Agenda 03/09/2010 Item #16C1 Agenda Item No. 16C1 March 9, 2010 Page 1 of 58 - EXECUTIVE SUMMARY Recommendation to approve a Fifth Amendment to the LandfIll Operating Agreement between Collier County and Waste Management, Inc., of Florida, providing administrative changes to clarify definitions that are consistent with Florida Administrative Code, Chapter 62-701, Solid Waste Management Facilities; to align current business processes; and, to restructure payment formulas due to the implementation of alternative daily cover materials including Posi-Shell@, mulch, and other Florida Department of Environmental Protection agency approved alternative cover materials to maintain odor control, landfill airspace preservation, and to provide estimated annual operating cost savings of $266,141, and estimated annual airspace savings valued at $736,285. OBJECTIVE: Approval of a Fifth Amendment to the Landfill Operating Agreement (LOA) providing administrative changes to clarify definitions that are consistent with Florida Administrative Code, Chapter 62-701, Solid Waste Management Facilities; to align current business processes; and to restructure payment formulas from three separate reimbursement fonnulas to one, per-ton price inclusive of reimbursements for soil, airspace savings, and the use ofPosi-Shell@ as an alternative daily cover material. - CONSIDERATIONS: The Solid Waste Management Department (SWMD) is responsible for the management of the Collier County Landfill (Landfill) and continuously seeks solutions to enhance best value, and regulatory compliant operations at the Landfill. Implementing the use of altemative products as daily cover that controls odor in accordance with the zero off-site odor policy, preserves valuable landfill airspace, and provides best value to the rate payers is one such solution. The implementation of alternative daily cover is consistent with the Integrated Solid Waste Management Strategy as the number one priority in conserving airspace and providing best value management practice that increases the longevity of the landfill. On September 12, 2006, Agenda item JOE, the Board gave direction to Waste Management, Inc., of Florida (WMIF), to perform a pilot test ofPosi-Shell@ as an alternative daily cover material to reduce the consumption of six inchcs of soil as a daily cover. Posi-Shell@ is a Florida Department of Environment Protection (FDEP) approved, spray-applied, cement-mortar coating similar to stucco, and is both nonflammable and durable. On January 20, 2009, WMIF presented to staff its airspace savings analysis utilizing Posi-Shell@ as an alternative daily cover. WMIF estimated the use ofPosi-Shell@, soil, and mulch used for daily cover on an annual basis in the approximate percentages of25 percent Posi-Shell(R), 45 percent soil, and 30 percent mulch. ,--. Soil alone as a daily cover, which is the current practice, consumes approximately 48,110 cubic yards of airspace per year. The reduction of soil usage increases the availability of valuable airspace for continuous disposal. 1be net impact is an extension of the useful life of the Landfill which will benefit future generations in Collier County. The use ofPosi-Shell@ will generate an estimated savings in airspace valued at $22,000,000 over the next 30 years. Additionally, through the use of soil, mulch, and Posi-Shell@, an estimated cost avoidance of up to $8,000,000 over the next 30 years in reduced odor control costs and operational reimbursement payments as presented in Exhibit C, "Waste Management, Inc. of Florida Performance Measures". Agenda Item No. 16C1 March 9, 2010 Page 2 of 58 Measures built into the reimbursement pricing approaches from a maximum of28 percent of the volume, in cubic yards for instances when soil only is utilized, to 21 percent of the volume, in cubic yards, for the use of soil, mulch, and Posi-Shell@. In the event that WMIF uses more material in any scenario than is listed on the Performance Measurcs, the County will be responsible to only reimburse WMIF up to the performance measure thresholds. This is an important and mutually ai,'feeable safeguard that provides an incentive to WMIF to maximize the use of alternative daily cover materials. The Fifth Amendment includes a change in the payment methodology from a per cubic yard reimbursement basis to a per ton reimbursement basis. Based upon the negotiated Performance Measures, WMIF invoicing is tied directly to waste buried and the application of cover materials. The price for soil and Posi-Shell@ are pass-through charges. The County pays the actual cost of these two materials; there are no escalations incorporated, Staff has included the following attachments: Fifth Amendment to the LOA, Attachment A-I, Summary of Base Tonnage Rates; Attachments A-2, A-2a through A-3, Escalation Methodology for daily cover materials; Attachment A-4, Payment for Mulch Processing; Attachment B, Monthly Odor