be issued to erect the screen enclosure on the existing footprint, under the condition that the applicant apply for a dimensional variance within 6 months of its issuance, and that the fees for the variance, application and advertising costs totaling $3,000 be waived by the Board of County Commissioners. CONSIDERATIONS: The subject property is an existing single-family residential dwelling unit located at 8923 Lely Island Circle, in the Lely Resort PUD zoning district. The property abuts a lake in the rear and two existing single-family dwelling units on each side. The original pool enclosure was permitted and a certificate of occupancy was issued to the property owner at the completion of its construction in 1991. The property owner recently removed the screen enclosure to resurface the pool deck and to upgrade the enclosure to the current building code. Unbeknownst to the property owner, the original enclosure was permitted erroneously at a distance of 5.2 feet from the rear property line; the minimum rear setback requirement for this property is 10 feet. When the contractor for the property owner applied for a permit to replace the enclosure, the 19 year old permitting error was discovered and the permit application was denied. Pursuant to the Land Development Code, the structure cannot be replaced unless it meets the current rear setback requirement of 10 feet. The property owner does not meet the criteria for an administrative variance as the encroachment exceeds the maximum allowable distance under which one would qualify. In this case, an administrative variance could only be approved up to a maximum distance of I-foot; however the structure encroaches 4.8 feet into the required rear yard. The proposed replacement enclosure was reviewed for compliance with the 2007 Florida Building Code "and the adjoining property owners have signed a letter approving the replacement, which will meet the same footprint as the original enclosure. Furthermore, the proposed enclosure does not encroach upon the 5-foot lake maintenance easement surrounding the lake. The alternative to the issuance of the permit at this time is to seek approval of a dimensional variance first from the Board of Zoning Appeals, however the time required obtaining a variance and the health/safety issues that exist with having an unprotected pool necessitates issuance of the permit at this time. Agenda Item No. 16A4 April 27, 2010 Page 2 of 7 FISCAL IMPACT: The cost of a dimensional variance is approximately $3,000 ($2,000 in application fees plus advertising costs). GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. LEGAL CONSIDERATION: A health safety and welfare issue exists for the timely replacement of the pool screen enclosure. If owner is willing to assume the risks of installing the pool screen enclosure without a variance and release the county from any claims if the variance is not approved, then I see no legal issues to hearing the variance at a later date. The Board has the authority to waive fees if a valid public purpose exists for doing so. This item is ready for Board consideration and approval.--HF AC RECOMMENDATION: To have the Board of County Commissioners approve staff's request to issue the screen enclosure permit with the following conditions: 1. Applicant applies for a dimensional variance within 6 months of its issuance. 2. The fees for the variance, application and advertising costs totaling $3,000 are waived by the Board of County Commissioners. 3. Receipt from owner of a letter or document that states that owner is willing to assume the risks of installing the pool screen enclosure without a variance and release the county from any and all claims if the variance is not approved.
