Agenda 03/09/2010 Item #16J 1 Agenda Item No. 16J1 March 9, 2010 Page 1 of 2 .,"-- EXECU1TVESU~ARY RECOMMEND AUTHORIZATION OF A BUDGET AMENDMENT TO TRANSFER FUNDS COLLECTED FOR THE COLLIER COUNTY JUVENILE ASSESSMENT CENTER TO THE SHERIFF IN THE AMOUNT OF $59,000 TO BE USED EXCLUSIVELY FOR THE OPERATION OF THE JUVENILE ASSESSMENT CENTER. OBJECTIVE: To authorize the transfer of funds collected through the Court system to fund the Juveni]e Assessment Center (JAC) to the Sheriff. CONSIDERATION: Prior to the implementation of Revision 7 to Article 5 of the State Constitution. funding for an assessment center was collected on all criminal cases. These funds are maintained by the Clerk of Court and can only be expended upon the request of the Sheriff. With the implementation of the aforementioned revision to the Constitution, this funding source was eliminated, However, the Board was authorized to replace it by implementing an ordinance for the imposition of $65 on certain criminal cases. This $65 is divided into quarters with 25 percent being availab]e for juvenile alternative programs. The Board of County Commissioners further divided the 25 percent between Teen Court and the J AC. Since November 2004, the funds have been transferred to the Clerk of the Circuit Court and payments have been made for the operation of the Juvenile Assessment Center with the approval of the Sheriff. The Clerk now desires for the Sheriff to pay the expenses of the Juvenile Assessment Center. In addition to the $59.000 in Fund ]75, there is currently $25,280.25 in the Clerk's Fund 65] and $]7,464.6] in Fund -- ] 76, available for transfer to the Sheriff, FISCAL IMPACT: Funds are budgeted in the Juvenile Assessment Center Fund ]75 in the amount of $59,000 as a transfer to the Clerk of Courts. These funds would now be a transfer to the Sheriff; additionally the $17,464.6] balance in the Clerk's Fund ]76 and $25,280.25 in Fund 65] would be transferred to the Sheriff for JAC operations. Future funds expended in this program would come from the portion of the $65 court costs collected. This program has no impact on the general fund. LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney's office and the request for authorization of a budget amendment to transfer funds does not present a legal issue.-SRT. GROWTH MANAGEMENT: none RECOMMENDATION: Approval of a budget amendment in the amount of $59,000 to transfer funds from Fund 175 to the Sheriff.