Control Invoicing Process; Attachments B-1 through B-5, Sample Odor Control Invoice; and Attachment C, Waste Management Inc. of Florida Performance Measures. FISCAL IMPACT: The County will reduce its daily cover material cost by an estimated 35.16 percent by utilizing Posi-Shell@ as an alternative daily cover material. Based on current disposal practices, the calculated savings include estimated savings in airspace of over $736,285 per year over the next 30 years, and an estimated savings of up to $266,141 per year over the next 30 years in reduced soil payments and operational reimbursement payments to WMIF. GROWTH MANAGEMENT IMPACT: The use of alternative daily cover material is consistent with the County's Growth Management Plan, specifically Solid Waste Sub-Element Objective 2, Policies 2.2, 2.3, and 3.2, that state the County will utilize efficient methods for environmentally sound disposal of solid waste in accordance with local, state and federal regulations. LEGAL CONSIDERATIONS: This item has been reviewed and approved by the County Attorney's Office and is legally sufficient-JBW. "Yard Trash" means vegetative matter resulting from landscaping maintenance or land clearing operations and includes materials such as tree and shrub trimmings, grass clippings, palm fronts, trees and tree stumps, and associated rocks and soils. Section 2.14 Cover Material Any use of tarpaulins in lieu of Initial cover material shall be for the working face only and shall require the prior written approval of the County Manager. In no event shall the Landfill working face exceed a fifty (50) foot by one hundred (100) foot area when daily work ceases on the working face. Subject to the provisions of this paragraph and the requirements and procedures set forth in Section 2.26(5) and 2.26(6), the Contractor shall be allowed to use ADC if the use of such material is requested in writing by the County, accepted by the Contractor and aj;1proved by the Department. Section 2.26 (I) (g) The Contractor shall promptly install an upgraded blower and flare system with a lBiBiJRum manufacturer's rated flow capacity of at least 3,000 standard cubic feet per minute. This system shall be designed, maintailled, ancklper<lle&-to ensure t~ower and-flare are operate4 oontinuously and rest;wt automatieally, if necessary with an automatic restmt feature and manually activated redundant blower unit. The system shall be maintained to minimize downtime and operated continuously to the extent practical. The County shall be notified of any downtime within one hour or scheduled maintenance with at least one week of advance notice. TIle County and WMIF agree that the cost for this service is $14.84 per inbound ton, which includes a 15% margin. The County recognizes that the cost for performing the grinding, mulching and blending services may increase or decrease annually due to changes in contractual obligations between WMIF and their subcontractors. If the costs increase or decrease, WMIF must notify the County in writing of such changes within twenty (20) business days prior to commencement of the increase or decrease. If WMIF and the County arc unable to agree upon the fee within ten (10) business days from the notification, WMIF must obtain competitive, best value proposals from three (3) qualified vendors, within twenty (20) business days and submit to the County. The County will have five (5) business days from the submittal date to review and approve the proposed new rate. Upon the County's approval of the pel' ton adjustment, the approved cost shall be utilized for reimbursement to WMIF by the County. In the event the County does not approve the new rate, or takes longer than five (5) business days to approve, WMIF will use stocked soil and mulch mix. In the event that the stocked soil and mulch mix is depleted, WMIF will use either Soil Only or Soil and Posi-Shell. Upon changing the daily cover method the Soil Only or Soil and Posi-shell Per Ton (as applicable) Reimbursement Rate will be utilized for payment to WMIF by the County for each month during which the mulch could not be processed at an approved ratc. Upon reaching a negotiated, mutually agreed price for the blending of mulch and soil, WMIF willre-commence the use of soil and mulch mix. In the event that vegetative waste is not utilized for blending with soil as set fOlih above, the unused vegetative waste will be diverted to all area within the Collier County Landfill or the Resource Recovery Park designated by the County Manager or its designee, where it will remain and be utilized by Collier County as needed. In the event that the County Manager or designee request that the unuscd vegetative waste be transpOlied off-site, WMIF will develop a process for the removal of the excess vegetative waste, which provides best value pricing for the reuse, recycle or disposal of excess, unused vegetative waste and submit the process to the County