OBJECTIVE: To obtain Board authorization for the Chair, to execute and file Federal Transit Administration (FT A) grant applications; execute grants and cooperative agreements; and to file with applications the annual certification and assurances, as required, subject to approval of such items brought to the Board, CONSIDERATION: The County is eligible under state and local law to request, receive, and dispense Federal Transit Administration (FTA) funds and to execute and administer FTA funded projects, The authority to take actions and responsibility on behalf of the County must be properly delegated and executed, The attached Resolution will provide for the proper delegation of authority to the Board and its Chairman, FISCAL IMPACT: There is no fiscal impact with this item. However, any new grant applications will be presented by Executive Summary to the Board for approval. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office and is legally sufficient for Board action~SRT, GROWTH MANAGEMENT IMPACT: This item has no Growth Management Impact. WHEREAS, the Board of County Commissioners of Collier County is the governing body in and for Collier County, Florida, a political subdivision of the State of Florida; and WHEREAS, the Federal Transportation Administrator has been delegated authority to award federal financial assistance for a transportation project; and WHEREAS, grant and/or cooperative agreements for federal financial assistance will impose certain obligations upon Collier County, the applicant, and may require Collier County to fund the local share of project costs; and WHEREAS, Collier County, the applicant, has or will provide all annual certifications and assurances to the Federal Transit Administration required for projects. NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners, Collier County, Florida, that: I. Authorization to Execute and File Applications. The Chair or the Board's designee is authorized to execute, file and manage grants, on behalf of Collier County, for federal assistance with the Federal Transit Administration for federal assistance authorized by 49 V.S.C. ~ 5307 and Title 23 of the Vnited States Code, or other federal statutes authorizing projects administered by the Federal Transit Administration. 2. Annual Certifications and Auuraaees. The Chair or the Board's designee is authorized to execute and file with its application the annual certification and assurances, and other documents the Federal Transit Administration requires before awarding a federal assistance grant or cooperative agreement. 3. Authorization to Execute GraDt and Coouerative A2reemeDts. The Chair or the Board's designee is authorized to execute grant and cooperative agreements with the Federal Transit Administration on behalf of Collier County, Florida, following the Board's review and approval.