for review. The County will have five (5) business days from the submittal date to review and approve the proposed process. Upon the County's approval of the pel' ton adjustment, the approved cost shall be utilized for reimbursement to WMIF by the County. The worksheet contains two pages, the first Is the annuai impacts and the other Is the 30 year impact. The following is a summary of the file: There are two components to the schedule, the odor control reimbursement part and the airspace benefit section. The odor control reimbursement savings is calculated by taking the cubic yards of soil that are saved by use of Pas i-Shell and then reducing them further by replacing some soil usage with mulch. The net impact Is we would be using 55% less soli In combination with Pas I-Shell and mulch. This reduced soil lowers the odor control reimbursement amounts which on a 30 year basis are almost $B,OOO,OOO. A larger portion of the benefit to Collier County relates to the freed up airspace that can now be used to bury additional tons of garbage. The impact is calculated by taking the soli savings related to the use of Posl,Shell and converting It Into tons. Savings of 716,580 cubic yards Is reduced by the .25 Inches of airspace used by the Posl-Shell (44,726 cu/yds) which results In a net airspace savings of 671,854 cubic yards. Those cubic yards are then converted to tons by multiplying by .65 which results In 436,705 additional tons of airspace available for disposal. At the current gate rate of $50.58 per ton the airspace value would be In excess of $22,000,000. The grand total benefit to Collier County Is over $30,000,000 over the 30 year period for the combination of reduced odor control payments as well as additional airspace saved. Clearly, as the tipping fees Increase over the next 30 years, the value increases. I have used a similar format to the handouts we were using during our negotiating sessions. MISSION: To operate and maintain the Landfill in an environmentally safe and sound manner while providing the best value to Collier County ("County"). Among other things, Waste Management Inc. of Florida ("WMIF) and the County intend to comply with all applicable rules and regulations, eliminate off-site odors, achieve operational excellence, preserve airspace capacity, and protect the environment, including but not limited to ground water, surface water, and air quality. GOALS: . Evaluate the use of Posi-Shell and crushed concrete as ADC at the Landfill. . Compare the use of Posi-Shell and crushed concrete to the County's current practice of using soil as cover material. . Determine whether (and the extent to which) the use of Posi-Shell and crushed concrete as ADC consumes less airspace at the Landfill than the use of soil as cover material. . Determine whether (and the extent to which) the use of Posi-Shell and crushed concrete as ADC costs less than the use of soil as cover material. . Determine whether the use of Posi-Shell and crushed concrete as ADC is a satisfactory (or improved) method of controlling odors at the Landfill. BACKGROUND: The cost of using soil as cover material at the Landfill has increased significantly since June 2004. The availability of soil from local suppliers is limited. There is a need to identify a viable substitute for soil as cover material because soil is a non-renewable resource that may not be available in the future. ",-. On September 13, 2006, WMIF petitioned the Board of County Commissioners ("Board") for reimbursement of unusual and unanticipated increases in the cost of the soil used at the Landfill between May 2004 and July 2006. In response to WMIF's petition, the Board authorized the Solid Waste Management Department and WMIF to undertake a pilot project at the Landfill and thus determine whether Posi-Shell could be used successfully as an alternative daily cover ("ADC"). On March 15, 2006 WMIF submitted a letter to the Florida Department of Environmental Protection ("DEP") and thereby requested DEP's authorization to perform a pilot project using Posi-Shell as an ADC at the Landfill. In a letter dated March 21, 2006, DEP stated that it has no objections to the pilot project. DEP also indicated that it would inspect the Landfill during the pilot project to determine whether the project is being conducted in compliance with the . applicable DEP rules and regulations. APPROACH: Posi-Shell has been selected by WMIF and the County for a pilot test that will be conducted from March 15, 2006 through June 30, 2006, unless the County gives its prior written approval to change these dates. A letter (dated March 21, 2006) authorizing the pilot test has been received from the FDEP. _ Crushed concrete also has been selected for use during the pilot test. A report prepared by Dr. Tim Townsend, a professor at the University of Florida, concludes that crushed concrete is effective at controlling and minimizing odors from landfills. Crushed concrete was not used during the 60-day dry season pilot test for two reasons: 1. From about mid March to about mid April, it simply was not available 2. With Collier County's determination that crushed concrete is not considered "soil" under the contract, its use is economically infeasible for WMIF Collier County and WMIF staff both observed and recorded the daily use of Posi- Shell during the Pilot Project. WMIF recorded daily data using the "scorecard" developed and approved by the Collier County Project Development Team (PDT). The "scorecard" reflected visual observation and analytical data, as applicable, related to odor control, vector control, litter control, erosion control, fire control, and appearance of operations, and other factors that will enable the PDT to evaluate the impacts and benefits of Posi-Shell compared to the traditional use of soil for initial cover. In addition, the 'scorecard" reflected FDEP's Guidelines for Obtaining Approval to use Alternate Initial Cover Materials. .- -,- -- .-.-.-.---.-.- ~, ~-_. ___0.....___.. ".. __,,~,-,._. _ ~--,_... PILOT STUDY RESULTS: The equipment used for the application of the posi-shell ADC includes a mixing silo and an applicator unit. A bulldozer as shown in Photo 1 pulled the applicator unit. On most days a water truck was used to supply water to the applicator unit. The mixing silo and materials are shown in Photo 2. The following materials mixed in a 2,000 - gallon application unit constitute a load. . 1600 gallons water . 4, bags (15- pound bags) Posi Pak Type P-100 Fiber Strands . 20- bags (50- pound bags) PSM-200 Setting Agent . 4,000 pounds (2- tons) Portiand Cement ._-, Once the last dust control run of the day was completed, the water truck was filled with water to supply the Posi-Shell application unit. Between 4:30 and 5:00 pm, water was transferred to the application unit and the bags of Posi Pak and - -----"'" ~'-".., -"",;.""'.-.'-.'-"- - -.- '_.-'._'---~..- -. --,. PSM-200 were added. After a minimum of 5 minutes of mixing, the Portland Cement was added and mixed. . The typical daily procedure was to stage about 10 loads of soil cover near the working face, finish compacting the waste, and smooth the waste surface by walking it in with a dozer. Then the soil cover was spread on the top surface and the applicator was pulled to the working face. Posi-Shell works best when applied from multiple directions. At a minimum an application was conducted from both above and below the working face as shown in Photos 4 & 5. Care was taken to spray the Posi-Shell not only up and down the working face, but also across it from side to side. Generally, the application from the bottom was the heavy base application and the application from the top was lighter to fill in the shadows. The area was sprayed with the material to a coating depth of approximately one quarter (1/4) inch. A series of nozzles were used to spay the material close to the applicator or up to 150 feet away. Wind had some impact on the spray, but typically the applicator was capable of spraying 150 feet even against a significant wind. The material seemed to cover the flagging very well with little effort from the operator. The material dried according to its thickness. Significant drying occurs during the first two hours, but sometimes thick applications were a little wet the next morning. Photos 6 through 12 show the material in various stages of application. Actual spraying time for a 2,000 gallon load is a little over a half hour, but the total time to mix a load. spay it from various locations, and clean the machine was typically about one hour and 45 minutes for two people. One person can perform the entire process, but two people let both finish sooner. Data was captured daily on the ADC "Scorecard". Copies of the daily scorecards and summary are provided in Appendix 2 of this report. Ratings on the scorecard are from "-2" (poor) to "+2" (excellent) with "0" equal to soil cover. Written summaries and average score for the individual performance parameters are as follows: . Odor Control: With a single exception, odor from the waste during the dry season pilot test was not detected in WMIF's odor monitoring program. The County's perimeter H2S sensors as not calibrated so they did extensive testing with portable H2S sensors including around the working face and did not register significant levels. WMIF's odor monitoring program identified a working face type odor early in the morning of May 4, 2007 near the south side of the landfill. A review of the data from May 2 and May 3 indicate good Posi-Shell coverage and no issues with its performance on following days. Also, operating staff has not noted odors near the working face. At this point, the working face .- odor is an unexplained anomaly that has not recurred. (Average Score +1.11 ) . Vector Control: Birds don't like wet Posi-Shell. They will sit all around it - particularly on the soil top cover. After about 15 - 20 days, the buzzards seem to have gotten hungry and started attacking the Posi-Shell much like they had attacked soil cover. We noted damage on 4/6 and 4/7. It seemed to get worse by about 4/10 when I sent these pictures and the copy of the email to follow. We started using bird bangers on 4/11 and they seemed to work well. Over the last month, the buzzard population has dramatically decreased. There still exist a couple eagles and there are swarms of sea gulls, but we no longer see significant bird damage. Buzzards appear to be the culprit, and they are no longer prevalent. Photos 13 & 14 are from the area that was covered well with Posi-Shell the previous night. It appears that when the Buzzards become extremely hungry they tend to break through the Posi-Shell but typically are only able to un cove plastic and smooth paper. You can even see where they have gone through the plastic to pull something out. This damage happens primarily during the day, so this damage can be minimized by systematically scaring the birds away. No other vectors have been noted during the dry season. (Average Score +1.30) -,.~.. . Litter Control: The only significant difference in litter control between Posi-Shell and soil is that it is very easy to tack down pieces of litter around the working face with Posi-Shell. This helps prevent the litter from blowing away from the working face area. There has not been any problem with litter becoming detached from a Posi-Shell covered working face. The only thing noted is that sometimes a piece of blowing litter will tend to get stuck in the Posi,Shell that had been covered several days earlier. This could be considered an advantage in that the Posi-Shell covered area will likely be covered with additional waste in a relatively short period of time and the litter is kept from blowing outside of the disposal area. (Average Score +1.25) . Erosion Control: Very little rainfall occurred during the dry season pilot study, but when it did, the Posi-Shell seemed to hold up well. Only when a rainfall occurred shortly after application did significant damage to the ADC occur. We found that touch up of a slightly damaged area was very easy to accomplish as needed and that once a Posi-Shell covered surface had been in place for a few days and had been touched up, it seemed to hold up very well. A more thorough analysis of this will be performed in the next stage. (Average Score +0.23) ,-". . Appearance of Operations: Generally, Posi-Shelllooks as good or better than soil cover. While a very well applied soil cover may initially look better than Posi-Shell, Posi-Shell is a close second when the waste _'___'..__m.._ .. "~.."~ --~_." "'.'_.--.'- ..._~,--,~, is well walked in before application. The difference is that Posi-Shell is not attacked as badly by birds and that it is very easy to touch up so that after a period of time, a Posi-Shell covered waste surface tends to look better than a soil surface. A soil surface protected with Posi-Shell has a very good appearance for long periods of time. (Average Score +1.39) . Fire Control: No problems were encountered. To be evaluated further by FDEP. (Average Score 0.18) . Weather Conditions: During the dry season pilot, we have experienced wind and a few rainfall events. Wind has not posed a problem at all. We have been impressed with how well we can spray into a strong wind. Photos 15 & 16 show minimal damage after a rain event. Rainfall did not prevent our application of Posi-Shell during this reporting period, but soil should be stockpiled as a contingency in the event of hard rain. The wet season pilot study will yield more useful results. (Average Rainfall 0.04"/day) . Staffing Requirements: One person can handle mixing and applying Posi-Shell, but two allow the job to be accomplished sooner. Once the operators became experienced with the technique, the total time for mixing, application and cleaning has typically been 1 Y. to 1 % hours for two people. There is likely some additional time related to filling the water truck that was not reflected in the captured data. . Working Face: We have covered from about 6,000 sq. ft. to over 15,000 sq. ft. per load. For a working face that has been well walked in, we have achieved good results up to about 12,000 sq. ft. or sometimes a little more. Above 13,500 sq. ft., results will not be acceptable. During the dry season pilot, the area to be covered has been unusually large while we were receiving large daily quantities of asbestos. It was also quite large during a few of the trials of a two-day lift. For the dry season pilot, the lift height has typically been about 14' to 18'. This minimizes the total area to be covered but makes the sloping part of the working face to be covered with Posi-Shelllarger. One load of Posi,Shell should be more than adequate for daily working faces of this height. . Airspace Consumption: Airspace Utilization Factor (AUF) was measured during the pilot test period of March 18 through May 9, 2007. This measured AUF was then compared to historical data measured over several other periods. Because settlement can greatly affect AUF, the test period AUF was compared to the Q2 2006 AUF data. The reason for this was due to the fact that these lifts were very similar in that they were both from an initial fill lift (fluff lift) of a new cell. Initially it was thought that the use of posi-shell would yield a 21 % increase in AUF. The actual increase in AUF between these two periods was measured to be 38.7%. It should - be noted that variations in waste streams and initial compaction can affect performance but the improvement is clearly documented not only by this initial result but also by the reduced use of soil cover. A summary of the AUF measurements is provided in Appendix 3. . Contingency Plan: A stockpile of soil is necessary in case of untimely rainfall or equipment failure. Equipment failure caused WMI F to execute this plan during the dry season pilot. It is anticipated that this contingency will be required and utilized during the rainy season when rainfall in the afternoon becomes frequent. . Post Application Conditions: By the nature of the surfaces we are covering with Posi-Shell, they tend to be covered again with additional waste within a few days. Generally, if the waste is well walked in to a relatively smooth surface and if the area covered is less than about 12,000 sq. ft., Posi-Shelllooks quite good and stands up well over long periods of time. Rainfall within 2 hours or so can damage a Pas i-Shell covered surface significantly. Rainfall after that initial period will cause much less damage. Surfaces covered with Posi,Shell and then later touched up seem to stand up very well for long periods of time COST ANALYSIS: .-." Detailed cost tracking was performed during the pilot test period. Actual cost for the application of initial cover was tracked starting in January 1, 2007. Soil use was tracked and recorded on Soil use logs provided in Appendix 4 of this report. Pas i-shell use was initiated on March 20, 2007. At that time all cost including soil usage was captured and compared to the previous period when only soil was used. This comparison indicates that the use of posi shell during the dry months has the potential to reduce initial cover cost by as much as 50%. A detailed analysis and summary is provided in Appendix 5. It should also be noted that a further cost saving could be realized with the use of crushed concrete. Typically, crushed concrete can be purchased or manufactured for 10% to 50% less than the purchase of soil. CONCLUSION: Posi-shell has performed very well as compared to soil as initial cover. In nearly every performance category, posi-shell exceeded the performance of soil while providing a cost savings. Additionally, a clear increase in AUF was also measured. - -.._.,,-- . _.,~"_ " _,_.,w_._'" -- --<---_.....- . --.----- This pilot test was limited to the dry season. In order to provide a better understanding of its long-term performance, it is recommended that the pilot program be extended and closely monitored during the wet season. Additionally, it is recommended that crushed concrete be included and encouraged in the pilot program. This is particularly critical during the wet season to properly analyze the benefits of this material. It is anticipated that this material will perform better than soil in increment weather. It is further recommended that WMIF be reimbursed for the use of crushed concrete since this material is being directly substituted for soil, has the same material characteristics as soil and cost less. Proposed Fifth Amendment Dear Ms. Best: As requested I have review the proposed Fifth Amendment to the Landfill Operating Agreement between Collier County and Waste Management Inc. of Florida. I have also reviewed supporting documentation you provided. I conclude: 1. The proposed methodology for reimbursing Waste Management for cover material is a significant improvement over the current methodology. The current method has lead to disputes and was difficult to administer. The proposed method is simpler and clearer and should be much easier to administer. 2. The Amendment permits Waste management to supplement soil cover material with mulch and alternative daily cover. Technically these are sound alternatives which have the potential to save money and save airspace while still being environmentally sound. 3. The proposed methodology gets the incentives right: Waste Management will be encouraged to use a combination of soil. mulch, and alternative cover material so as to save money and maximize airspace. This will benefit both the County and Waste Management. 4. The proposed methodology for adjusting costs appears to be sound. I would recommend that the Fifth Amendment be adopted.
